The selection of decisions spans from 2013 to the date of publication.CAFA was enacted with the stated purpose of expanding the number of class actions that could be heard in federal court. Amoche, 556 F.3d at 47, 49 (stating that, "[i]n CAFA, Congress expressly expanded federal jurisdiction largely for the benefit of defendants against a background of what it considered to be abusive class action practices in state courts," "which had 'harmed class members with legitimate claims and defendants that had acted responsibly,' 'adversely affected interstate commerce,' and 'undermined public respect for our judicial system'" (alteration omitted) (quoting CAFA, Pub.L. No. 109-2, § 2(a), 119 Stat. 4, 4 (2005))). Congress effectuated that purpose "by imposing only a minimal diversity requirement, eliminating the statutory one-year time limit for removal, and providing for interlocutory appeal of a federal district court's remand order." Id. at 47-48 (citing 28 U.S.C. §§ 1332(d)(2), 1453(b), (c)). Pazol v. Tough Mudder Inc., 819 F. 3d 548 (1st Cir. 2016).CAFA extends federal jurisdiction to certain large class action lawsuits. Hollinger v. Home State Mut. Ins. Co., 654 F.3d 564, 569 (5th Cir.2011). CAFA jurisdiction may be exercised where the proposed class is at least 100 members, minimal diversity exists between the parties, the amount in controversy is greater than $5,000,000, and the primary defendants are not states, state officials, or other government entities. 28 U.S.C. § 1332(d)(2), (5). Arbuckle Mountain Ranch v. Chesapeake Energy, 810 F. 3d 335 (5th Cir. 2016).CAFA was enacted in 2005, approximately 15 years after Congress passed the supplemental jurisdiction statute. CAFA itself "dramatically expanded federal jurisdiction over class actions." Greenwich Fin. Servs. Distressed Mortg. Fund 3 LLC v. Countrywide Fin. Corp., 603 F.3d 23, 32 (2d Cir. 2010). It did so with the "primary objective" of "ensuring Federal court consideration of interstate [class action] cases of national importance." Standard Fire Ins. Co. v. Knowles, --U.S.--, 133 S. Ct. 1345, 1350 (2013) (internal quotation marks omitted). By bringing large class actions within the jurisdiction of the federal courts, CAFA also sought to "curb perceived abuses of the class action device which . . . had often been used to litigate multi-state or even national class actions in state courts." The current controversy, centered on lawsuits for money damages, is characterized by sharp disagreement among stakeholders about the kinds of suits being filed, whether plaintiffs' claims are meritorious, and whether resolutions to class actions are fair or socially desirable. Ultimately, these concerns lead many to wonder, Are class actions worth their costs to society and to business? Do they do more harm than good? To describe the landscape of current damage class action litigation, elucidate problems, and identify solutions, the RAND Institute for Civil Justice conducted a study using qualitative and quantitative research methods. The researchers concluded that the controversy over damage class actions has proven intractable because it implicates deeply held but sharply contested ideological views among stakeholders. Nevertheless, many of the political antagonists agree that class action practices merit improvement. The authors argue that both practices and outcomes could be substantially improved if more judges would supervise class action litigation more actively and scrutinize proposed settlements and fee awards more carefully. Educating and empowering judges to take more responsibility for case outcomes--and ensuring that they have the resources to do so--can help the civil justice system achieve a better balance between the public goals of class actions and the private interests that drive them.

Book excerpt: Class actions -- once the modus operandi of civil rights litigation -- recently underwent sweeping changes as a result of the Class Action Fairness Act of 2005. Civil rights groups vehemently opposed the Act, joining forces at various times with consumer, environmental, and labor groups in an effort to defeat the bill. The most controversial provision of the Act subjects many state law class actions to federal court jurisdiction, allowing these actions to be originally filed in federal court or removed from state to federal court. On the eve of CAFA's passage, civil rights groups in conjunction with labor organizations sought unsuccessfully to exclude state law civil rights and employment actions from this extraordinary expansion of federal jurisdiction. Yet this aspect of the legislation's history and its consequences remain unexamined, rendering CAFA largely absent from conversations about the direction of civil rights advocacy in the courts. This Article fills the void by analyzing the history of the failed “civil rights exemption” to CAFA and its ramifications for the civil rights and employment actions it aimed to address. This examination reveals that scores of state law employment class actions have been removed to federal court pursuant to the Act, resulting in the federalization of single-state employment classes -- a striking departure from the national class actions originally targeted by CAFA. For the labor movement, which has steadily relied less on the National Labor Relations Act and more on complex legal and public relations strategies to build union strength, the federalization of state employment class actions may be an unfortunate development. By contrast, few state civil rights class actions have been removed to federal court. Though firm conclusions must await further research, there are several possible explanations for the dearth of state law civil rights class actions in federal court post-CAFA. This Article reflects on the role of the class action device in a post-CAFA era for civil rights and employment advocacy. While class action remains an important impetus for institutional change, CAFA and other recent limitations on the device illustrate the need to critically consider its role among the tools increasingly employed by civil rights and employment advocates.
