By recommending funding levels, creating new policies, and implementing new programs; successive administrations have adapted preparedness efforts to align with changing domestic priorities and foreign policy goals. They have also instituted administrative reorganizations that reflected their preference for consolidated or dispersed civil defense and homeland security responsibilities within the Federal government. Programs were seldom able to get ahead of world events, and were ultimately challenged in their ability to answer the public's need for protection from threats due to bureaucratic turbulence created by frequent reorganization, shifting funding priorities, and varying levels of support by senior policymakers. This in turn has had an effect on the public's perception of national preparedness. Public awareness and support have waxed and waned over the years, as the government's emphasis on national preparedness has shifted. An analysis of the history of civil defense and homeland security programs in the United States clearly indicates that to be considered successful, national preparedness programs must be long in their reach yet cost effective. They must also be appropriately tailored to the Nation's diverse communities, be carefully planned, capable of quickly providing pertinent information to the populace about imminent threats, and able to convey risk without creating unnecessary alarm. The following narrative identifies some of the key trends, drivers of change, and lessons learned in the history of U.S. national preparedness programs. A review of the history of these programs will assist the Federal government in its efforts to develop and implement effective homeland security policy and better understand previous national preparedness initiatives.

This monograph provides and examination of the legal, and traditional aspects of Homeland Security in the U.S. and the current framework for managing a domestic Weapons of Mass Destruction (WMD) incident. Understanding the past roles and missions of the DoD in regard to Homeland Security are relevant as the Office of Homeland Security (OHS) formulates a comprehensive national strategy for Homeland Security. Throughout the Nation's history, the American public has consistently equated Homeland Security with the Armed Forces. Immediately following the 11 September attacks there was confusion among many in the U.S. government as to which federal agency was responsible for Homeland Security. Several key members of the Senate Armed Services committee expressed concern over the current security framework and the DoD's supporting role in domestic Homeland Security. This monograph addresses these issues through an examination of the DoD's (Armed Forces) historical role in the defense of the nation as well as its role in domestic support operations. The monograph begins with a brief analysis of the emerging threats that the United States faces, and offers a proposed definition for Homeland Security. This is followed by an examination of the evolution of legal considerations when employing federal military forces in a domestic support capacity. It addresses the Posse Comitatus Act and recent refinements to the Act that circumvent its provisions in instances of clearly identified threats to the Nation's interests. The second chapter includes an analysis of Civil Defense and the DoD's participation in past Civil Defense missions. A chronology of Civil Defense in America is included beginning with post World War I activities up through the present time. This analysis illustrates that in time of crisis, when the public feels vulnerable, they look to the DoD for security. The monograph outlines the current DoD supporting role to both the FBI for Crisis Management and to the FEMA for Consequence Management during a WMD incident. The monograph argues that the current system is adequate and the DoD should not be designated as the LFA for WMD incidents. The monograph recommends the creation of a new Commander-in-Chief (CINC) for Homeland Security. This CINC should also be charged with the responsibility of developing the campaign for, and executing the global War on Terror. Additional recommendations include some minor changes to both Joint and Army doctrine in regard to Homeland Security. It also recommends that the DoD maintain a receptive attitude towards new domestic missions, advocating the temporary execution of non-traditional missions.

Left uncorrected, civic life and national continuity will remain increasingly at risk. At stake well beyond our shores is the stability and future direction of an international political and economic system dependent on robust and continued U.S. engagement. Outdated hierarchical, industrial structures and processes configured in 1947 for the Cold War no longer provide for the security and resilience of the homeland. Security governance in this post-industrial, digital age of complex interdependencies must transform to anticipate and if necessary manage a range of cascading catastrophic effects, whether wrought by asymmetric adversaries or technological or natural disasters. Security structures and processes that perpetuate a 20th century, top-down, federal-centric governance model offer Americans no more than a single point-of-failure. The strategic environment has changed; the system has not. Changes in policy alone will not bring resolution. U.S. security governance today requires a means to begin the structural and process transformation into what this book calls Network Federalism. Charting the origins and development of borders-out security governance into and through the American Century, the book establishes how an expanding techno-industrial base enabled American hegemony. Turning to the homeland, it introduces a borders-in narrative—the convergence of the functional disciplines of emergency management, civil defense, resource mobilization and counterterrorism into what is now called homeland security. For both policymakers and students a seminal work in the yet-to-be-established homeland security canon, this book records the political dynamics behind the creation of the Department of Homeland Security, the impact of Hurricane Katrina and the ongoing development of what is now called the Homeland Security Enterprise. The work makes the case that national security governance has heretofore been one-dimensional, involving horizontal interagency structures and processes at the Federal level. Yet homeland security in this federal republic has a second dimension that is vertical, intergovernmental, involving sovereign states and local governments whose personnel are not in the President’s chain of command. In the strategic environment of the post-industrial 21st century, states thus have a co-equal role in strategy and policy development, resourcing and operational execution to perform security and resilience missions. This book argues that only a Network Federal governance will provide unity of effort to mature the Homeland Security Enterprise. The places to start implementing network federal mechanisms are in the ten FEMA regions. To that end, it recommends establishment of Regional Preparedness Staffs, composed of Federal, state and local personnel serving as co-equals on Intergovernmental Personnel Act (IPA) rotational assignments. These IPAs would form the basis of an intergovernmental and interdisciplinary homeland security professional cadre to build a collaborative national preparedness culture. As facilitators of regional unity of effort with regard to prioritization of risk, planning, resourcing and operational execution, these Regional Preparedness Staffs would provide the Nation with decentralized network nodes enabling security and resilience in this 21st century post-industrial strategic environment.

Book excerpt: The U.S. military has provided support to civil authorities in response to civil emergencies and natural disasters dating back to the Truman era. The terminology applied to this function has varied over the years: military assistance, or military support to civil authorities; military support of civil defense; and employment of military resources in natural disaster emergencies within the United States. As will be illustrated in this report's discussion of U.S. Defense Department (DoD) regulatory documents, the specific responsibilities of the department and the service branches were initially divided between civil defense (attacks on the United States) and disaster-related civil emergencies, but now are addressed collectively as Military Support to Civil Authorities (MSCA) as a matter of departmental policy and doctrine. In addition, the events of September 11, 2001, and the subsequent creation of a homeland security infrastructure have resulted in the adoption of MSCA policy in the context of the broader issue of homeland defense. However, both the core regulations and the DoD internal directive that govern MSCA predate the post-9/11 world, because they were adopted in 1993. In addition, the primary statutory authority for these documents is the Federal Civil Defense Act of 1950, which was repealed in 1994. Consequently, all of the recent policy statements defining MSCA and establishing DoD's role are found in homeland security directives and strategy documents issued by the White House and the military. The U.S. Department of Defense, in its 2005 Strategy for Homeland Defense and Civil Support, defines defense support of civil authorities as "DoD support, including Federal military forces, the Department's career civilian and contractor personnel, and DoD agency and component assets, for domestic emergencies and for designated law enforcement and other activities." This function is provided when DoD is directed to do so by the president or the secretary of defense. A report on the future of the National Guard and Reserves issued in 2006 defines "civil support" as "an umbrella term that encompasses the support the Department of Defense could provide as part of a response to a natural disaster or terrorist attack, to include an event involving chemical, biological, nuclear, radiological, or explosive materials (CBRNE), as well as support DoD could provide for other law enforcement activities." DoD's Homeland Security doctrine issued by the Joint Chiefs of Staff in August 2005 states "MSCA is the most widely recognized form of DOD Civil Support because it usually consists of support for high-profile emergencies such as natural or manmade disasters that often invoke Presidential or state emergency/disaster declarations. DOD assistance should be requested by an LFA (Lead Federal Agency) only when other local, state and federal capabilities have been exhausted or when a military-unique capability is required." MSCA is generally provided during natural disasters, special security events, and accidental or intentional manmade disasters that have evoked a presidential or state emergency declaration. Major Robert Preiss, a former strategic analyst in the National Guard Bureau, defined MSCA in 2003 as "assistance to civilian governmental entities - Federal, state, or local - that the services may provide to help manage a crisis, attack, or calamity." The National Response Plan issued by the Department of Homeland Security in December 2004, which is discussed in greater detail in a separate section of this report, also stipulates that DoD civil support is generally provided only when local, state and other federal resources are "overwhelmed."
