Book Synopsis The Application of the Precautionary Principle in Practice by : Joakim Zander
Download or read book The Application of the Precautionary Principle in Practice written by Joakim Zander and published by Cambridge University Press. This book was released on 2010-08-19 with total page pages. Available in PDF, EPUB and Kindle. Book excerpt: This overview of the role played by the precautionary principle in international trade law, European law and national law compares how precautionary considerations have been applied in the fields of pesticide regulation and the regulation of base stations for mobile telephones in Sweden, the UK and the US. A number of problems in the current application of the precautionary principle are identified and discussed. For example, it is shown that a firm reliance on a wide and open-ended precautionary principle may lead to problems with the consistency, foreseeability, effectiveness and efficiency of measures intended to reduce environmental or health risks. It is suggested that the precautionary principle indeed may be an important tool, but that in order to be acceptable it must be coupled with strong requirements on the performance of risk assessments, cost/benefit analyses and risk trade-off analyses.
Book Synopsis Dumbing Down the Courts by : John R. Lott, Jr.
Download or read book Dumbing Down the Courts written by John R. Lott, Jr. and published by Hillcrest Publishing Group. This book was released on 2013-09-17 with total page 355 pages. Available in PDF, EPUB and Kindle. Book excerpt: Judges have enormous power. They determine whom we can marry, whether we can own firearms, whether the government can mandate that we buy certain products, and how we define "personhood." But who gets to occupy these powerful positions? Up until now, there has been little systematic study of what type of judges get confirmed. In his rigorous yet readable style, John Lott analyzes both historical accounts and large amounts of data to see how the confirmation process has changed over time. Most importantly, Dumbing Down the Courts shows that intelligence has now become a liability for judicial nominees. With courts taking on an ever greater role in our lives, smarter judges are feared by the opposition. Although presidents want brilliant judges who support their positions, senators of the opposing party increasingly "Bork" those nominees who would be the most influential judges, subjecting them to humiliating and long confirmations. The conclusion? The brightest nominees will not end

Book Synopsis Planning Reform in the New Century by : Daniel R. Mandelker
Download or read book Planning Reform in the New Century written by Daniel R. Mandelker and published by Routledge. This book was released on 2005 with total page 372 pages. Available in PDF, EPUB and Kindle. Book excerpt: Do urban growth boundaries actually manage growth? How can the chaotic common law of vested rights be tamed? How can we make the development review process fair? Should housing policies be taken out of the hands of local boards? Planning's leading thinkers tackled these questions and others in a December 2004 conference sponsored by the Center for Interdisciplinary Studies at the Washington University School of Law and the American Planning Association. ?Planning Reform in the New Century ? is the record of their spirited debate. Planning has reached a turning point. Problems the profession has grappled with for years remain unsolved. Programs once heralded as panaceas are stumbling. Current legislation is inadequate for the demands of the new century. With tough criticisms and bold ideas, these planners, lawyers, and researchers offer their perspectives on the pitfalls and opportunities that await the profession. Their observations on statutory reform, affordable housing, growth management and the role of the comprehensive plan in land-use decisions are a blueprint for planning reform.

Book Synopsis Special Education Law by : Peter S. Latham
Download or read book Special Education Law written by Peter S. Latham and published by Allyn & Bacon. This book was released on 2008 with total page 214 pages. Available in PDF, EPUB and Kindle. Book excerpt: Clear, well organized presentation of IDEA and other pertinent federal laws, together with well organized discussion of relevant cases, help educators understand and apply their knowledge in concrete situations. The emphasis of this practical book is on increasing understanding at a conceptual level rather than rote memorization of detailed provisions of the IDEA and other laws. By understanding the law, educators will be better equipped to work with future amendments of IDEA and with new laws that may be enacted by Congress. They will also have an increased ability to apply statutory provisions to specific situations. Part I - Constitutional Framework: provides important background in understanding the authority that Congress has to enact laws that impact on education in the United States and the authority that the courts have to interpret laws. Includes discussion of the judicial system, the key provisions of the United States Constitution, due process, equal protection, the statutes of certain regulations, and a brief overview and comparison of the Individuals with Disabilities Education Act (IDEA), the Rehabilitation Act (RA), and the Americans with Disabilities Act (ADA). Part II - IDEA: covers background, basic language and coverage, duty to evaluate, FAPE, IEP, placement, related services, inclusions/least restrictive environment, private school, discipline, mediation, due process, and court proceedings. Sample forms are included to supplement discussion with concrete examples to aid understanding. Part III - RA and ADA: covers RA/ADA basics, such as who is an individual with a disability, what entities are covered, enforcement provisions, and application to schools, universities, and employers. Part IV - Other Legal Issues: covers No Child Left Behind, FERPA, tort liability, and high stakes testing issues. At the end of each part there is a very basic question and answer section to assist the student in focusing on major points in each part.
