Book excerpt: The Research Handbook on European Social Security Law critically examines the various European dimensions of social security. The collection discusses a wide range of questions and dilemmas ensuing from the present state of European social security law, whilst at the same time identifying future lines of inquiry that are likely to dominate the discourse in the coming years. This Handbook encompasses numerous dimensions of European social security law, including: social security as a human right; standard setting in social security; the protection of mobile persons and migrants; as well as the global context of European social security law. It pays attention to both EU law and to various instruments of the Council of Europe. Throughout the book's chapters prominent experts analyse contemporary debates, discuss new challenges and point out further lines of research. Via this exploration, the Handbook provides a source of inspiration for the development of this special field of law. Covering a breadth of topic and research, scholars and practitioners alike will find this Research Handbook to be an invaluable source of information.

Available in PDF, EPUB and Kindle. Book excerpt: Previous efforts at legal development have focused almost exclusively on state legal systems, many of which have shown little improvement over time. Recently, organizations engaged in legal development activities have begun to pay greater attention to the implications of local, informal, indigenous, religious, and village courts or tribunals, which often are more efficacious than state legal institutions, especially in rural communities. Legal pluralism is the term applied to these situations because these institutions exist alongside official state legal systems, usually in a complex or uncertain relationship. Although academics, especially legal anthropologists and sociologists, have discussed legal pluralism for decades, their work has not been consulted in the development context. Similarly, academics have failed to benefit from the insights of development practitioners. This book brings together, in a single volume, contributions from academics and practitioners to explore the implications of legal pluralism for legal development. All of the practitioners have extensive experience in development projects, the academics come from a variety of backgrounds, and most have written extensively on legal pluralism and on development.

Book excerpt: Franco Basaglia (1924-1980) was an Italian psychiatrist and activist who proposed the dismantling of psychiatric hospitals and pioneered new ideas about mental health and its treatment. Basaglia was also one of the principal proponents of Italy's Law 180, which effectively closed down large mental hospitals in Italy. His ideas and his disciples have had a decisive influence in the move away from institutional care in many parts of the world, particularly in continental Europe and South America. However, Basaglia is strikingly absent from the literature in Germanic and Anglophone psychiatry. Most of the literature about Basaglia in the last 40 years has been published by his followers and supporters and has often been largely positive, with little exploration of differing responses or possible limitations of his model. Basaglia's International Legacy: From Asylum to Community provides an overview of current thinking and the international influence of Franco Basaglia. This resource draws on the combined knowledge of clinicians, policy makers, historians, and social scientists, including a handful of Basaglia's collaborators. It provides an in-depth understanding and critical analysis of the various applications of his thinking worldwide. Organised into three broad sections, chapters examine Basaglia's work and influence in Italy; in the 'Basaglian' countries of Europe and South America; and in those countries where his influence has either been rejected or significantly modified. The Editors bring together the contributions and draw out the important messages (both positive and negative) for current clinical practice and development within international mental health services.

Book excerpt: Americans now face a caring deficit: there are simply too many demands on people’s time for us to care adequately for our children, elderly people, and ourselves. At the same time, political involvement in the United States is at an all-time low, and although political life should help us to care better, people see caring as unsupported by public life and deem the concerns of politics as remote from their lives. Caring Democracy argues that we need to rethink American democracy, as well as our fundamental values and commitments, from a caring perspective. The idea that production and economic life are the most important political and human concerns ignores the reality that caring, for ourselves and others, should be the highest value that shapes how we view the economy, politics, and institutions such as schools and the family. Care is at the center of our human lives, but Tronto argues it is currently too far removed from the concerns of politics. Caring Democracy traces the reasons for this disconnection and argues for the need to make care, not economics, the central concern of democratic political life. Joan C. Tronto is a Professor in the Political Science Department at the University of Minnesota. She is the author of Moral Boundaries: A Political Argument for an Ethic of Care (Routledge).

Book excerpt: Rapid population aging, once associated with only a select group of modern industrialized nations, has now become a topic of increasing global concern. This volume reframes aging on a global scale by illustrating the multiple ways it is embedded within individual, social, and cultural life courses. It presents a broad range of ethnographic work, introducing a variety of conceptual and methodological approaches to studying life-course transitions in conjunction with broader sociocultural transformations. Through detailed accounts, in such diverse settings as nursing homes in Sri Lanka, a factory in Massachusetts, cemeteries in Japan and clinics in Mexico, the authors explore not simply our understandings of growing older, but the interweaving of individual maturity and intergenerational relationships, social and economic institutions, and intimate experiences of gender, identity, and the body.

Book excerpt: Since 1963, the state of Israel has awarded the title of “Righteous among the Nations” to individuals who risked their lives sheltering Jews during the Holocaust. This distinction remained solely an Israeli initiative until the late 1990s, when European governments began developing their own national categories, the most prominent of which was the “Righteous of France,” honoring those who protected Jews during the Vichy regime. In National Policy, Global Memory, Sarah Gensburger uses this dramatic episode to lend a new perspective to debates over memory and nationhood. In particular, she works to combine two often divergent disciplines—memory studies and political science—to study “memory politics” as a form of public policy.

Book excerpt: Care work, both paid and unpaid, contributes to well-being, social development and economic growth. But the costs of providing care are unequally borne across gender and social class. Feminist scholarship on the gendered construction of welfare provisioning and welfare regimes has produced a conceptually strong and empirically grounded analysis of care, reinforcing the necessity of rethinking the distinctions between "the public" and "the private" as well as the links between them. Yet this analysis, premised on post-industrial contexts, does not travel easily to other parts of the world. Many of its core assumptions – about family structures, labor markets, state capacities, and public social provisioning – do not hold for a wider range of countries. Drawing on original research on the care economy in three developing regions (Africa, Asia, Latin America), this volume addresses a major empirical lacuna while facilitating a conversation across the North-South divide.

Book excerpt: This book explores how around the world, women’s increased presence in the labor force has reorganized the division of labor in households, affecting different regions depending on their cultures, economies, and politics; as well as the nature and size of their welfare states and the gendering of employment opportunities. As one result, the authors find, women are increasingly migrating from the global south to become care workers in the global north. This volume focuses on changing patterns of family and gender relations, migration, and care work in the countries surrounding the Pacific Rim—a global epicenter of transnational care migration. Using a multi-scalar approach that addresses micro, meso, and macro levels, chapters examine three domains: care provisioning, the supply of and demand for care work, and the shaping and framing of care. The analysis reveals that multiple forms of global inequalities are now playing out in the most intimate of spaces.

Book excerpt: This work examines the experience of women providing care to children, disabled persons, the chronically ill, and the frail elderly. It differs from most writing about caregiving because it focuses on the providers rather than the care recipients. It looks at the experience of women caregivers in specific settings, exploring what caregiving actually entails and what it means in their lives

Book excerpt: First published in 1997, this volume aimed to study social care services as a specific type of social policy that operates on a different set of principles as supportive services rather than as poor relief or social security work. The focus is on determining what is specifically Scandinavian about the world-famous Scandinavian welfare state, with studies on issues including the origins of four social care service models, the development of local authority social services in Iceland and social services as a gender issue.
