Book excerpt: To manage the problems related to the availability of Internet pornography in public libraries, Congress enacted the Children's Internet Protection Act (CIPA). It made the use of filtering software by public libraries a condition of the permit of federal funding. It was done to prevent minors from accessing content that is harmful to them. However, the District Court held these requirements invalid because they induce public libraries to violate consumers' First Amendment rights.

This is especially true for kids, who soak up new technologies like eager little sponges. They have access to an enormous array of material, including educational links, sports info, chat roomsâ€"and, unfortunately, pornography. But we must approach our need to protect children with care to avoid placing unnecessary restrictions on the many positive features of the Internet. Youth, Pornography, and the Internet examines approaches to protecting children and teens from Internet pornography, threats from sexual predators operating on-line, and other inappropriate material on the Internet. The National Research Council's Computer Science and Telecommunications Board explores a number of fundamental questions: Who defines what is inappropriate material? Do we control Internet access by a 17-year-old in the same manner as for a 7-year-old? What is the role of technology and policy in solving such a problem in the context of family, community, and society? The book discusses social and educational strategies, technological tools, and policy options for how to teach children to make safe and appropriate decisions about what they see and experience on the Internet. It includes lessons learned from case studies of community efforts to intervene in kids' exposure to Internet porn. Providing a foundation for informed debate, this very timely and relevant book will be a must-read for a variety of audiences.

Available in PDF, EPUB and Kindle. Book excerpt: Government's ever-increasing participation in communication processes, Mark Yudof argues, threatens key democratic values that the First Amendment was designed to protect. Government control over the exchange of ideas and information would be inconsistent with citizen autonomy, informed consent, and a balanced and mutually responsive relationship between citizens and their government. Yet the danger of government dominance must be weighed against the necessary role of government in furthering democratic values by proposing and promotion policies and by disseminating information and educating citizens. Restraints on government's ability to control communications processes are desirable, but excessive or inappropriate restrictions threaten democracy. Professor Yudof identifies a number of formal and informal checks on government as disseminator, withholder, and controller of ideas and information. Where more controls are needed, the strengthening of pluralism and legislative oversight is generally the answer. Constitutional redress in the courts should be sought only in extreme instances, he cautions, to avoid judicial interference with legitimate policy objectives.

This updated, everything-you-need-to-know reference removes the uncertainty. Internet and the Law: Technology, Society, and Compromises, Second Edition is the go-to source for anyone who needs clear explanations of complex legal concepts related to online practices and content. This wide-ranging, alphabetical reference explores diverse areas of law, including territorial jurisdiction and taxation, that are relevant to or affected by advances in information technology and the rise of the Internet. Particular emphasis is placed on intellectual property law and laws regarding freedom of expression. The Internet, as this book shows, raises questions not only about how to protect intellectual creations, but about what should be protected. Entries also discuss how the Web has brought First Amendment rights and free expression into question as society grapples with attempts to control "leaks" and to restrict content such as pornography, spam, defamation, and criminal speech.

Available in PDF, EPUB and Kindle. Book excerpt: Libraries are not exempt from the financial costs of data breaches or leaks, no matter the size. Whether from a library worker unwittingly sharing a patron’s address with a perpetrator of domestic violence to leaving sensitive patron data unprotected, patrons can also pay a hefty price when libraries fail to manage patron data securely and ethically. In this guide, readers will learn concrete action steps for putting the ethical management of data into practice, following two common public and academic library cumulative case studies. The authors explore such key topics as succinct summaries of major U.S. laws and other regulations and standards governing patron data management; information security practices to protect patrons and libraries from common threats; how to navigate barriers in organizational culture when implementing data privacy measures; sources for publicly available, customizable privacy training material for library workers; the data life cycle from planning and collecting to disposal; how to conduct a data inventory; understanding the associated privacy risks of different types of library data; why the current popular model of library assessment can become a huge privacy invasion; addressing key topics while keeping your privacy policy clear and understandable to patrons; and data privacy and security provisions to look for in vendor contracts.
