Available in PDF, EPUB and Kindle. Book excerpt: This thought-provoking work raises important questions about sex offender laws, drawing from personal stories, research, and data to prove the policies promote fear, destroy lives, and fail to protect children. Do sex offender laws protect children, or are they inherently unfair practices that, at their worst, promote vigilante justice? The latter, this book argues. By analyzing the social, political, historical, and cultural context surrounding the emergence of current sex offender policies and laws, the work shows how sex offenders have come to loom as greater-than-life monsters when, in many cases, that is not true at all. Looking at its subject from a fresh viewpoint, the book shares research and new analyses of data and qualitative evidence to show how sex-offender laws are not only ineffective, but engender destructive fear and anxiety. To help readers understand the impact of these laws, the author presents interviews with sex offenders and their families as they describe the day-to-day reality of living on the sex offender registry. Citing research and statistics, the book challenges the idea that sex offenders must be continually monitored and publicly identified because they are incurably predatory. Most important, the study shows that undue sex offender panic is preventing policymakers from addressing the true threats to children—poverty and growing inequality.

Book excerpt: This expanded and updated Second Edition of Legal Issues in Child Abuse and Neglect Practice offers a state-of-the-art exploration of what role the law can play in bettering the lives of victimized children. While all who work with abused children share the same goals, there often exists a gap in communication between legal and helping professionals that reduces efficacy of cooperative efforts. This new edition continues to provide vital information to non-lawyers on how the legal system in the United States works in child abuse cases.

Available in PDF, EPUB and Kindle. Book excerpt: This work is an important new edition of a classic study—one of the few exhaustive examinations of childhood sexual abuse available—with 40 percent new material. Even though it is as old as human history, child sexual abuse has generally remained a dark and well-hidden secret. Only in the last few decades has it become a topic of open public debate and scientific research, and we still have more questions than answers. How often are accusations of sexual abuse legitimate, and how often are they the result of false memories? Can sexual offenders be cured, or will they ultimately re-offend? These are only a few of the difficult questions this volume seeks to answer. Childhood Sexual Abuse: A Reference Handbook explores the many ways we define child sexual abuse in the United States and in different parts of the world and how those differences are represented in U.S. and international laws. It summarizes what we know about how to intervene, treat, and prevent childhood sexual abuse effectively and tells the stories of individuals who have had a dramatic effect on the handling of childhood sexual abuse. For students, social workers, teachers, policymakers, parents, and concerned citizens, this work offers a one-stop, multifaceted discussion of one of the major issues facing children and their families.

Available in PDF, EPUB and Kindle. Book excerpt: St. Mary County is a small rural midwestern enclave with a unique approach to handling accusations of child sexual abuse. Hoping to spare children the trauma of lengthy court appearances and probing interrogations, St. Mary's professionals strive to obtain confessions from accused sex offenders rather than ask the victim to bear the burden of proof. Treating this county as a critical case study, scholars from a variety of fields come together to analyze this community's unique approach. They address relevant case law, innovative treatments for both victim and offender, and the social history of child sexual abuse as a national policy concern. They cover legal burdens and scientific methods, prosecutors and protocol, the interrogation of victims and suspects, the use of expert witnesses, defense strategies, and practice wisdom in videotaping. In addition, they examine the unfolding drama of a single legal case from incidence to conviction. The result is a fascinating dialogue that confronts the unique complexities of child sexual abuse for readers on all sides of the issue. Introducing a model that makes enormous headway in the pursuit of justice, fairness, and trauma treatment, this interdisciplinary text is an indispensible tool for all communities seeking redress.

Book excerpt: Professionals from social work, psychology, nursing, medicine and related disciplines are increasingly being confronted by issues of law in their interaction with abused and neglected children. Serving to familiarize these practitioners with the innumerable legal implications of their day-to-day work, this volume delineates American legal aspects of interviewing children who may be abused or neglected. The author discusses expert testimony, focusing on the question of who is qualified to provide such testimony, what professionals may and may not say as expert witnesses, and explores how to cope with cross-examination in court cases.

Available in PDF, EPUB and Kindle. Book excerpt: When we consider the concept of sexual abuse and harassment, our minds tend to jump either towards adults caught in unhealthy relationships or criminals who take advantage of children. But the millions of maturing teenagers who also deal with sexual harassment can fall between the cracks. When it comes to sexual relationships, adolescents pose a particular problem. Few teenagers possess all of the emotional and intellectual tools needed to navigate these threats, including the all too real advances made by supervisors, teachers, and mentors. In Sexual Exploitation of Teenagers, Jennifer Drobac explores the shockingly common problem of maturing adolescents who are harassed and exploited by adults in their lives. Reviewing the neuroscience and psychosocial evidence of adolescent development, she explains why teens are so vulnerable to adult harassers. Even today, in an age of increasing public awareness, criminal and civil law regarding the sexual abuse of minors remains tragically inept and irregular from state to state. Drobac uses six recent cases of teens suffering sexual harassment to illuminate the flaws and contradictions of this system, skillfully showing how our current laws fail to protect youths, and offering an array of imaginative legal reforms that could achieve increased justice for adolescent victims of sexual coercion.

Available in PDF, EPUB and Kindle. Book excerpt: In the first half of the twentieth century, Americans' intense concern with sex crimes against children led to a wave of public discussion, legislative action, and criminal prosecution. Stephen Robertson provides the first large-scale, long-term study of how American criminal courts dealt with the prosecution of sexual violence against children. Robertson describes how the nineteenth-century approach to childhood as a single phase of innocence began to shift at the end of the century to include several stages of childhood development, prompting reformers to create legal categories such as statutory rape and carnal abuse to protect children. However, while ordinary New Yorkers' involvement in the prosecution of those offenses reshaped their understandings of who was a child and produced a new concern to establish the age of their sexual partners, their beliefs in childhood innocence and in a concept of sexuality centered on sexual intercourse remained unchanged. As a result, families' use of the law and jurors' decisions ultimately diminished the protection the new laws offered to children. Robertson's study, based on the previously unexamined files of the New York County district attorney's office, reveals the importance of child sexuality and sex crimes in twentieth-century American culture.

Available in PDF, EPUB and Kindle. Book excerpt: In the 1980s, Canada witnessed a public outcry over child sexual abuse cases. Elected officials sought a remedy through legal reforms. Amendments were made to the Criminal Code of Canada and sexual assault was redefined. The word "rape" was replaced with a continuum of categories intended to reflect the full range of sexually intrusive behaviours. Margaret Wright examines how the courts have dealt with child sexual abuse cases since then. She demonstrates that although the laws may have changed, their interpretation still depends on the social construction of children and on judges' own understanding of what constitutes child sexual abuse.

This book was released on 2013-11-12 with total page 479 pages. Available in PDF, EPUB and Kindle. Book excerpt: Every day in the United States, children and adolescents are victims of commercial sexual exploitation and sex trafficking. Despite the serious and long-term consequences for victims as well as their families, communities, and society, efforts to prevent, identify, and respond to these crimes are largely under supported, inefficient, uncoordinated, and unevaluated. Confronting Commercial Sexual Exploitation and Sex Trafficking of Minors in the United States examines commercial sexual exploitation and sex trafficking of U.S. citizens and lawful permanent residents of the United States under age 18. According to this report, efforts to prevent, identify, and respond to these crimes require better collaborative approaches that build upon the capabilities of people and entities from a range of sectors. In addition, such efforts need to confront demand and the individuals who commit and benefit from these crimes. The report recommends increased awareness and understanding, strengthening of the law's response, strengthening of research to advance understanding and to support the development of prevention and intervention strategies, support for multi-sector and interagency collaboration, and creation of a digital information-sharing platform. A nation that is unaware of these problems or disengaged from solutions unwittingly contributes to the ongoing abuse of minors. If acted upon in a coordinated and comprehensive manner, the recommendations of Confronting Commercial Sexual Exploitation and Sex Trafficking of Minors in the United States can help advance and strengthen the nation's emerging efforts to prevent, identify, and respond to commercial sexual exploitation and sex trafficking of minors in the United States.
