Book Synopsis Welfare's Forgotten Past by : Lorie Charlesworth
Download or read book Welfare's Forgotten Past written by Lorie Charlesworth and published by Routledge. This book was released on 2009-12-16 with total page 561 pages. Available in PDF, EPUB and Kindle. Book excerpt: That ‘poor law was law’ is a fact that has slipped from the consciousness of historians of welfare in England and Wales, and in North America. Welfare's Forgotten Past remedies this situation by tracing the history of the legal right of the settled poor to relief when destitute. Poor law was not simply local custom, but consisted of legal rights, duties and obligations that went beyond social altruism. This legal ‘truth’ is, however, still ignored or rejected by some historians, and thus ‘lost’ to social welfare policy-makers. This forgetting or minimising of a legal, enforceable right to relief has not only led to a misunderstanding of welfare’s past; it has also contributed to the stigmatisation of poverty, and the emergence and persistence of the idea that its relief is a 'gift' from the state. Documenting the history and the effects of this forgetting, whilst also providing a ‘legal’ history of welfare, Lorie Charlesworth argues that it is timely for social policy-makers and reformists – in Britain, the United States and elsewhere – to reconsider an alternative welfare model, based on the more positive, legal aspects of welfare’s 400-year legal history.

Download or read book Strengthening the Rule of Law through the UN Security Council written by Jeremy Farrall and published by Routledge. This book was released on 2016-04-14 with total page 329 pages. Available in PDF, EPUB and Kindle. Book excerpt: The UN Security Council formally acknowledged an obligation to promote justice and the rule of law in 2003. This volume examines the extent to which the Council has honoured this commitment when exercising its powers under the UN Charter to maintain international peace and security. It discusses both how the concept of the rule of law regulates, or influences, Security Council activity and how the Council has in turn shaped the notion of the rule of law. It explores in particular how this relationship has affected the Security Council’s three most prominent tools for the maintenance of international peace and security: peacekeeping, sanctions and force. In doing so, this volume identifies strategies for better promotion of the rule of law by the Security Council. This book will be of interest to scholars and students of international law, international relations, international development and peacekeeping.

Download or read book Comparative Company Law written by O. Nwafor and published by African Books Collective. This book was released on 2020-07-01 with total page 537 pages. Available in PDF, EPUB and Kindle. Book excerpt: Topics discussed in this book are deliberately comparative and show the different levels of the ground rules for the regulation of corporate operations in the different jurisdictions. The United Kingdom, Nigeria and South Africa are primarily chosen simply on the common law background upon which the statutory provisions in those countries are founded. There are also references to Canada, Australia and India on case by case basis to illustrate the differences in the application of the relevant legal principles and statutory interpretations. The insights gained should facilitate statutory amendments and effective adjustment in the operations of the regulatory agencies and business organizations. The book is written as an invaluable study material for students at the tertiary level. Illuminating the concepts from divergent perspectives avails the reader a broad range of explanations for a better understanding of the subject. Legal practitioners and the judiciary should also find in this work a good source of legal information on company law, especially whenever the need arises to seek persuasive guidance from the opinions of courts and writers on similar developments in cognate jurisdictions to give meaning to those difficult and uncharted courses in the discharge of their daily responsibilities of interpreting and applying the law as judicial officers. The book should be a handy material for those running the affairs of a company in understanding the rules of their engagement.
Book Synopsis The Corporation, Law and Capitalism by : Grietje Baars
Download or read book The Corporation, Law and Capitalism written by Grietje Baars and published by BRILL. This book was released on 2019-03-25 with total page 518 pages. Available in PDF, EPUB and Kindle. Book excerpt: In The Corporation, Law and Capitalism, Grietje Baars offers a radical Marxist perspective on the role of law in the global political economy. Closing a major gap in historical-materialist scholarship, they demonstrate how the corporation, capitalism’s main engine from city-state and colonial times to the present multinational, is a masterpiece of legal technology. The symbiosis between law and capital becomes acutely apparent in the question of ‘corporate accountability’. Baars provides a detailed analysis of corporate human rights and war crimes trials, from the Nuremberg industrialists’ trials to current efforts. The book shows that precisely because of law’s relationship to capital, law cannot prevent or remedy the ‘externalities’ produced by corporate capitalism. This realisation will generate the space required to formulate a different answer to ‘the question of the corporation’, and to global corporate capitalism more broadly, outside of the law.
