Available in PDF, EPUB and Kindle. Book excerpt: Challenging the myth that the federal government exercises exclusive control over U.S. foreign-policymaking, Michael J. Glennon and Robert D. Sloane propose that we recognize the prominent role that states and cities now play in that realm. Foreign Affairs Federalism provides the first comprehensive study of the constitutional law and practice of federalism in the conduct of U.S. foreign relations. It could hardly be timelier. States and cities recently have limited greenhouse gas emissions, declared nuclear free zones and sanctuaries for undocumented immigrants, established thousands of sister-city relationships, set up informal diplomatic offices abroad, and sanctioned oppressive foreign governments. Exploring the implications of these and other initiatives, this book argues that the national interest cannot be advanced internationally by Washington alone. Glennon and Sloane examine in detail the considerable foreign affairs powers retained by the states under the Constitution and question the need for Congress or the president to step in to provide "one voice" in foreign affairs. They present concrete, realistic ways that the courts can update antiquated federalism precepts and untangle interwoven strands of international law, federal law, and state law. The result is a lucid, incisive, and up-to-date analysis of the rules that empower-and limit-states and cities abroad.

Book excerpt: Tracing the historical roots of India`s federalism, this book analyzes the changes brought about by the shift from one-party dominance to coalition politics and multi-party governance. Coupled with these changes, the author maintains that the process of economic liberalization has permanently altered the federal calculus in India. The book argues that these developments have transformed federal relations in India from intergovernmental competition between the central government and the states to interjurisdictional cooperation between the states. As a result, the states no longer need to rely exclusively on the central government for their economic and industrial development.

Bringing to surface the complex dimensions that affect relations between India’s central government and states, this short introduction is the one-stop account to federalism in India. Paying attention to the constitutional, political, and economic factors that shape Centre–state relations, this book stimulates understanding of some of the big dilemmas facing India today. The ability of India’s central government to set the economic agenda or secure implementation of national policies throughout the country depends on the institutions and practices of federalism. Similarly, the ability of India’s states to contribute to national policy making or to define their own policy agendas that speak to local priorities all hinge on questions of federalism. Organised in four chapters, this book introduces readers to one of the key living features of Indian democracy.

Book excerpt: Abstract: For the first time since 1984, the 2014 general elections handed a majority in the Lok Sabha to a single party. This article provides a critical assessment of what the victory of the Bharatiya Janata Party has meant for the dynamics of center-state relations in India. In doing so, the article first engages with the concept of "competitive-cooperative federalism" and more widely with a framework that allows us to locate shifts in center-state relations across three dimensions: the political, the fiscal, and the administrative. Overall, we argue that despite the BJP's promise to put "center-state relations on an even keel" these relations have become more centralized under the Prime Ministership of Narendra Modi. At the same time, this process of centralization has not been uniform across the three identified dimensions: centralization is strongest in the political domain, but weakest in fiscal matters, where the central government felt bound by the recommendations of the XIV Finance

Book excerpt: A 70 page booklet describing the legal relationship between the States of the Union and the United States government. The States of the Union are sovereign and existed before the United States government was formed. The people of the States created the federal government as an agency to coordinate and simplify legal and business issues that differed among the States. The United States government is a federal government with limited, enumerated authority, not a national government with plenary, unlimited authority. The States of the Union are not subdivisions of the United States government, but are separate, distinct, and foreign to that government. Members of Congress are sent there by the vote of the people of the respective States of the Union to represent their wishes for how the United States government will create and enforce laws, regulations, and policies that affect them and other Americans in all the Union States and in the territories owned or managed by the United States government. Laws, regulations, and policies created for the territories have no authority in the States of the Union. The President is the CEO of the federal government and is required to properly enforce the laws enacted by Congress. We the people control the federal government through elections and the courts.
