By the sacrifice of some details of comparatively little importance to the American student (as in the chapters on Election, Satisfaction, and Perform ance, 461 of matters peculiar to the jurisdiction in individ ual states (as in 299 and by the free use of cross references (e. G., see 70-88, 151 it has been found possible to preserve intact those full discussions of the foundation and rationale of the various equitable doctrines which are the chief excellence of the work. The index (with some regret) has been greatly shortened; on the other hand, the chapter analyses have been retained without omissions, for the purpose of showing the author's full scheme of treatment of the various subjects. The ascertainment of principles is of importance as well to the study of the law, as to its successful amendment1 and judicial development. If the explanation of tacking here advanced be the true one, it will appear that there has been in recent times a tendency of the courts to extend in more than one direction that justly reprobated doctrine, which, however, ao cording to the accepted judicial axiom is to be applied only within the bare limits of the old authorities which established it. But if the theories put forward should prove upon further investigation not to be sustainable, they may perhaps claim the merit appertaining to hypotheses in general, that they are necessary steps to something more certain. Perhaps too the statement as a whole of equitable doctrine concerning the legal estate as it now stands - its intricacy, its fortuitous results, its occasional injustice, its technicality and immaturities - may help to make more clear the urgency of the case for the legislative reform of English property law. Book excerpt: The fair and equitable treatment (‘FET’) standard is a type of protection found in BITs which has become in the last decades one of the most controversial provisions examined by arbitral tribunals. This book first examines the interaction between the ‘minimum standard of treatment’ (MST) and the FET standard and the question why States started referring to the former in their BITs. It also addresses the question whether the FET should be considered as an autonomous standard of protection under BITs. This book also examines the controversial proposition that the FET standard should now be considered as a rule of customary international law. I will show that while the practice of States to include FET clauses in their BITs can be considered as general, widespread and representative, it remains that it is not uniform and consistent enough for the standard to have crystallised into a customary rule. States also lack the necessary opinio juris when including the clause in their BITs.
