Book excerpt: Excerpt from Cases Decided on the British North America Act, 1867, Vol. 2: In the Privy Council, the Supreme Court of Canada, and the Provincial Courts The present volume contains the reported cases in the Court of Queen's Bench and the Superior and other Courts of Quebec, and in the Supreme Courts of Nova Scotia and New Brunswick. It also contains the cases in the Privy Council, the Supreme Court of Canada, and the Superior Courts of Ontario, published since June, 1882. Some important cases not having as yet been finally disposed of are reserved for a future volume. The method of arrangement adopted in the former volume has been retained. The head notes have in all cases been revised or re-written. As in the case of the former volume, where any part of a judgment has been omitted, the omission has been marked by asterisks or otherwise; the omissions being such matters only as do not affect the constitutional points. Square brackets, thus [ ], shew that the words placed within them are introduced by the editor. The quotations and references in the various judgments have, as far as possible, been verified and corrected. The case of Smith v. The Merchants' Bank, Vol. I., p. 828, has been reversed by the Ontario Court of Appeal on grounds which do not affect the constitutional question, though some of the Appeal Judges expressed disapproval of the decision as to that point The judgment of the Court of Appeal is not yet reported, and the case has been carried to the Supreme Court of Canada, and now stands for judgment The editor will be glad to have his attention called to any cases on the construction of the B.
