Particularly, it investigates factors that facilitate collusion of car part manufacturers. Furthermore, it focuses on cartelization in procurement auctions as the touch point of automotive manufacturers and suppliers where collusive activities are executed. Hence, it examines the current state of theoretical research on collusive mechanism in auctions and provides implications for further research. Finally, it analyzes approaches to prevent collusion and assesses whether such measures are applicable to the automotive industry. The thesis is structured as follows: After this introduction, chapter two defines the scope of the industry for this paper and provides a broad overview of its different sectors and significant players. In addition, due to their overall importance for the following analysis, procurement and bidding processes in the automotive industry are exhibited upfront. To emphasize the industry’s importance for the EU, an outline of the state of this industry sector in the EEA is given. Building on that, chapter three presents a general introduction to cartelization in the automotive industry, followed by a presentation of three representative recent cartel cases in the EU: Car Glass, Automotive Bearings and Parking Heaters. This sets ground for a detailed analysis of the prevailing environment in the automotive industry. First, the analysis examines the manufacturer side including degrees of concentration, dominant strategies and effects of the automotive manufacturers’ market power. This is followed by an analysis of the supplier side regarding concentration and barriers to entry. Contingent on the analysis, factors that facilitate collusion in the automotive industry are summarized To introduce collusion in auctions, chapter four starts with an outline of the theoretical foundation of auction theory. Based on this, auction formats that foster collusion and stability of cartels are discussed. Furthermore, the most relevant incentive compatible mechanisms are introduced distinguishing between one-shot and repeated auction games.

The data and legal evidence suggest that the cartels in the two states allocate contracts in different ways: One cartel divides the market among members, while the other cartel also uses side payments to compensate that both forms of cartel agreements are almost optimal, provided the number of contracts is sufficiently large. In the auction the cartel bidder may face competition from non-cartel bidders. The presence of an optimal cartel induces an asymmetry in the auction. The selected cartel bidder is bidding as a representative of a group and has on average a lower cost than a non-cartel bidder. The data support the predicted equilibrium bidding behaviour in asymmetric auctions in accordance with optimal cartels.

The longstanding condemnation under the US Sherman Act of 1890 has been taken up (although in a rather different form) during the last thirty years in the EC/EU and in European national jurisdictions in particular, but also in a range of countries outside North America and Europe. Legal control has not only extended geographically but has intensified, as a number of jurisdictions have moved beyond administrative regulation and penalties to embrace enforcement through civil liability and (most significantly in terms of policy and rhetoric) the methods of criminal law. It is therefore timely to consider critically this development of legal control and assess its achievement to date and its future prospects. We find that bidders who win by a very small margin have significantly lower backlog than those who lose by a very small margin in the sample of procurement auctions from Indonesia, suggesting that bidders collude by bid rotation. Our results suggest that the proportion of noncompetitive auctions is at least about 5% for all E-procurement auctions and about 3% for all auctions in Indonesia. We cannot reject the null of competition in other countries.

As a result, there is a high incentive for organizing cartels (the price elasticity of demand is zero below the base price) that are quite stable because there are no lasting benefits for cheaters. In such circumstances leniency programs are unlikely to help discovering cartels. Since all public procurement cartels operate through some form of bid rotation, public procurement officials have all the information necessary (but they have to collect evidence on a number of bids) to discover them, contrary to what happens in normal markets where customers are not aware of the existence of a cartel. However in order to promote reporting, the structure of incentives has to change. For example, the money saved from a carte, should at least in part remain with the administration that helped discovering it and the reporting official should have some career advantages. In any case, competition authorities should create a channel of communication with public purchasers, so that they would know that informing the Authority on any suspicion they may have on bid rigging is easy and does not require them to provide a full proof.
