Book excerpt: Managing the nation's air quality is a complex undertaking, involving tens of thousands of people in regulating thousands of pollution sources. The authors identify what has worked and what has not, and they offer wide-ranging recommendations for setting future priorities, making difficult choices, and increasing innovation. This new book explores how to better integrate scientific advances and new technologies into the air quality management system. The volume reviews the three-decade history of governmental efforts toward cleaner air, discussing how air quality standards are set and results measured, the design and implementation of control strategies, regulatory processes and procedures, special issues with mobile pollution sources, and more. The book looks at efforts to spur social and behavioral changes that affect air quality, the effectiveness of market-based instruments for air quality regulation, and many other aspects of the issue. Rich in technical detail, this book will be of interest to all those engaged in air quality management: scientists, engineers, industrial managers, law makers, regulators, health officials, clean-air advocates, and concerned citizens.

Book excerpt: Transportation conformity is required under the Clean Air Act (CAA) Section 176(c) to ensure that Federally-supported transportation activities are consistent with (“conform to”) the purpose of a State Implementation Plan (SIP). Transportation conformity establishes the framework for improving air quality to protect public health and the environment. Conformity to the purpose of the SIP means Federal Highway Administration (FHWA) and Federal Transit Administration (FTA) funding and approvals are given to highway and transit activities that will not cause new air quality violations, worsen existing air quality violations, or delay timely attainment of the relevant air quality standard, or any interim milestone. This Guide was prepared to help State and local officials understand transportation conformity and how conformity requirements relate to transportation investments in their communities. Specifically, the implications of conformity on metropolitan transportation plans, transportation improvement programs (TIPs), and transportation projects are discussed. The Guide provides overview information on the major elements of the conformity process and provides answers to basic questions. Several exhibits are included in the Guide to illustrate key elements of the conformity process. Appendices are also included that discuss the health effects of pollutants, options to reduce on-road mobile source emissions, and resource agency contacts.

Book excerpt: This practical guide to air pollution law governing stationary sources is essential to fully deciphering, applying, and complying with this highly complex area of the law. Corporate counsel, attorneys for regulated sources, federal, state, and local compliance officials and prosecutors, technical consultants, teachers of environmental law, students, legislators, and environmental policymakers will all benefit from Professor Reitze's clear, extensive analysis. This work builds on Professor Reitze's earlier work, Air Pollution Control Law: Compliance and Enforcement, to provide expanded coverage of new source review, hazardous air pollutants, interstate air pollution control, preconstruction and operating permits, and enforcement issues. Whether you are new to environmental law or have considerable experience with the Clean Air Act, this book is an invaluable companion to working your way through the regulatory maze surrounding stationary sources.

Book excerpt: EPA is issuing this guidance document to assist permit writers and permit applicants in addressing the prevention of significant deterioration (PSD) and title V permitting requirements1 for greenhouse gases (GHGs) that begin to apply on January 2, 2011. This document: (1) describes, in general terms and through examples, the requirements of the PSD and title V permit regulations; (2) reiterates and emphasizes relevant past EPA guidance on the PSD and title V review processes for other regulated air pollutants;2 and (3) provides additional recommendations and suggested methods for meeting the permitting requirements for GHGs, which are illustrated in many cases by examples. We believe this guidance is necessary to respond to inquiries from permitting authorities and other stakeholders regarding how these permitting programs will apply to GHG emissions. This document is organized into sections with supporting appendices. Section I describes the purpose of this document, describes the actions that led to the permitting of sources of GHGs, and provides a general background for the permitting of major stationary sources. Section II describes PSD applicability criteria and how to determine if a proposed new or modified stationary source is required to obtain a PSD permit for GHGs. Section III discusses the process that EPA recommends following to determine best available control technology (BACT) for GHGs for new sources and modified emissions units. Section IV discusses how other PSD permitting requirements are generally inapplicable or have limited relevance to GHGs. Section V describes considerations for permitting of GHGs under title V of the CAA. The appendices located at the end of this document include PSD applicability flowcharts for new and modified sources of GHGs, an example PSD applicability analysis for a modified source, example BACT analyses, compilations of resources for estimating emissions of GHGs and for finding control measures for sources of GHGs, and cost effectiveness calculation methodology

Book excerpt: "The United States Code is the official codification of the general and permanent laws of the United States of America. The Code was first published in 1926, and a new edition of the code has been published every six years since 1934. The 2012 edition of the Code incorporates laws enacted through the One Hundred Twelfth Congress, Second Session, the last of which was signed by the President on January 15, 2013. It does not include laws of the One Hundred Thirteenth Congress, First Session, enacted between January 2, 2013, the date it convened, and January 15, 2013. By statutory authority this edition may be cited "U.S.C. 2012 ed." As adopted in 1926, the Code established prima facie the general and permanent laws of the United States. The underlying statutes reprinted in the Code remained in effect and controlled over the Code in case of any discrepancy. In 1947, Congress began enacting individual titles of the Code into positive law. When a title is enacted into positive law, the underlying statutes are repealed and the title then becomes legal evidence of the law. Currently, 26 of the 51 titles in the Code have been so enacted. These are identified in the table of titles near the beginning of each volume. The Law Revision Counsel of the House of Representatives continues to prepare legislation pursuant to 2 U.S.C. 285b to enact the remainder of the Code, on a title-by-title basis, into positive law. The 2012 edition of the Code was prepared and published under the supervision of Ralph V. Seep, Law Revision Counsel. Grateful acknowledgment is made of the contributions by all who helped in this work, particularly the staffs of the Office of the Law Revision Counsel and the Government Printing Office"--Preface.

Book excerpt: Air Emissions from Animal Feeding Operations: Current Knowledge, Future Needs discusses the need for the U.S. Environmental Protection Agency to implement a new method for estimating the amount of ammonia, nitrous oxide, methane, and other pollutants emitted from livestock and poultry farms, and for determining how these emissions are dispersed in the atmosphere. The committee calls for the EPA and the U.S. Department of Agriculture to establish a joint council to coordinate and oversee short - and long-term research to estimate emissions from animal feeding operations accurately and to develop mitigation strategies. Their recommendation was for the joint council to focus its efforts first on those pollutants that pose the greatest risk to the environment and public health.
