Dahlan and published by UUM Press. This book was released on 2011-01-01 with total page 276 pages. Available in PDF, EPUB and Kindle. Book excerpt: Abandoned housing projects is one the major problems in housing industry in Peninsular Malaysia. The reasons leading to this problem are many. This catastrophe has caused multifarious problems to the stakeholders, particularly the purchasers who become the aggrieved parties. To date, there is no effective and once-and-for-all means to face the problems of abandoned housing projects. One of the factors which causes abandonment of housing projects in Peninsular Malaysia, is the lack of political will on part of the government to adopt an affirmative better housing delivery system such as the ‘full build then sell system’ and the introduction of a housing development insurance to face the problems of housing abandonment. This book provides in-depth analyses of the terms and conditions of the statutory standard sale and purchase agreements as enshrined in Schedules G, H, I and J of the Housing Development (Control and Licensing) Regulations 1989. The objective of this book, among others, is to identify the weaknesses of the terms of the agreements, if any, which may have contributed to the problem of abandoned housing projects and their consequential troubles. As comparative analyses, the terms and conditions of the sale and purchase agreements as applicable and enforced in the Republic of Singapore and New South Wales, Australia, are chosen. The purpose of these comparative analyses is to find the terms and conditions in these foreign jurisdictions’ agreements which can be learned and adopted in the statutory standard sale and purchase agreements (Schedules G, H, I and J). It is also for the betterment of the Malaysian housing industry as a whole, and to protect the interests of the stakeholders, in particular the purchasers as against the problems of housing abandonment and its consequences.

Book excerpt: Sale of Land in NSW: Commentary and Materials Sixth Edition analyses the effects of the 2017 standard form of contract for sale of land and the Conveyancing (Sale of Land) Regulation 2017 (NSW) on Conveyancing law and practice. The plain English style, carefully selected extracts and concise approach ensures readers gain a sound working knowledge of the fundamental legal principles of vendor and purchaser law. In the time since the last edition of this book, the law and practice of conveyancing has had to adapt to deal with the changing legal and regulatory environment. There have been three editions of the Standard From Contract in the last three years to deal with the introduction of electronic conveyancing and capital gains withholding for foreign residents, and further increases in the number and type of regulatory matters that affect the quality of land, including the requirement for warnings and vendor disclosure. The intent of this book is still to provide students with a sound introduction to the fundamental concepts of conveyancing law and practice; and to provide practitioners with a first point of reference from which to commence their research. We have sought in this edition to provide some comparative material on aspects of the law of conveyancing in other Australian jurisdictions. One thing that has stood out in preparing this edition has been the variety of standard form contracts in the Australian States and Territories and the extent of differences, both great and subtle, in their legislative regimes. It has not been possible to adopt a systematic review of those regimes, but where possible we have provided references to interstate statutes, or a short comparative commentary. The primary subject of the book, though, is the law of New South Wales. There have not been quite so many new decisions to extract as in the previous edition, but the interaction of principles of property, contract and equity has produced decisions on several practical aspects, such as the implications of providing settlement statements, and the relationship between the purchaser's obligation to submit a transfer and the vendor's obligation to convey

This book was released on 2011-01-01 with total page 204 pages. Available in PDF, EPUB and Kindle. Book excerpt: Abandoned housing project is one of the housing problems in Peninsular Malaysia. Even though there are laws and policies provided by the Malaysian Government to control the housing industry, the abandoned housing project is still an unsettled issue for the Malaysian Government to tackle. The real victims are the purchasers themselves. There is virtually no standard common way to face the problems of abandoned housing projects. Likewise, there is no similar specific method to deal with the rehabilitation of abandoned housing projects. This is due to the fact that in every abandoned housing project and its rehabilitation, the problem and issues faced by the stakeholders vary. Thus different methods are used to deal with the problems, especially to rehabilitate the projects. If the project is not variable for rehabilitation, the project will be stalled forever without any prospects for rehabilitation, to the detriment of the purchasers. This book discusses the law and practice in rehabilitating abandoned housing project in Peninsular Malaysia. Certain suggestions are also provided in this modest book for facing the problems of abandoned housing projects and their rehabilitation in Peninsular Malaysia and for the betterment of the housing industry in Peninsular Malaysia.
