Book excerpt: In 2017 four rivers in Aotearoa New Zealand, India, and Colombia were given the status of legal persons, and there was a recent attempt to extend these rights to the Colorado River in the USA. Understanding the implications of creating legal rights for rivers is an urgent challenge for both water resource management and environmental law. Giving rivers legal rights means the law can see rivers as legal persons, thus creating new legal rights which can then be enforced. When rivers are legally people, does that encourage collaboration and partnership between humans and rivers, or establish rivers as another competitor for scarce resources? To assess what it means to give rivers legal rights and legal personality, this book examines the form and function of environmental water managers (EWMs). These organisations have legal personality, and have been active in water resource management for over two decades. EWMs operate by acquiring water rights from irrigators in rivers where there is insufficient water to maintain ecological health. EWMs can compete with farmers for access to water, but they can also strengthen collaboration between traditionally divergent users of the aquatic environment, such as environmentalists, recreational fishers, hunters, farmers, and hydropower. This book explores how EWMs use the opportunities created by giving nature legal rights, such as the ability to participate in markets, enter contracts, hold property, and enforce those rights in court. However, examination of the EWMs unearths a crucial and unexpected paradox: giving legal rights to nature may increase its legal power, but in doing so it can weaken community support for protecting the environment in the first place. The book develops a new conceptual framework to identify the multiple constructions of the environment in law, and how these constructions can interact to generate these unexpected outcomes. It explores EWMs in the USA and Australia as examples, and assesses the implications of creating legal rights for rivers for water governance. Lessons from the EWMs, as well as early lessons from the new ‘river persons,’ show how to use the law to improve river protection and how to begin to mitigate the problems of the paradox.

Based on interviews, policy analysis and participatory observation, three features of markets for ecosystem services emerge as particularly problematic. First, the logic of displacement or the idea that particular elements of an ecosystem can be separated and traded across landscapes or watersheds runs counter to political interests, environmental beliefs and people's connections to specific places. The second problem is that of measurement. Quantification methods embed a range of often contentious assumptions and decisions about what counts when restoring ecosystems. The third problem is related to participation in environmental decision-making.

Book excerpt: Agricultural systems are no longer evaluated solely on the basis of the food they provide, but also on their capacity to limit impacts on the environment, such as soil conservation, water quality and biodiversity conservation, as well as their contribution to mitigating and adapting to climate change. In order to cope with these multiple service functions, they must internalize the costs and benefits of their environmental impact. Payments for ecosystem services are hoped to encourage and promote sustainable practices via financial incentives. The authors show that while the principle is straightforward, the practice is much more complicated. Whereas scenic beauty and protection of water sources provide benefits to the local population, carbon sequestration and biodiversity conservation can be considered international public goods, rendering potential payment schemes more complex. Few examples exist where national or international bodies have been able to set up viable mechanisms that compensate agricultural systems for the environmental services they provide. However this book provides several examples of successful programs, and aims to transfer them to other regions of the world. The authors show that a product can be sold if it is clearly quantified, there exists a means to determine the service's values, and there is a willing buyer. The first two sections of the book present methodological issues related to the quantification and marketing of ecosystem services from agriculture, including agroforestry. The third and final section presents case studies of practical payments for ecosystem services and experiences in Central and South America, and draws some lessons learnt for effective and sustainable development of ecosystem services compensation mechanisms.

Certification of ecosystem services is a useful concept, but many practical and theoretical obstacles must be addressed before it can be put into practice. This paper is a review of existing development in certification of ecosystem services, with information useful for designing and implementing projects to evaluate the efficacy of new systems. We discuss the potential use of more holistic concepts for measuring management sustainability, which are to date undeveloped and untested, and recommend developing pilot projects that are specifically designed to address a number of challenges inherent to ecosystem service certification.
