Volume 7: The Jurists’ Philosophy of Law from Rome to the Seventeenth Century edited by Andrea Padovani and Peter Stein Volume 7 is the second of the historical volumes and acts as a complement to the previous Volume 6, discussing from the jurists’ perspective what that previous volume discusses from the philosophers’ perspective. The subjects of analysis are, first, the Roman jurists’ conception of law, second, the metaphysical and logical presuppositions of late medieval legal science, and, lastly, the connection between legal and political thought up to the 17th century. The discussion shows how legal science proceeds at every step of the way, from Rome to early modern times, as an enterprise that cannot be untangled from other forms of thought, thus giving rise to an interest in logic, medieval theology, philosophy, and politics—all areas where legal science has had an influence. Volume 8: A History of the Philosophy of Law in The Common Law World, 1600–1900 by Michael Lobban Volume 8, the third of the historical volumes, offers a history of legal philosophy in common-law countries from the 17th to the 19th century. Its main focus (like that of Volume 9) is on the ways in which jurists and legal philosophers thought about law and legal reasoning. The volume begins with a discussion of the ‘common law mind’ as it evolved in late medieval and early modern England. It goes on to examine the different jurisprudential traditions which developed in England and the United States, showing that while Coke’s vision of the common law continued to exert a strong influence on American jurists, in England a more positivist approach took root, which found its fullest articulation in the work of Bentham and Austin.

The analysis goes from general to particular, starting with a theoretical overview on constitutionalism, human rights and Islam, moving to the assessment of the post-Arab Spring Constitutions of Egypt and Tunisia, and concluding with a specific focus on the rights of sexual minorities and freethinkers. Part I provides a theoretical account of the conception of constitutionalism and human rights in Islam, compared and contrasted with Western constitutionalism. A set of issues where the tension between sharica and human rights is accentuated is analysed against the backdrop of the main Islamic charters of rights. Part II conducts a similar assessment based on the Constitutions of Tunisia and Egypt – the two main epicentres of the Arab Spring. Part III moves to two specific rights in the same countries, from the twofold perspective of the Constitutions and international law: the freedom from interference in one’s intimate life, with particular regard to homosexuality; and the freedom of holding and expressing nonconventional beliefs, deemed unacceptable from the point of view of traditional Islam. These issues have been chosen as representative of the most controversial, still considered taboo in both legal and social terms, hence at the fringes of the debate on individual freedoms. Focusing on two overlooked and underexplored issues, the work thus pushes the boundaries of the human rights discourse in Muslim contexts.

Book excerpt: This intellectual biography provides an organic framework for understanding Antonio Gramsci’s process of intellectual development, paying close attention to the historical and intellectual contexts out of which his views emerged. The Gramsci in Notebooks cannot fully account for the young director of L’Ordine Nuovo, or for the communist leader. Gramsci’s development did not occur under conditions of intellectual inflexibility, of absence of evolution. However, there is a strong thread connecting the “political Gramsci” with Gramsci as a “cultivated man.” The Sardinian intellectual’s life is marked by the drama of World War I, the first mass conflict in which the great scientific discoveries of the previous decades were applied on a large scale and in which millions of peasants and workers were slaughtered. In all of his theoretical formulations, this dual relation, which epitomizes the instrumental use of “simpletons” by ruling classes, goes beyond the military context of the trenches and becomes full-fledged in the fundamental relations of modern capitalist society. In contrast with this notion of social hierarchy, which is deemed natural and unchangeable, Gramsci constantly affirmed the need to overcome the historically determined rupture between intellectual and manual functions, due to which the existence of a priesthood or of a separate caste of specialists in politics and in knowledge is made necessary. It is not the specific professional activity (whether material or immaterial) that determines the essence of human nature: to Gramsci, “all men are philosophers.” In this passage from Notebooks, we find the condensed form of his idea of “human emancipation,” which is the historical need for an “intellectual and moral reform”: the subversion of traditional relations between rulers and ruled and the end of exploitation of man by man.

His contribution turns on the theory of the suspended middle of the original relationship between the natural and the supernatural, which he experienced and elaborated. The device of the relationship between the original metaphysical-affective-symbolic structure of the believing conscience and the affective turn in metaphysics, intrinsically linked to his trinitarian ontology, allowed Rosmini to elaborate theories and epistemologies from a unitary perspective in various fields of knowledge. This volume indicates the implications of the unbreakable bond between Rosmini’s philosophy and theology in disciplines such as pedagogical science, political science, and juridical science. Following the favorable resolution of the “Rosminian question” the Catholic Church beatified Rosmini in 2007 and in 2018 indicated his theoretical-practical approach as a universal education model to be followed.
