Book excerpt: A regulação internacional dos investimentos estrangeiros decorre de um processo histórico de internacionalização de sua proteção, a partir de práticas e normas aplicadas desde as grandes navegações, incluindo os períodos do colonialismo e imperialismo, até o contexto contemporâneo pós-2ª Guerra Mundial, caracterizando o Direito Internacional do Investimento. As antigas metrópoles europeias, Estados Unidos e o Japão, constituem-se como as tradicionais economias exportadoras de capital enquanto as nações que se tornaram independentes nos séculos XIX, na América Latina, e XX, África e Ásia, qualificam-se como economias importadoras de capital. O século XXI, por sua vez, inaugura um novo paradigma do Direito Internacional do Investimento ao reconhecer novas nações exportadoras de capital: as economias emergentes. A alteração da conjuntura econômica global, observada em novos agrupamentos, como BRICS e G20, possibilitou o reconhecimento de recentes exportadores de capital, ainda que mantenham considerável nível de importação de capital. A alteração no paradigma de proteção do investidor estrangeiro, sobretudo, a partir de 2015, ocorre em três níveis, bilateral, regional e multilateral. Nesse sentido, as economias emergentes afastam-se do modelo de tomadoras de normas (rule takers) para se configurarem como formadoras de normas (rule makers). Na instância bilateral, observa-se a substituição dos tradicionais acordos bilaterais de investimento (Bilateral Investment Treatment - BITs) por instrumentos mais equilibrados, a criação de modelos próprios dos emergentes, a denúncia de BITs e a alteração para a facilitação do investimento, como no caso brasileiro dos Acordos de Cooperação e Facilitação do Investimento (ACFI). No nível regional, observa-se a criação de acordos a tratar de forma conjunta comércio e investimento, envolvendo grande número de países, conhecidos como os mega acordos. No nível multilateral, a ausência de acordos de investimentos, a falta de consenso para a finalização da Rodada de Doha e o bloqueio do Órgão de Apelação do Sistema de Controvérsias da Organização Mundial do Comércio contribuem para o retorno de práticas protecionistas dos países desenvolvidos, a fragmentação do sistema econômico global, a tendência à desglobalização e a pluralidade de tratados. Nesse sentido, a perspectiva emergente insere-se em duas espécies: (i) integração cautelosa, via modelos próprios de BITs dos emergentes, como China e Índia; e (ii) não integração ao sistema, como Brasil e África do Sul. A obra objetiva analisar de forma crítica o Direito Internacional do Investimento sob a perspectiva dos países emergentes, em especial considerando a posição histórica da América Latina, as estruturas neocoloniais e o tratamento unilateral conferido aos investidores estrangeiros, em prejuízo aos Estados receptores de investimento.

Book excerpt: This research evaluates whether the new model of investment agreement developed by Brazil (CFIA) is a mechanism for enhancing protection and respect for social and economic rights. The research starts by exploring the origins of investment treaties, their development and main characteristics. It examines why investment treaties and socio-economic rights are related, by mapping cases in which investment treaties have already impaired the protection of such rights. The research then analyzes how these two issues shall be jointly handled. It considers international organizations? initiatives to regulate business and human rights and investment treaties? frameworks that foster sustainable development, as well as new investment agreements? models developed by different countries, and then suggests criteria for evaluating whether an investment treaty is adequate from the socio-economic rights standpoint. Finally, this research investigates the CFIA model, brings a brief historical overview, evaluates CFIAs? wording, and examines how some CFIAs? institutional mechanisms consider corporate social responsibility issues. In conclusion, this research asserts that the CFIA model can be a mechanism for enhancing protection and respect for socio-economic rights, but some concerns (particularly related to safeguarding States? regulatory space and providing for stronger obligations to investors and States to protect human rights) need to be addressed.
