Book excerpt: The 'Gang Of 8' -- a bipartisan group of U.S. senators -- have introduced this landmark immigration bill that would bolster border security, legalize many of America's 11 million undocumented immigrants and put them on a path to citizenship, dramatically overhaul the legal immigration system, and crack down on employers who hire unauthorized workers. This is must reading for anyone interested in one of the major issues of the day.

Book excerpt: The Border Security, Economic Opportunity, and Immigration Modernization Act (S. 744) would revise laws governing immigration and the enforcement of those laws, allowing for a significant increase in the number of noncitizens who could lawfully enter the United States permanently or temporarily. The bill also would create a process for many currently unauthorized residents to gain legal status, subject to their meeting conditions specified in the bill. This report, the supplement to a cost estimate for S. 744, provides estimates of the overall economic impact of the legislation and of the incremental federal budgetary effects of changes in the economy that the cost estimate does not reflect. Ascertaining the effects of immigration policies on the economy and the federal budget is complicated and highly uncertain, even in the short run, and that task is even more difficult for longer periods; for that reason, this report addresses only the next 20 years. Book excerpt: The Border Security, Economic Opportunity, and Immigration Modernization Act (S. 744) would revise laws governing immigration and the enforcement of those laws, allowing for a significant increase in the number of noncitizens who could lawfully enter the United States permanently or temporarily.1 The bill also would create a process for many currently unauthorized residents to gain legal status, subject to their meeting conditions specified in the bill. The Congressional Budget Office (CBO) and the staff of the Joint Committee on Taxation (JCT) have prepared an estimate of the cost of that legislation to the federal government, including projections of the bill's effects on both federal spending and federal revenues.2 That cost estimate reflects some, but not all, of the effects that S. 744 would have on the economy. This supplemental report provides estimates of the overall economic impact of the legislation and of the incremental federal budgetary effects of changes in the economy that the cost estimate does not reflect. Available in PDF, EPUB and Kindle. Book excerpt: Immigration reform was an active legislative issue in the first session of the 113th Congress. The Senate passed the Border Security, Economic Opportunity, and Immigration Modernization Act (S. 744), a comprehensive immigration reform bill that includes provisions on border security, interior enforcement, employment eligibility verification and worksite enforcement, legalization of unauthorized aliens, immigrant visas, nonimmigrant visas, and humanitarian admissions. For its part, the House took a different approach to immigration reform. Rather than considering a single comprehensive bill, the House acted on a set of immigration bills that address border security, interior enforcement, employment eligibility verification and worksite enforcement, and nonimmigrant and immigrant visas. House committees reported or ordered to be reported the following immigration bills: Border Security Results Act of 2013 (H.R. 1417); Strengthen and Fortify Enforcement (SAFE) Act (H.R. 2278); Legal Workforce Act (H.R. 1772); Agricultural Guestworker (AG) Act (H.R. 1773); and Supplying Knowledge-based Immigrants and Lifting Levels of STEM Visas (SKILLS Visa) Act (H.R. 2131). This report discusses these and other immigration-related issues that received legislative action or have been of significant congressional interest in the 113th Congress.

Book excerpt: The Border Security, Economic Opportunity, and Immigration Modernization Act (S. 744) would revise laws governing immigration and the enforcement of those laws, allowing for a significant increase in the number of noncitizens who could lawfully enter the United States on both a permanent and temporary basis. Additionally, the bill would create a process for many individuals who are present in the country now on an unauthorized basis to gain legal status, subject to requirements specified in the bill. The bill also would directly appropriate funds for tightening border security and enforcing immigration laws, and would authorize additional appropriations for those purposes. This report provides a cost estimate of that legislation to the federal government, including projections of the bill's effects on both federal spending and federal revenues. Tables. Book excerpt: For several years, some Members of Congress have favored "comprehensive immigration reform" (CIR), a label that commonly refers to omnibus legislation that includes increased border security and immigration enforcement, expanded employment eligibility verification, revision of nonimmigrant visas and legal permanent immigration, and legalization for some unauthorized aliens residing in the country. Leaders in both chambers have identified immigration as a legislative priority in the 113th Congress. While Members of the House reportedly have considered several different approaches to immigration reform during the spring of 2013, debate in the Senate has focused mainly on a single CIR bill: the Border Security, Economic Opportunity, and Immigration Modernization Act (S. 744). This book summarizes major provisions of S. 744, as reported by the Senate Judiciary Committee. It also discusses H.R. 1417, as reported by the House Homeland Security Committee, a bill that focuses more narrowly on border security strategies and metrics. The analysis focuses on eight major policy areas that encompass the U.S. immigration debate: comprehensive reform "triggers" and funding; border security; interior enforcement; employment eligibility verification and worksite enforcement; legalization of unauthorized aliens; immigrant visas; nonimmigrant visas; and humanitarian provisions. This book provides a detailed discussion of major legislation related to each of these issues.

Book excerpt: During the past two years, the Congress has considered proposals to modify the nation's immigration system. The Border Security, Economic Opportunity, and Immigra-tion Modernization Act (S. 744), passed by the Senate in June 2013, addresses multiple facets of immigration policy, including changes to the existing visa system, improvements in border security and law enforcement, and changes to the status of people who currently live in the country without legal authorization. Other proposals have focused on one component of immigration policy-for example, improving border security or changing cer-tain aspects of the visa system. Whether the proposals involve broad or narrow changes to immigration policy, they could have a variety of consequences for both citi-zens and noncitizens, for the federal government, and for state and local governments. This Congressional Budget Office (CBO) report examines some of those proposals and how such changes would affect the federal budget. When estimating the budgetary consequences of immi-gration reform, CBO considers various factors. Depend-ing on the details of proposed legislation, changes to immigration policy could have a significant effect on the size and composition of the noncitizen population and, as a result, on rates of participation in federal programs and the payment of taxes. For that reason, when estimating the budgetary effects of proposals, CBO considers the demographic and labor force characteristics of foreign-born people, their eligibility for and participation in fed-eral programs, their tax liability, changes in the economy, and a number of other factors. If proposals were com-bined into a single, more comprehensive immigration bill, estimates of the budgetary effects would take into account the complex interactions among the various pro-visions; the net effect would not be a simple summation of the individual effects.

Book excerpt: Along with the civil rights and voting rights acts, the Immigration and Nationality Act of 1965 is one of the most important bills of the civil rights era. The Act's political, legal, and demographic impact continues to be felt, yet its legacy is controversial. The 1965 Act was groundbreaking in eliminating the white America immigration policy in place since 1790, ending Asian exclusion, and limiting discrimination against Eastern European Catholics and Jews. At the same time, the Act discriminated against gay men and lesbians, tied refugee status to Cold War political interests, and shattered traditional patterns of Mexican migration, setting the stage for current immigration politics. Drawing from studies in law, political science, anthropology, and economics, this book will be an essential tool for any scholar or student interested in immigration law.

Available in PDF, EPUB and Kindle. Book excerpt: Who controls American immigration policy? The biggest immigration controversies of the last decade have all involved policies produced by the President policies such as President Obama's decision to protect Dreamers from deportation and President Trump's proclamation banning immigrants from several majority-Muslim nations. While critics of these policies have been separated by a vast ideological chasm, their broadsides have embodied the same widely shared belief: that Congress, not the President, ought to dictate who may come to the United States and who will be forced to leave. This belief is a myth. In The President and Immigration Law, Adam B. Cox and Cristina M. Rodríguez chronicle the untold story of how, over the course of two centuries, the President became our immigration policymaker-in-chief. Diving deep into the history of American immigration policy from founding-era disputes over deporting sympathizers with France to contemporary debates about asylum-seekers at the Southern border they show how migration crises, real or imagined, have empowered presidents. Far more importantly, they also uncover how the Executive's ordinary power to decide when to enforce the law, and against whom, has become an extraordinarily powerful vehicle for making immigration policy. This pathbreaking account helps us understand how the United States ?has come to run an enormous shadow immigration system-one in which nearly half of all noncitizens in the country are living in violation of the law. It also provides a blueprint for reform, one that accepts rather than laments the role the President plays in shaping the national community, while also outlining strategies to curb the abuse of law enforcement authority in immigration and beyond.
