Available in PDF, EPUB and Kindle. Book excerpt: Trends in the Judiciary: Interviews with Judges from Across the Globe, Volume Four, provides insights into the lives, working environments, and social milieus of a select group of judges. These legal luminaries, often viewed as pedantic in their ontology, serve the crucial role of preserving the human rights of individuals. This text offers detailed data emanating from the narratives of judges who were interviewed by a wide range of academicians, from emerging and mid-career scholars to professionals and established professors. The narratives of the judges are interspersed with research data and country details in an effort to enhance the knowledge base of the readership. Judges from Asia, Africa, the Caribbean, Europe, the Pacific Islands, New Zealand, North America, and South America all contributed to this text by sharing information on their careers as well as insights as they traversed their profession. The readership of this manuscript will experience the thought processes of judges in relation to the social, cultural, economic, and political context of their respective nations and the gender issues, subtle attempts at juridical control, dealing with powerful criminals, and the lives of judges who have other interests besides "interpreting and applying the law." The international, cross-cultural perspectives presented in this book should be of significant interest to academics, practitioners, students, criminologists, and the criminal justice community, and those interested in comparative legal studies across the globe.

Book excerpt: This book examines contemporary militant democracies in post-communist states in the European Union. Examining, through case studies, their broader relevance to political, legal, and social structures, this book looks in revealing detail at the struggles between these democratic and anti-democratic actors that share similar historical experiences of contentious politics, communism, and political transformation. It importantly unravels the tension between them, determining which are already authoritarian, and which are teetering on the brink of an anti-democratic breakthrough. Analysing regimes’ continuance trajectories to capture how and what shaped the neo-militant aspects of democracies (neomilitancy) over time, the book accounts for why particular post-communist European neo-militant democracies emerge while others decline or transform into quasi-militant democracies despite transformation, how they differ from each other, what brings about the differences and similarities between them, and how and why they change over time. With right-wing populist parties coming to power on the back of fears associated with economic, social, and cultural globalisation and the misuse of state authorities to strengthen protective measures against threats to democratic institutions, the book represents a timely and important contribution. This book will be of key interest to scholars and students of Post-Soviet/Communist/East European Studies, Democratic Backsliding, European and Comparative Politics, Nationalism and Ethnic Conflict, Democracy and Dictatorship, Public Comparative Constitutional Law, Human Rights Law and Political Theory.

Book excerpt: This volume examines the war in Ukraine from a range of historical, military and feminist perspectives, exploring aspects such as the attitude of neighboring states, political leadership, local government, social mechanisms and the cultural and media policies of both Russia and Ukraine. The contributors explain how Ukraine shaped its identity following its separation from the USSR and how Russia built its military power and implemented its invasion plans. Considering the impact of the war not only in Ukraine, but also the Baltic states, chapters discuss the leadership role of President Zelensky, patriotic attitudes, the victimization of women and the impact on Poland as it helps and aid to huge numbers of refugees. Providing much needed context on the Russia-Ukraine war, this book will be of interest to students and scholars of international relations, political science, gender studies, international and national security and public politics.

Available in PDF, EPUB and Kindle. Book excerpt: This book examines legal limitations on government deficit and debt and its impact on the ability of nations to provide services to their residents. It studies constitutional and statutory limitations, as well as those imposed by international treaties and other instruments, including those of both the European Union and the International Monetary Fund. The book contains a general report examining the fiscal rules that govern the budgets and expenditures of nation states. The general report is followed by a special report which covers the limits imposed by the European Union and by the smaller group of countries constituting the Eurozone. Ten national reports, describing the limits in their respective countries, form the basis of the general report. These countries include eight members of the European Union (five of which use the Euro and three of which do not), one other European state and one non-European state. The reports include two countries in which constitutional “debt brakes” limit national deficit and debt.

Available in PDF, EPUB and Kindle. Book excerpt: This book brings together academics and practitioners from a range of disciplines from more than twenty countries to reflect on the growing importance of transparency, power and control in our international community and how these concerns and ideas have been examined, used and interpreted in a range of national and international contexts. Contributors explore these issues from a range of overlapping concerns and perspectives, such as semiotic, sociolinguistic, psychological, philosophical, and visual in diverse socio-political, administrative, institutional, as well as legal contexts. The collection examines the ways in which 'actors' in our society - legislators, politicians, activists, and artists - have provoked public discourses to confront these issues.

Book excerpt: This two-volume book, published open access, brings together leading scholars of constitutional law from twenty-nine European countries to revisit the role of national constitutions at a time when decision-making has increasingly shifted to the European and transnational level. It offers important insights into three areas. First, it explores how constitutions reflect the transfer of powers from domestic to European and global institutions. Secondly, it revisits substantive constitutional values, such as the protection of constitutional rights, the rule of law, democratic participation and constitutional review, along with constitutional court judgments that tackle the protection of these rights and values in the transnational context, e.g. with regard to the Data Retention Directive, the European Arrest Warrant, the ESM Treaty, and EU and IMF austerity measures. The responsiveness of the ECJ regarding the above rights and values, along with the standard of protection, is also assessed. Thirdly, challenges in the context of global governance in relation to judicial review, democratic control and accountability are examined. On a broader level, the contributors were also invited to reflect on what has increasingly been described as the erosion or ‘twilight’ of constitutionalism, or a shift to a thin version of the rule of law, democracy and judicial review in the context of Europeanisation and globalisation processes. The national reports are complemented by a separately published comparative study, which identifies a number of broader trends and challenges that are shared across several Member States and warrant wider discussion. The research for this publication and the comparative study were carried out within the framework of the ERC-funded project ‘The Role and Future of National Constitutions in European and Global Governance’. The book is aimed at scholars, researchers, judges and legal advisors working on the interface between national constitutional law and EU and transnational law. The extradition cases are also of interest to scholars and practitioners in the field of criminal law. Anneli Albi is Professor of European Law at the University of Kent, United Kingdom. Samo Bardutzky is Assistant Professor of Constitutional Law at the University of Ljubljana, Slovenia.
