Book excerpt: The 1968 Nuclear Non-proliferation Treaty has proven the most complicated and controversial of all arms control treaties, both in principle and in practice. Statements of nuclear-weapon States from the Cold War to the present, led by the United States, show a disproportionate prioritization of the non-proliferation pillar of the Treaty, and an unwarranted underprioritization of the civilian energy development and disarmament pillars of the treaty. This book argues that the way in which nuclear-weapon States have interpreted the Treaty has laid the legal foundation for a number of policies related to trade in civilian nuclear energy technologies and nuclear weapons disarmament. These policies circumscribe the rights of non-nuclear-weapon States under Article IV of the Treaty by imposing conditions on the supply of civilian nuclear technologies. They also provide for the renewal and maintaintenance, and in some cases further development of the nuclear weapons arsenals of nuclear-weapon States. The book provides a legal analysis of this trend in treaty interpretation by nuclear-weapon States and the policies for which it has provided legal justification. It argues, through a close and systematic examination of the Treaty by reference to the rules of treaty interpretation found in the 1969 Vienna Convention on the Law of Treaties, that this disproportionate prioritization of the non-proliferation pillar of the Treaty leads to erroneous legal interpretations in light of the original balance of principles underlying the Treaty, prejudicing the legitimate legal interests of non-nuclear-weapon States.

There would be more fingers on more triggers and, probably, a greater risk that a trigger might be pulled with incalculable consequences. It is easy to see, therefore, that there is a collective interest in avoiding the spread of nuclear weapons to further countries. Nations do not, however, normally undertake or refrain from actions because of such a collective interest; they do so because of their individual interests. This is especially true in the field of national security. A nation perceiving that it has a real interest in developing nuclear weapons is not very likely to refrain from doing so merely because it is told such development would be bad for the world community. If the global interest in avoiding the spread of nuclear weapons to more coun tries is to succeed, conditions that make it in the interest of each individual nation to renounce nuclear weapons need to be created or maintained. Fortunately, conditions have prevailed in which the vast majority of nations have seen an advantage in making legally binding nonproliferation commitments. An important rationale for many of these countries has been that these commitments would facilitate the transfer of desired civil nuclear technology.

Over time, however, states have created a number of other mechanisms for organizing international cooperation to promote nonproliferation. Examples range from regional efforts to various worldwide export-control regimes and nuclear security summit meetings initiated by U.S. president Barack Obama. Many of these additional nonproliferation arrangements are less formal and have fewer members than the global treaties. International Cooperation on WMD Nonproliferation calls attention to the emergence of international cooperation beyond the core global nonproliferation treaties. The contributors examine why these other cooperative nonproliferation mechanisms have emerged, assess their effectiveness, and ask how well the different pieces of the global nonproliferation regime complex fit together. Collectively, the essayists show that states have added new forms of international cooperation to combat WMD proliferation for multiple reasons, including the need to address new problems and the entrepreneurial activities of key state leaders. Looking closely at nine cases in East Asia and the Middle East, Etel Solingen finds two distinct regional patterns. In East Asia, the norm since the late 1960s has been to forswear nuclear weapons, and North Korea, which makes no secret of its nuclear ambitions, is the anomaly. In the Middle East the opposite is the case, with Iran, Iraq, Israel, and Libya suspected of pursuing nuclear-weapons capabilities, with Egypt as the anomaly in recent decades. Identifying the domestic conditions underlying these divergent paths, Solingen argues that there are clear differences between states whose leaders advocate integration in the global economy and those that reject it. Among the former are countries like South Korea, Taiwan, and Japan, whose leaders have had stronger incentives to avoid the political, economic, and other costs of acquiring nuclear weapons. The latter, as in most cases in the Middle East, have had stronger incentives to exploit nuclear weapons as tools in nationalist platforms geared to helping their leaders survive in power. Solingen complements her bold argument with other logics explaining nuclear behavior, including security dilemmas, international norms and institutions, and the role of democracy and authoritarianism. Her account charts the most important frontier in understanding nuclear proliferation: grasping the relationship between internal and external political survival. The analysis presented here finds that the NPT has been surprisingly successful. Indeed, it is arguably the most successful arms control treaty in human history. Unfortunately -- and strangely -- this success has been either ignored or discounted as irrelevant. It will be argued that failure to fully acknowledge and understand the success of the NPT is a potentially dangerous policy error. To understand the treaty's success, the paper looks beyond security and technical factors and instead considers political factors and the way in which the NPT influenced countries' internal decision dynamics. It concludes by looking at the lessons learned and their implications for non-proliferation policy.

Book excerpt: As currently interpreted, it is difficult to see why the Nuclear Nonproliferation Treaty (NPT) warrants much support as a nonproliferation convention. Most foreign ministries, including that of Iran and the United States, insist that Article IV of the NPT recognizes the "inalienable right" of all states to develop "peaceful nuclear energy." This includes money-losing activities, such as nuclear fuel reprocessing, which can bring countries to the very brink of acquiring nuclear weapons. If the NPT is intended to ensure that states share peaceful "benefits" of nuclear energy and to prevent the spread of nuclear bomb making technologies, it is difficult to see how it can accomplish either if the interpretation identified above is correct. Some argue, however, that the NPT clearly proscribes proliferation by requiring international nuclear safeguards against military diversions of fissile material. Unfortunately, these procedures, which are required of all non-nuclear weapons state members of the NPT under Article III, are rickety at best. Each chapter of this book is dedicated to clarifying the NPT's key ambiguities, and the chapters are roughly structured to trace the NPT's text, article by article. The analysis set forth here was mostly written or commissioned by the Nonproliferation Policy Education Center. Much more, of course, could have been included in this book. But rather than seeking to be comprehensive, the aim throughout is to provide a guide for both policymakers and security analysts. This guide should assist in navigating the most important debates over how best to read and implement the NPT and, in the process, spotlighting alternative views of the NPT that are sound and supportable.
