Book Synopsis Beyond Winning by : Robert H. Mnookin
Download or read book Beyond Winning written by Robert H. Mnookin and published by Harvard University Press. This book was released on 2004-04-15 with total page 369 pages. Available in PDF, EPUB and Kindle. Book excerpt: Conflict is inevitable, in both deals and disputes. Yet when clients call in the lawyers to haggle over who gets how much of the pie, traditional hard-bargaining tactics can lead to ruin. Too often, deals blow up, cases don’t settle, relationships fall apart, justice is delayed. Beyond Winning charts a way out of our current crisis of confidence in the legal system. It offers a fresh look at negotiation, aimed at helping lawyers turn disputes into deals, and deals into better deals, through practical, tough-minded problem-solving techniques. In this step-by-step guide to conflict resolution, the authors describe the many obstacles that can derail a legal negotiation, both behind the bargaining table with one’s own client and across the table with the other side. They offer clear, candid advice about ways lawyers can search for beneficial trades, enlarge the scope of interests, improve communication, minimize transaction costs, and leave both sides better off than before. But lawyers cannot do the job alone. People who hire lawyers must help change the game from conflict to collaboration. The entrepreneur structuring a joint venture, the plaintiff embroiled in a civil suit, the CEO negotiating an employment contract, the real estate developer concerned with environmental hazards, the parent considering a custody battle—clients who understand the pressures and incentives a lawyer faces can work more effectively within the legal system to promote their own best interests. Attorneys exhausted by the trench warfare of cases that drag on for years will find here a positive, proven approach to revitalizing their profession.

Book Synopsis An Evolutionary Theory of Economic Change by : Richard R. Nelson
Download or read book An Evolutionary Theory of Economic Change written by Richard R. Nelson and published by Harvard University Press. This book was released on 1985-10-15 with total page 456 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book contains the most sustained and serious attack on mainstream, neoclassical economics in more than forty years. Nelson and Winter focus their critique on the basic question of how firms and industries change overtime. They marshal significant objections to the fundamental neoclassical assumptions of profit maximization and market equilibrium, which they find ineffective in the analysis of technological innovation and the dynamics of competition among firms. To replace these assumptions, they borrow from biology the concept of natural selection to construct a precise and detailed evolutionary theory of business behavior. They grant that films are motivated by profit and engage in search for ways of improving profits, but they do not consider them to be profit maximizing. Likewise, they emphasize the tendency for the more profitable firms to drive the less profitable ones out of business, but they do not focus their analysis on hypothetical states of industry equilibrium. The results of their new paradigm and analytical framework are impressive. Not only have they been able to develop more coherent and powerful models of competitive firm dynamics under conditions of growth and technological change, but their approach is compatible with findings in psychology and other social sciences. Finally, their work has important implications for welfare economics and for government policy toward industry.

Book Synopsis Adoption Beyond Borders by : Rebecca J. Compton
Download or read book Adoption Beyond Borders written by Rebecca J. Compton and published by Oxford University Press. This book was released on 2016-02-01 with total page 249 pages. Available in PDF, EPUB and Kindle. Book excerpt: International adoptions have decreased dramatically in the last decade, despite robust evidence of the tremendous benefits that early placement in adoptive families can confer upon children who are not able to remain with birth families. Adoption Beyond Borders integrates evidence from a range of disciplines in the social and biological sciences-- including psychology, neuroscience, evolutionary biology, sociology, anthropology, and social work -- to provide a ringing endorsement of international adoption as a viable child welfare option. The author interweaves narrative accounts of her own adoption journey, which involved visiting a Kazakhstani orphanage daily for nearly a year, to illustrate the complexities and implications of the research evidence. Topics include: the effects of institutionalization on children's developing brains, cognitive abilities, and socio-emotional functioning; the challenges of navigating issues of identity when adopting across national, cultural, and racial lines; the strong emotional bonds that form even without genetic relatedness; and the methods in which adoptive families can address the special needs of children who experienced early neglect and deprivation, thereby providing a supportive environment in which those children can flourish. Striving to attain a balanced, evidence-based perspective on controversial issues, Adoption Beyond Borders argues that international adoption must be maintained and supported as a vital means of promoting international child welfare.
Book Synopsis Beyond Brushtalk by : Christopher T. Keaveney
Download or read book Beyond Brushtalk written by Christopher T. Keaveney and published by Hong Kong University Press. This book was released on 2008-11-01 with total page 219 pages. Available in PDF, EPUB and Kindle. Book excerpt: Beyond Brushtalk explores interactions between Japanese and Chinese writers during the golden age of such exchange, 1919 to 1937. During this period, there were unprecedented opportunities for exchange between writers, which was made possible by the ease of travel between Japan and China during these years and the educational background of Chinese writers as students in Japan. Although the salubrious interaction that developed during that period was destined not to last, it nevertheless was significant as a courageous essay at cultural interaction. This book will appeal not only to those interested in Sino-Japanese studies, an increasingly important field of study in its own right, but will also appeal to scholars of both Japanese literature and Chinese literature and researchers whose areas of interest correspond to the major writers included in this work such as Lu Xun and Zhou Zuoren on the Chinese side and Tanizaki Jun'ichirō and Hayashi Fumiko on the Japanese side. The relations and resulting literary works involving these major writers are often relatively neglected aspects of their total output and will draw interest from scholars of their work. This book will be accessible to both Sinologists and Japanologists with little background in the corresponding field, and to the generalist possessing an interest in literary exchange.
Book Synopsis Beyond Egyptomania by : Miguel John Versluys
Download or read book Beyond Egyptomania written by Miguel John Versluys and published by Walter de Gruyter GmbH & Co KG. This book was released on 2020-06-08 with total page 362 pages. Available in PDF, EPUB and Kindle. Book excerpt: The material and intellectual presence of Egypt is at the heart of Western culture, religion and art from Antiquity to the present. This volume aims to provide a long term and interdisciplinary perspective on Egypt and its mnemohistory, taking theories on objects and their agency as its main point of departure. The central questions the book addresses are why, from the first millennium BC onwards, things and concepts Egyptian are to be found in such a great variety of places throughout European history and how we can account for their enduring impact over time. By taking a radically object-oriented perspective on this question, this book is also a major contribution to current debates on the agency of artefacts across archaeology, anthropology and art history.
