What human rights obligations do states assume upon joining regional bodies? Regional Protection of Human Rights, Second Edition is the first text of its kind devoted to the European, Inter-American and African systems for the protection of human rights. It illustrates how international human rights law is interpreted and implemented across international organizations and offers examples of political, economic, social problems and legal issues to emphasize the significant impact of international human rights law institutions on the constitutions, law, policies, and societies of different regions. Regional Protection of Human Rights provides readers with access to the basic documents of each legal system and their inter-relationships, enabling readers to apply those documents to ever-changing global situations, and alerting them to the dynamic nature of regional human rights law and institutions. The jurisprudence of the European and Inter-American Courts and decisions of the Inter-American and African Commissions are emphasized, including decisions on the interpretation and application of various human rights, procedural requirements and remedies. Prospects for regional systems in the Middle East and Asia are also discussed. The relevant basic texts are reproduced in a documentary supplement. Together, Regional Protection of Human Rights and its accompanying Documentary Supplement provide comprehensive access to the basic documents of each legal system and their inter-relationships, enabling readers to apply those documents to ever-changing global situations, and alerting them to the dynamic nature of regional human rights law and institutions. In addition to serving as a text for courses on human rights law, the book will be useful for courses in international law, international relations, and political science. It is also be a helpful resource for lawyers and policy-makers concerned with the protection of human rights.

Book excerpt: The African human rights system has undergone some remarkable developments since the adoption of the African Charter on Human and Peoples Rights, the cornerstone of the African human rights system, in June 1981. The year2011 marked the 30th anniversary of the adoption of the African Charter. It also marked 25 years since the African Charter entered into force on 21 October 1986.This book aims to provide reflections on most of the major human rights issues in the past 30 years of the African human rights system in practice and discussion on the future: the African Charter s impact and contribution to the respect, protection and promotion of human rights in Africa; the contemporary challenges faced by the African Human rights system in responding adequately to the demands of rapidly evolving African societies; and how the African human rights system can be strengthened in the future to ensure that the human rights protected in the African Charter, as developed in the jurisprudence of the African Commission since the Commission was inaugurated in 1987, are realised in practice. The chapters in this volume bring together the work of 20 human rights scholars and practitioners, with expertise in human rights in Africa, under the following general themes: rights and duties in the African Charter; rights of the vulnerable under the African system; implementation mechanisms for human rights in Africa; and towards an effective African regional human rights system.

Book excerpt: The political and spiritual affinity felt by black peoples may date back centuries, but it was first formalized in Africa by a series of conferences at the beginning of the twentieth century. In the postwar struggle for independence, Africanness became a potent force. Later, in the early 1960s, the flood of newly independent African states adopted a Pan-African ideal in their common struggle against the remaining colonial and white-dominated territories on the continent. The launch of the Organization of African Unity (OAU) in 1963 was an impressive achievement by any standards, and many commentators cited in this bibliography recognize this, adding that the OAU's survival for thirty years is even more astonishing. Overall, however, assessments of the OAU's activities have not been positive. Lack of unanimity among member-states has weakened the OAU's ability to deal with disputes. While critical of OAU's ineffectiveness, most writers marvel at the organization's resilience over three decades. While Central and Eastern Europe fragment, Africa is still represented by one organization, with annual meetings continuing to be held and attended by foreign ministers, prime ministers, and presidents. Chapters in this original and comprehensive bibliography include "Literature on the OAU," "General Assessments," "The OAU in African Politics," and "The OAU in World Politics." There are also extensive indexes of authors, titles, and subjects regarding the OAU. Organization of African Unity is a critical resource for political scientists, historians, and Africa area specialists seeking to understand a changing continent.

The publication first elaborates on the American-Canadian Boundary Disputes and Cooperation, American-Mexican Boundary Disputes and Cooperation, Andean common market, League of Arab States, and the Association of South-east Asian Nations. Discussions focus on structure and organization, activities, evaluation, membership, functions, and establishment, objectives, and principles. The text then examines the Balkan Pact of 1953/1954, Belgium-Luxembourg Economic Union, Benelux Economic Union, and boundary disputes between China and USSR. The manuscript considers the boundary disputes in Latin America and Africa, Council for Mutual Economic Assistance, European Atomic Energy Community, European Coal and Steel Community, and the European Conference of Postal and Telecommunications Administrations. The publication also takes a look at the Economic Community of West African States, European Atomic Energy Community, and the European Atomic Energy Society. The book is a vital source of information for researchers interested in regional organizations, cooperation, and problems.

Book excerpt: This book examines the development of collective security by regional organisations particularly after the Cold War. It analyses the various constitutional developments that have occurred within regional arrangements such as ECOWAS, African Union, SADC, OAS, and NATO and critically analyses how these developments have propelled regional organisations to depart from the normative framework of regional arrangement contained in Chapter VIII of the UN Charter. Through a comprehensive examination of practice, the book evaluates the impact of regional organisations' newly asserted powers to authorise enforcement action and determine when situations within member states warrant their intervention. It inquires into the legal justifications for these developments both from within the UN Charter and regional treaties and practice and asks whether consensual intervention, that is the use of force by regional organisations on the basis of their members' consent, contravenes or constitutes an exception to the prohibition of the use or threat of force under Article 2(4) of the Charter. The book also analyses the regime of complementarity between the UN and regional organisations.

This book is the first comprehensive analysis of the legal framework within which it is being pursued. It will fill a huge knowledge gap and serve as an invaluable teaching and research tool for policy makers in the public and private sectors, teachers, researchers and students of African trade and beyond. The author argues that African Regional Trade Agreements (RTAs) are best understood as flexible legal regimes particularly given their commitment to variable geometry and multiple memberships. He analyzes the progress made toward trade liberalization in each region, how the RTAs are financed, their trade remedy and judicial regimes, and how well they measure up to Article XXIV of GATT. The book also covers monetary unions as well as intra-African regional integration, and examines free trade agreements with non-African regions including the Economic Partnership Agreements with the European Union.

Since the Reports began in 1922 over 10,000 cases have been reported in full or digest form. This new companion volume is an indispensable guide to the Reports themselves, as well as being an essential compendium to the vast range of international law jurisprudence over the last eighty years. The Table of Treaties covers in a single consolidation all treaties referred to in volumes 1-125 of the International Law Reports by date and treaty title. It also indicates where the treaties may be found, particularly useful in the case of early and bilateral treaties. The Table is accompanied by indexes to the treaties by party and subject.

The founding of the African Union and the drafting of the Responsibility to Protect doctrine, the basis for collective action against genocide, ethnic cleansing and crimes against humanity makes this a critical time to reflect on how best to address regional conflicts. This book responds to new regional conflicts over health, water, land and food security in the world's poorest, most socially fragmented continent. The work assesses African regional security arrangements and provides new policy recommendations for the future.

The African continent is now one of the fastest-growing economic regions in the world and represents a viable destination for foreign direct and portfolio investment. This book, which is the first comprehensive analysis of financial integration and regulation in Africa, fills a huge gap in the literature on financial regulation and would constitute an invaluable source of information to policy makers, investors, researchers and students of financial regulation from an emerging and frontier markets perspective. It considers how financial integration can facilitate African financial markets to achieve their full potential and provides a comparative study with the EU framework for financial integration and regulation. It assesses the implementation of effective and regional domestic infrastructures and how these can be adapted to suit the African context. The book also provides an assessment of government policies towards the integration of financial regulation in keeping with the regional agenda of the African Union (AU) and the African Economic Community (AEC).

Book excerpt: Against the background of a changing world order, colonial powers frequently challenged Pan-Africanism and the reasonable arguments voiced in Pan-African Congresses. In Pan-Africanism: Visions, Initiatives, and Transformations, Mano Delea highlights how Pan-Africanism moved its epicenter, as the circumstances of world politics changed, from the Diaspora to Africa, where it was transformed and institutionalized. Unlike other research done on Pan-Africanism, Delea offers three new additions to this academic research by addressing and analyzing the responses of leading historical newspapers to the Pan-African Congresses from 1900 to 1945, examining the transformation of and division between Pan-Africanism as a social movement and as an institutionalized phenomenon, and discussing the epistemologies and knowledge production within Pan-Africanism throughout its history.

Available in PDF, EPUB and Kindle. Book excerpt: Conflict in the Horn of Africa examines how the Kenya-Somalia border problem has deep roots in pre-colonial and colonial times mirroring the phenomenon of shifting territorial and human frontiers and treaties which Britain, France, Italy, and Ethiopia made before and after World Wars I and II. This book documents the Kenya-Somalia border problem from the nineteenth century, when decisions ignored African concerns, to independence, when Africans acted as the principal players. Vincent Bakpetu Thompson analyses how the crises regarding Kenya and Somalia’s domestic situations impacted their international relations in and beyond the region. This book furthers the discussion by looking at the current problems in the region that are obscured by instability, infiltrations, the repetitive influx of refugees crossing and re-crossing the border, and increasing terrorist attacks.
