Book excerpt: Getúlio Dornelles Vargas established his dictatorship in Brazil in 1937, and from 1938 through 1940 American diplomats and military planners were preoccupied with the possibility that Brazil might ally herself with Nazi Germany. Such an alliance would have made fortress America vulnerable and closed the South Atlantic to Allied shipping. Fortunately for America, Brazil eventually joined the Allies and American engineers turned Northeast Brazil into a vast springboard for supplies for the war fronts. Frank D. McCann has used previously inaccessible Brazilian archival material to discuss the events during the Vargas regime which brought about a close alliance between Brazil and the United States and resulted in Brazil's economic, political, and military dependence on her powerful North American ally. He shows that until 1940 the drive for closer union came largely from Brazil, which wanted to offset the shifting alliances of the Spanish-speaking countries and escape from British economic domination. American interest in Brazil increased during the 1930's as the U.S. turned to Latin America to recoup losses in foreign trade and as Washington began to fear that Nazism and Fascism would spread to South America. By 1940 the nature of Brazil's relationship with the United States made it impossible for Brazil to remain neutral. Frank McCann's analysis of Brazil's decision to join the Allies affords a view of the diplomatic uses of economic and military aid, which became a feature of diplomacy in the postwar years. It also provides insights into the military's influence on foreign policy, and into the functioning of Vargas' Estado Nôvo. Originally published in 1974. Book excerpt: Georges Abi-Saab began his writing and teaching at a time when the process of decolonization, and thereafter the quest for emancipation, began to make its far-reaching impact on the international scene, producing significant changes in the international environment, both quantitatively in increasing the number of nation-States and qualitatively in changing patterns of interests and claims. This was bound to result in new pressures on the international legal system itself and in a questioning of the traditional Eurocentric content of international law. In his work and teaching Professor Abi-Saab viewed the dynamics of international law as a function of two driving forces: the emergence of the third world and the sense of injustice. In his view, the first driving force - the emergence of the third world - raised the problem of exclusion: exclusion from participation in the elaboration of international law and the decision-making process, and exclusion as beneficiaries of the resulting rules of international law. At the same time, this new force introduced diversity into the international scene, reflecting the richness of the international community in its different facets. This process remains relevant today, reflecting the contemporary problem of exclusion of new actors as well as their quest for participation. The second driving force - the sense of injustice - posed a teleological problem for him, that of defining community values in order that they capture the different facets of justice, whether formal or distributive. So long as there is no effective organic structure, international law in his view will continue to remain effectiveness-oriented, reflecting rather than impacting on the structures of power. Nevertheless, it is undeniable that there is an on-going process of development of community values and interests; as Georges Abi-Saab wrote with reference to international crimes: `law, like all social phenomena, is a continuous unfolding, a continuous process of elaboration'. He has also considered that the dynamics of the international legal process itself can be captured from the perspective of international organizations as vehicles for change in the international system. From his early writings, Georges Abi-Saab approached the United Nations Charter as a blueprint - both normative and institutional - for a certain type of international society. International institutions with all their imperfections, continue for him to be the means of realization of the law of cooperation which lies at the heart of his concept of the international system. The themes selected for this volume in honour of Professor Georges Abi-Saab are intended to reflect his unique and pioneering contribution to the field of international law. The contributors are drawn from what he has always considered to be his large `family' of former students: in his forty years of teaching, Georges Abi-Saab has acted as mentor to generations of students from all over the world who have benefited from his vision, insights, originality and creative and stimulating use of language. The contributors also include colleagues and friends who share a similar vision of the international legal system.

Book excerpt: This study begins with a brief survey of economic thought on the relationship between foreign trade and national power, from the Mercantilists on. Chapter II attempts a systematic theoretical approach to the subject. It first makes clear the fundamental basis of the possible use of foreign trade as an instrument of national power policy. Using well-known concepts of economic analysis, it proceeds to show under what conditions and by means of what policies this instrument is likely to attain its highest efficiency. The principles of power policy thus deduced theoretically are then compared with the actual practices followed by German trading methods in recent years. Toward the end of this chapter the reader will be carried into a detailed discussion of certain problems of the theory of international trade, which are touched upon earlier in the chapter. Chapter III is applied to the historical background of our problem. It gives a survey of the literature on "economic aggression" before and during World War I and brings out the importance of the Paris Economic Conference of the Allies in 1916 for the Versailles Treaty and postwar economic policies. In Chapter IV we review in the light of our theoretical and historical analyses certain safeguards or remedies which could be or have been proposed to prevent the use of foreign trade as an instrument of national power policies. Certain questions raised in Part 1 can be answered in quantitative terms. Part 2 consists, therefore, of an exposition of various trends of international trade in recent years disclosed by statistical analysis. In Chapter V we calculate an index number expressing the extent to which the trade of the large trading nations is or has been directed by preference toward the smaller trading countries. Chapter VI gives index numbers for the degree of concentration of their foreign trade on one or a few big markets or sources of supply. Finally, in Chapter VII we measure the extent to which world trade has been based primarily on an exchange of manufactures against raw materials and foodstuffs.
