The idea was born primarily in the Baltic States of Estonia, Latvia and Lithuania. Indeed, international and domestic events and other developments surrounding the Baltic States throughout their history have made a considerable impact on discussions and on the evolution of international law and international politics. Despite a clear Baltic ownership, the aim of the Baltic Yearbook of International Law is to become a forum for debate on topical questions in international law and related fields and thus to contribute to the development of thought, standard-setting and relevant practices in the world. The Baltic Yearbook of International Law is an annual publication containing studies that are relevant to Baltic affairs and beyond. The Yearbook will serve as an important source of information not available elsewhere on practices of Estonia, Latvia and Lithuania in the area of foreign relations. Book reviews will include information on books published in the Baltic States and about Baltic issues.

This volume is devoted to highlighting the reflections aired in Riga when the Law School was implementing the Jean Monnet Project in 2017-2019. These reflections broadly focused on the law of the European Union. The editors of the Baltic Yearbook are certain that the EU-law perspective will be of interest to international lawyers throughout the world, whether as an option or as an idea as to what the international legal order might look like with ever growing globalization and migration of the world's people.

Book excerpt: Whilst the concept of jus cogens has grown increasingly more important in public international law, lawyers remain hugely divided both over what precisely confers a jus cogens status on a norm, and what this conferral implies in terms of legal consequences. In this ground-breaking book, Ulf Linderfalk clearly and succinctly explores the reasons for this divide in order to facilitate more rational and productive future discourse.

Book excerpt: The Baltic Yearbook of International Law is an annual publication containing contributions on topical issues in international law and related fields that are relevant to Baltic affairs and beyond. In addition to articles on different aspects of international law, each Yearbook focuses on a theme with particular importance to the development of international law. The Baltic States have joined the European Union and NATO at a time when great challenges face these organisations and the European structure at large within new world realities. This volume's contributions discuss the reforms within the legal systems of these States undertaken with an aim to prepare for the reception of EC law in their domestic systems. Other contributions address some of the pending questions as to where the EC is headed, especially in the area of the protection of human rights. This volume marks the beginning of a new period in the 'History of International Law in the Baltic States'. Research carried out with the purpose of discovering the direction international law in the Baltic States will take promises to be an exciting and challenging task for the Yearbook and a valuable contribution to the international law discourse.

Book excerpt: Celebrating the 20th anniversary of the Baltic Yearbook of International Law, this volume contains a selection of articles chosen by the editors to showcase the Yearbook’s important contribution to international legal scholarship and practice. It thus offers ground-breaking articles on diverse legal areas, including international humanitarian law, international human rights law, peaceful settlement of disputes, European Union law, and the history of international law. Naturally, issues relevant to the international legal status of the Baltic States and the consequences of their occupation by the Soviet Union are also explored, as well as to transitional justice and the collapse of communism. Finally, articles on new areas, such as bioethics and cyperspace, are also included, showing where the development of science prompts the need for legal regulation. This wide-ranging selection reflects the Yearbook’s aim to offer a unique forum among international legal periodicals - where the past meets the future.

Available in PDF, EPUB and Kindle. Book excerpt: In The Legality of a Jewish State, the author traces the diplomatic history that led to the partition of Palestine in 1948 and the creation of Israel as a state. He argues that the fate of Palestine was not determined on the basis of principle, but by the failure of legality. In focusing on the lawyer-diplomats who pressed for and against a Jewish state at the United Nations, he offers an explanation of the effort in 1947-48 by Arab states at the UN to gain a legal opinion from the International Court of Justice about partition and the declaration of a Jewish state. Their arguments at that time may surprise a twenty-first-century reader, touching on issues that are still at the heart of the contemporary conflict in the Middle East.

Volume 3 contains contributions that were presented at, or inspired by, the conference entitled Reparations to States, Groups and Individuals: Implementation of State Responsibility organised on the occasion of the inauguration of the Yearbook. Undoubtedly, there are many difficult legal and political questions surrounding the implementation of the law of State responsibility and this volume addresses only some of them. The contributions disclose several fundamental questions concerning the implementation of State responsibility. Can or should the general principles of State responsibility such as the obligation of full reparation be modified when applied within a specific framework of a treaty regime? Can or should these principles be modified when a treaty embodies rights that are generally considered to have achieved the character of jus cogens norms? How to enforce the obligation of reparations between States when one of them does not recognise any such obligation? One way or another all articles published in this volume raise the issue of ways and means to ensure the compliance of States with their international obligations and their responsibility in case of violations of these obligations.

Book excerpt: The Baltic Yearbook of International Law is an annual publication containing contributions on topical issues in international law and related fields that are relevant to Baltic affairs and beyond. In addition to articles on different aspects of international law, each Yearbook focuses on a theme with particular importance to the development of international law or interest to the Baltic region. Volume 11 of the Baltic Yearbook of International Law is the first volume devoted exclusively to one of the Baltic national schools of international law. Its theme is the Lithuanian school of international law and its traditions and modern developments. It is not often that contributions to the development and thought in international law from small States and academic communities achieve wider audiences or have larger influence. The Baltic Yearbook continues to serve as a forum for providing insights into international law scholarly debates and practices in the region. Like all the previous volumes, the current volume contains extensive reports on practices of Estonia, Latvia and Lithuania in international law. The Yearbook thereby aims to contribute to the development of thought and relevant practices in the world.
