Book excerpt: The Supreme Court has held that the Thirteenth Amendment prohibits slavery or involuntary servitude and also empowers Congress to end any lingering quot;badges and incidents of slavery.quot; The Court, however, has failed to provide any guidance as to defining the badges and incidents of slavery when Congress has failed to identify a condition or form of discrimination as such. This has led the lower courts to conclude that the judiciary's role under the Thirteenth Amendment is limited to enforcing only the Amendment's prohibition of literal enslavement. This article has two primary objectives. First, it offers an interpretive framework for defining the badges and incidents of slavery that is true to both the Amendment's drafters' original purposes and that can also serve as a vibrant remedy for the legacies of slavery. The Thirteenth Amendment should neither be construed as a dead letter whose purpose was served with the removal of the freedmen's bonds nor as a limitless remedy for all forms of discrimination. Rather, the Amendment must be interpreted in an evolutionary manner, but with specific regard to the experience of the victims of human bondage in the United States (i.e., African-Americans) and the destructive effects that the system of slavery had upon American society, laws, and customs. Second, this Article explains that the judiciary has concurrent power with Congress to define and offer redress for the badges and incidents of slavery. Limiting the Amendment, in the absence of Congressional action, to literal enslavement ignores the Amendment's Framers' expressed original intent that the Amendment itself would eliminate all lingering vestiges of the slave system. Furthermore, such an interpretation violates separation of powers principles by imputing to Congress the ability to legislate under the Amendment's Enforcement Clause against conditions that purportedly do not in any way violate the Amendment itself. Even in the absence of Congressional action, the judiciary should enforce the Thirteenth Amendment's promise to eliminate the badges or incidents of slavery.

The badges were intended to legislate the practice of hiring a slave from one master to another, and slaves were required by law to wear them. Slave badges have become quite collectible and have excited both scholarly and popular interest in recent years. This work documents how the slave-hire system in Charleston came about, how it worked, who was in charge of it, and who enforced the laws regarding slave badges. Numerous badge makers are identified, and photographs of badges, with commentary on what the data stamped on them mean, are included. The authors located income and expense statements for Charleston from 1783 to 1865, and deduced how many slaves were hired out in the city every year from 1800 on. The work also discusses forgeries of slave badges, now quite common. There is a section of 20 color plates.

Book excerpt: A Degraded Caste of Society traces the origins of twenty-first-century cases of interracial violence to the separate and unequal protection principles of the criminal law of enslavement in the southern United States. Andrew T. Fede explains how antebellum appellate court opinions and statutes, when read in a context that includes newspaper articles and trial court and census records, extended this doctrine to the South’s free Black people, consigning them to what South Carolina justice John Belton O’Neall called “a degraded caste of society,” in which they were “in no respect, on a perfect equality with the white man.” This written law either criminalized Black insolence or privileged private white interracial violence, which became a badge of slavery that continued to influence the law in action, contrary to the Constitution’s mandate of equal protection of the criminal law. The U.S. Supreme Court enabled this denial of equal justice, as did Congress, which did not make all private white racially motivated violence a crime until 2009, when it adopted the Matthew Shepard and James Byrd Jr. Hate Crimes Prevention Act. Fede’s analysis supports that law’s constitutionality under the Thirteenth Amendment, while suggesting why—during the Jim Crow era and beyond—equal protection of the criminal law was not always realized, and why the curse of interracial violence has been a lingering badge of slavery.
