The Executive Office for U.S. Trustees (EOUST) asked the RAND Corporation to analyze the similarities and differences in the amounts and types of loans secured by debtors' household goods reported in bankruptcy cases filed before and after BAPCPA. RAND found no changes in debtor or creditor behavior due to the new definition of household goods. Some interview participants noted that it may be too early to tell whether debtors are changing their practices related to this issue.

However, there is little evidence that HMRC is making progress in preventing the sale of highly contrived tax avoidance schemes to a large number of taxpayers.However, the DOTAS has helped HMRC to change tax law and prevent some types of avoidance activity and also helped to change the market of tax avoidance schemes, the larger accountancy firms are now less active in this area.Tax avoidance is not illegal and is therefore inherently difficult to stop. A potential avoider can use a scheme to gain a tax advantage until HMRC can prove that the arrangement is not consistent with tax law. This can take many years and often requires litigation. HMRC has increased its focus on the tax affairs of high net worth and affluent individuals. But there are still 41,000 open avoidance cases and HMRC has yet to demonstrate how this number will be reduced. The large number of users of mass-marketed schemes presents a challenge to HMRC, seeking to tackle such schemes by litigating a few lead cases to demonstrate to other users that the scheme will not succeed in the courts. HMRC has an anti-avoidance strategy, but does not monitor its costs and has not yet identified how it will evaluate its effectiveness. This limits its ability to make informed decisions about where to direct its avoidance activity.

There is a proliferation of contrived schemes which exploit loopholes in legislation and abuse available tax relief schemes. Promoters are deliberately taking advantage of the time lag between the launch of a scheme and the closure of the scheme by HMRC. Promoters and providers sign up as many clients as possible before HMRC changes the law and shuts the scheme. They then move on to a new scheme and repeat the process. The complexity of tax law creates opportunities for avoidance, there is no effective deterrent, and HMRC is ineffective in challenging promoters. All too often Government introduces tax incentives to stimulate economic activity that become an opportunity for tax avoidance. Promoters collect their fees even when the schemes are found not to deliver a tax advantage and few schemes are covered by mis-selling regulations. Those who promote a tax avoidance scheme are required to notify HMRC of the scheme however, HMRC does not know how much avoidance is not disclosed but should. It is alarming that some QCs' opinions are being used by promoters as a "reasonable excuse" for non-disclosure which prevents HMRC from applying a penalty. HMRC could learn from how other countries deter and tackle tax avoidance. HMRC should also name and shame those who promote tax avoidance schemes, to harness public opinion and reduce the appetite of companies to promote or use avoidance schemes.

Book excerpt: The superordinate division of emotions is distributed along a bipolar dimension of affective valence, from approaching rewarding situations to avoiding punitive situations. Avoiding and approaching behaviors determine the disposition to the primary emotions of fear and attachment and the behavioral responses to the environmental stimuli of danger, novelty and reward. Approach or avoidance behaviors are associated with the brain pathways controlling cognitive and attentional function, reward sensitivity and emotional expression, involving prefrontal cortex, amygdala, striatum and cerebellum. Individual differences in approach and avoidance behavior might be modulated by normal variance in the level of functioning of different neurotransmitter systems, such as dopaminergic, serotoninergic, noradrenergic and endocannabinoid systems as well as many peptides such as corticotropin releasing hormone. These substances act at various central target areas to increase intensity of appetitive or defensive motivation. Physiologically, personality temperaments of approach and avoidance are viewed as instigators of propensity. They produce immediate affective, cognitive and behavioral inclinations in response to stimuli and orient individuals across domains and situations in a consistent fashion. Although the action undoubtedly emerges directly from these temperamental proclivities, ultimate behavioral outcomes are often a function of the integration among goal pursuit, self-regulation, and temperament trait. Defective coping strategies to aversive or rewarding stimuli characterize the patho-physiology of anxiety- and stress-related disorders or compulsive and addiction behaviors, respectively.
