Book excerpt: General average is considered to be one of the most uniformly regulated topics of maritime law. This study concludes that this perception is flawed. The invariably applicable York-Antwerp Rules do not provide a full regime, whereas their applicability is generally contractual only. As a result, questions arise as to which law applies to general average obligations, how the applicable national law is to be determined (taking into consideration the impact of the European Rome I and II Regulations), and what is provided in the national regimes. In addition, questions arise as to what the influence is of contractual provisions set out in contracts for the carriage of goods by sea and general average security forms, and how the various sources interact. This study contains an in depth assessment of these questions.

Available in PDF, EPUB and Kindle. Book excerpt: Insurance is a legal, an actuarial and a financial product, and it is one out of many risk management strategies. It follows that its history can only be studied in the broader context of the development of such strategies, applying an interdisciplinary approach. The theme of the present volume is maritime risk management. After an overview over the history of insurance, the contributions to the present volume examine different maritime risk management strategies by adopting a variety of methodological approaches. Some contributions focus on normative provisions, others contrast practice with legal scholarship, or focus on the emergence of insurance companies as opposed to individual insurers. Again, other contributions give insights in marine insurance practice in specific cities or analyse insurance practice through the lens of specific insurance litigation. As to the time frame, the different contributions span from antiquity to the nineteenth century.

Available in PDF, EPUB and Kindle. Book excerpt: Marine insurance has been of great importance to the expansion of long distance trade and economic growth in the early modern period, in particular for seafaring nations such as the Dutch Republic. The Amsterdam market became Europe's leading insurance market and within the Republic other insurance systems also emerged. Little is known about the differing institutional frameworks governing these industries and the interaction between the institutions and the actors in the industry. This study examines the development of marine insurance in the Netherlands in Amsterdam, Rotterdam and the province of Groningen from c. 1600 to 1870 from an institutional point of view. It examines how the behavior of authorities, insurers, underwriters and brokers was affected by the formal and informal constraints of the industry and how in turn their conduct has influenced the institutional framework and induced institutional change. Three insurance systems in the Netherlands, each with its own distinctive characteristics and the interaction between institutions and actors is examined. By examining developments over a period of two and half centuries the path of long - term institutional change becomes discernable.

Book excerpt: This book compiles seven essays concerning changes to merchant shipping over the hundred and fifty years between 1850 and 2000, and spanning a range of countries, with particular focus on Norway, Greece, Japan, and England. The essays are linked by the theme of change: from traditional to modern shipping; in fluctuating cargo demands; from sail to steam; wood to iron; in improvements in communication technologies; in political natures and affiliations; in seafaring skillsets; in the advent of containerisation and advent of globalisation. The overall aim is to construct a solid international context for the merchant shipping industry in the nineteenth and twentieth centuries - primarily to aid a major Norwegian deep-sea merchant marine project. The book contains an introduction that sets out these aims, and seven essays by maritime historians which form part of the international contextual whole, though all can be approached individually.

The analysis is based on time series constructed within the framework of the system of national accounts. To reconstruct national income extensive data concerning income, prices, foreign trade, production, employment, and capital formation were collected and processed. The central theme of the analysis is the nature of economic growth and the process of modernization. By presenting the results in an international perspective the specific characteristics of the Dutch economy can be discerned.

Available in PDF, EPUB and Kindle. Book excerpt: A major feat of research and synthesis, this book presents the first comprehensive history of the Dutch economy in the nineteenth century--an important but poorly understood piece of European economic history. Based on a detailed reconstruction of extensive economic data, the authors account for demise of the Dutch economy's golden age. After showing how institutional factors combined to make the Dutch economy a victim of its own success, the book traces its subsequent emergence as a modern industrial economy. Between 1780 and 1914, the Netherlands went through a double transition. Its economy--which, in the words of Adam Smith, was approaching a "stationary state" in the eighteenth century--entered a process of modern economic growth during the middle decades of the nineteenth. At the same time, the country's sociopolitical structure was undergoing radical transformation as the decentralized polity of the republic gave way to a unitary state. As the authors show, the dramatic transformation of the Dutch political structure was intertwined with equally radical changes in the institutional structure of the economy. The outcome of this dual transition was a rapidly industrializing economy on one side and, on the other, the neocorporatist sociopolitical structure that would characterize the Netherlands in the twentieth century. Analyzing both processes with a focus on institutional change, this book argues that the economic and political development of the Netherlands can be understood only in tandem.
