ILMO is a distinct sub-discipline within public international law and domestic public law, covering all domains of military operations: land, sea, air and (cyber)space. As such, ILMO includes elements of other branches of public international law, such as international humanitarian law, human rights law, the law on the use of force, the law of the sea, the law of State responsibility, arms control law and the law of international organisations. Importantly, as a hybrid field of law, ILMO covers the legal basis for military deployment both nationally and internationally, as well as the subsequent international legal regimes applicable to the forces (once deployed) and the domestic administrative and constitutional issues related to the relevant forces. Control is a central notion of ILMO and is the leading theme of this book. The contributions in this book reflect the variety of legal frameworks applicable to military operations and offer an insightful view into the various legal and factual roles of control. The legal notion of control is considered, inter alia, in relation to restraints in the decision to deploy military forces and the legal basis for doing so. Additionally, control is considered over the armed forces themselves, over detainees migrants at sea and over the type or scale of force used in military operations, through targeting rules or rules of engagement. The work endeavors to map out the main gaps and some possible approaches to address them. Part I sets the ground. First, it provides a concept of AWS. Next, it discusses the accountability gap AWS generate and shows how the international community has put far more emphasis on individual responsibility rather than state responsibility. Part II analyzes the challenges AWS pose to the regime governing state responsibility under international law, as codified in the Draft Articles on State Responsibility (ARSIWA). In this regard, it discusses attribution, breach of an international obligation, tempus comissi delicti, multiple states involved in a breach, force majeure, assurance of non-repetition, issues related to damage, the human-machine interaction and its impacts on state ́s responsibility, responsibility for not using AWS, weapons review and the duty of due diligence. Part III summarizes the challenges discussed in part II in thirteen issues of concern and presents possible paths de lege ferenda to address each of those issues, mainly a paradigm shift in attribution and strict liability, among seven other more specific proposals. The conclusion reached is that the current regime on the international responsibility of states is insufficient to deal with the new challenges AWS pose. De lege ferenda, the book argues for following the paths suggested in part III. It also reflects on parts II and III's findings and how many of AWS's challenges to state ́s responsibility apply to other autonomous devices. Therefore, through the case study of AWS, this work also opens the broader discussion of the gaps in the international responsibility of states regarding autonomous device misdoings.

Fighting Machines explores the relationship between lethal autonomous weapons (LAWS), the concept of human dignity, and international law. Much of this analysis speaks to three fundamental and related problems: When a LAWS takes a human life, is that killing a violation of human dignity? Can states and non-state actors use LAWS in accordance with international law? And are there certain responsibilities of human decision-making during wartime that we should not delegate to machines? In the book, Dan Saxon argues that the use of LAWS to take human life constitutes a violation of human dignity. Rather than concentrating on the victims of the use of lethal force, Saxon instead focuses on the technology and relevant legal principles and rules to advance several propositions. First, as LAWS operate at increasingly greater speeds, their use will undermine the opportunities for, and the value of, human reasoning and judgment. Second, by transferring responsibility for reasoning and judgment about the use of lethal force to computer software, the use of LAWS violates the dignity of the soldiers, commanders, and law enforcement officers who historically have made such decisions, and, therefore, breaches international law. Third, weapon designs that facilitate teamwork between humans and autonomous systems are necessary to ensure that humans and LAWS can operate interdependently so that individuals can fulfil their obligations under international law—including the preservation of their own dignity—and ensure that human reasoning and judgment are available for cognitive functions better suited to humans than machines.
