Book excerpt: When a juvenile offender is required by a diversion agreement or probation order to register under the Kansas Offender Registration Act, the registration information is open to the public. Further, a juvenile who is found guilty in an extended jurisdiction juvenile prosecution has a conviction that must be recorded in the criminal justice information system central repository because a conviction is a reportable event pursuant to K.S.A. 22-4705(a)(5). The Kansas Offender Registration Act requires persons who are "offenders" as defined by the Act to comply with its provisions. "Offender" is defined to include any person who is convicted of the offenses listed in the Act. A juvenile who is found guilty in an extended jurisdiction juvenile prosecution proceeding has a conviction for the offense charged and if, as a result of the conviction, the juvenile falls within the parameters of the Kansas Offender Registration Act, the juvenile must comply with its provisions. A juvenile who is required to comply with the Kansas Offender Registration Act must provide information that includes offenses committed and, if the juvenile was convicted of the offense(s), the juvenile must include the dates of any convictions. Book excerpt: 18 U.S.C. section 1161 and section 26(C) of the Indian Gaming Compact between the State of Kansas and the Sac and Fox Nation of Missouri in Kansas and Nebraska each provide for regulation of tribal liquor sales in accordance with state law. The United States Supreme Court in Rice v. Rehner held that 18 U.S.C. section 1161 confers concurrent jurisdiction on the states and the tribes over liquor transactions in Indian country. This grant of authority has been held to include regulatory as well as substantive law. Thus, the Sac and Fox Nation will be required to obtain a state license before beginning liquor sales at the tribal casino. Because the casino is located in Brown County which has not opted to allow drinking establishments within the county in accordance with Article 15, Section 10 of the Kansas Constitution and K.S.A. 1996 Supp. 41-2646, the Tribe may not operate a drinking establishment at the casino. Book excerpt: A speeding infraction diversion agreement which requires the offender to pay diversion fees in excess of actual diversion supervision costs and/or to make a donation to charity does not constitute compounding a crime under K.S.A. 21-3807, provided the agreement meets other statutory requirements for diversion under K.S.A. 22-2906 et seq. Although a county attorney has prosecutorial discretion to dismiss a traffic citation without a diversion agreement, in order to carry out the legislative objective to create uniform diversion policies, a county attorney should follow the statutory diversion requirements for traffic offense diversions. The notification provision of K.S.A. 22-2907(3), when read in light of the purpose of the entire diversion act, does not prevent a county attorney from offering diversion to traffic offenders even though it may be impossible to inform each offender of the diversion policies and guidelines. Consideration of the information provided by a defendant along with any available records of the Kansas Bureau of Investigation or Department of Revenue constitutes compliance with K.S.A. 22-2908(a)(3).
