As long as there is compliance with such requirements, provisions in the corporation's bylaws requiring execution of such instruments by officers of the corporation in addition to those specified in said statute are permissible. However, failure to comply with these bylaw requirements does not, as a general rule, affect the validity of a conveyance made in compliance with the statutory requirements. Book excerpt: The election, appointment, and removal of officers of a third class city having a mayor/council form of government is subject to K.S.A. 15-201 e̲t̲ s̲e̲q̲. unless the city charters out of these statutes under home rule powers. Under K.S.A. 15-209, an individual elected to the office of mayor of such a city must be a qualified elector of that city at the time of the election. The election of an individual who is not a qualified elector of the city is void, but the individual would have served as an officer d̲e̲ f̲a̲c̲t̲o̲. The last individual who was elected and qualified to the office of mayor would continue to serve as mayor until a successor is elected and qualified. If the former mayor is unable to continue serving as mayor, a vacancy in that office occurs, and the president of the city council then fills the office of mayor until the next regular election for the office of mayor. Book excerpt: The campus of a community college, at least for its students, possesses many of the characteristics of a public forum. For the board of trustees of a community college to prohibit or restrict speech based on the content of that speech, the board must show that its regulation is necessary to serve a compelling state interest and that it is narrowly drawn to achieve that end. The board may enforce regulations of the time, place and manner of expression if such regulations are content-neutral, are narrowly tailored to serve a significant governmental interest and leave open ample alternatives of communication. The presence of political campaign posters and signs in or on buildings located on the campus of a community college does not jeopardize the tax-exempt status of the community college. Book excerpt: A board of county commissioners is without authority to forgive interest and penalties lawfully owed as a result of unpaid taxes. Moreover, county officials and school district officials cannot decline receipt of tax moneys which should be received by operation of law. Tax moneys must be collected and distributed in the manner and to the entities prescribed by law. Once such collection and distribution has occurred and a county or school district receives tax moneys, such moneys may only be spent according to the procedures applicable to all expenditures by those entities. Unless statutorily exempted for a specified number of years, property need not be exempted on a yearly basis. Rather, K.S.A. 79-214 requires a property owner to notify taxing officials if the exempt use ceases.
