Book excerpt: As 1989 Senate Bill No. 126 does not apply uniformly to all cities, it is subject to a charter ordinance adopted under article 12, section 5 of the Kansas Constitution. However, a city may not, under article 12, section 5, modify rules adopted by the Kansas Supreme Court under 1989 Senate Bill No. 126, or rules adopted pursuant to article 3, section 1 of the Kansas Constitution. The assessment prescribed by section 3 of 1989 Senate Bill No. 126 applies to all cases disposed of on or after July 1, 1989, including cases filed before July 1, 1989. The judge or clerk of the municipal court must remit all assessments r̲e̲c̲e̲i̲v̲e̲d̲ pursuant to section 3 to the state treasurer for deposit in the state treasury to the credit of the municipal judge training fund. Book excerpt: If an officer or employee of a state district court is named as a defendant in a suit seeking damages for alleged nonfeasance, misfeasance or malfeasance of the duties of his or her office or employment, the Attorney General, upon timely notice by the defendant and request therefor, is authorized to provide for the defense of such officers and employees. Any such defendant remains personally liable for any judgment entered in such action, and for payment of any obligation agreed upon in settlement of the claim. Judicial immunity may be available to the defendant in such a case if the claim arises out of the performance of duty entailing the exercise of quasi-judicial discretion. However, neither absolute nor limited immunity may be available, depending upon the nature of the claim, if it relates to the mandatory, nondiscretionary duties of the office or employment.

If the property is identified as being stolen, it is the duty of the court and the state to see that the property is restored to its rightful owner at the earliest opportunity. However, the due process rights of the pawnbroker must be respected, W̲o̲l̲f̲e̲n̲b̲a̲r̲g̲e̲r̲ ̲v̲.̲ ̲W̲i̲l̲l̲i̲a̲m̲s̲, 774 F.2d 358 (10th Cir. 1985), and the Court should provide the pawnbroker with notice and opportunity to be heard before releasing property to the apparent owner. Book excerpt: "Forthwith" as used in K.S.A. 38-1672(a) is not susceptible to a fixed term definition and is dependent upon the circumstances. There is no time period within which SRS must act between the time a juvenile offender is placed in the custody of a state youth center and the time a juvenile is actually admitted to the youth center. If the court commits a juvenile offender to a state youth center the county is responsible for the expenses for the care and custody of the juvenile until the juvenile is delivered to the youth center. Placing a juvenile offender in the custody of both the secretary of SRS and a youth residential facility is not an "appropriate" combination of dispositions under K.S.A. 38-1663(a)(5). The juvenile offender code does not address the length of time between the point at which a juvenile offender is placed in the custody of SRS and the time SRS decides where the juvenile will be placed. A juvenile, under house arrest, who cuts his or her electronic monitoring equipment and absconds may be charged with escape from custody.
