Book excerpt: Where the commission-manager form of city government has been adopted by a city of the second class having a population of 8,000 or less: (1) a mayor is not elected, but the chairman of the city commission assumes the title of mayor; (2) a primary election is conducted, if required by the provisions of K.S.A. 25-2108a (as amended by L. 1982, ch. 157, section 5), according to the procedures prescribed by K.S.A. 25-2101 e̲t̲ s̲e̲q̲.; (3) the term of office of commissioners first elected is two years, and thereafter commissioners are elected for four-year terms; (4) the commissioner assuming the title of mayor serves as the official head of the city on formal occasions, performs the legislative duties of a commissioner, and signs all ordinances of the city; (5) city commissioners do not have titles, except as the board organizes itself for business; and (6) the nomination and election of commissioners is governed by the election laws applicable to city primary and general elections. Book excerpt: Community colleges are required to use the generally accepted accounting principles embodied in the chart of accounts specifically prescribed for community colleges under authority of K.S.A. 71-211, and may not exercise the authority granted by subsection (d) of K.S.A. 1980 Supp. 75-1120a (as amended by L. 1981, ch. 327, section 1) to obtain a waiver of the use of such principles required by subsection (a) thereof. A municipality may request and obtain a waiver of such requirements as they pertain to the preparation of financial statements and reports resulting from any audit of such municipality which is or will be conducted after July 1, 1981, the effective date of the 1981 amendment to K.S.A. 1980 Supp. 75-1120a. Although the 1981 amendment to K.S.A. 1980 Supp. 75-1120a authorized a municipality to obtain a waiver of the requirements of subsection (a) thereof as to the use of generally accepted accounting principles, subsection (c) of that statute, regarding fixed asset records, operates as a limitation on such waiver authority. Accordingly, a municipality may not obtain a waiver of the use of generally accepted accounting principles, as they pertain to the preparation and maintenance of fixed asset records, after or so as to extend beyond January 1, 1982. In assigning the work to be performed, a judge or court services division would be exercising judicial and discretionary functions, respectively, and would be exempt from liability under the Tort Claims Act, K.S.A. 1981 Supp. 75-6101 e̲t̲ s̲e̲q̲. However, as noted by Attorney General Opinion Nos. 81-98 and 82-157, the recipient organization (including local governments and non-profit corporations) may be liable for injuries and damages inflicted or suffered by persons acting within the scope of their designated community service duties. Such forms, therefore, constitute the records which are required to be maintained, and all information required by these forms is included in such records. Unless such records contain information which is made confidential by law or by directive authorized by law, all information contained in such records is available for public inspection under the Public Records Act (K.S.A. 45-201 e̲t̲ s̲e̲q̲.). If these records contain such confidential information, the law enforcement agency having custody of the records has a duty to make available for public inspection all disclosable portions of the records in a way which protects the confidentiality of the nondisclosable information. Prior to the 1982 amendment, the subsection authorized a court to punish first time violators by imposing a specified jail sentence or a specified fine, "or by both such fine and imprisonment." In the amended statute, the word "and" replaces the word "or" between the term of imprisonment and the amount of the fine, although the phrase "or by both such fine and imprisonment" is retained. In that the intent of the legislature in altering the disjunctive "or" to the conjunctive "and" was to require both forms of punishment, the additional phrase allowing such is now mere verbiage, and adds nothing to the statute. Accordingly, the above-referenced amendments are applicable only to offenses committed after the effective date of the act. Such cards, issued by banks, allow the violator to deposit a draft with the arresting officer, which draft is returned upon the violator's appearance for further proceedings before the court, or, alternatively, is forfeited upon nonappearance. The withholding of a predetermined amount by the issuer of the card from the amount posted as bond is not a violation of the Truth-in-Lending Act, 15 U.S.C. sections 1601 e̲t̲ s̲e̲q̲., in that there is no credit transaction which is subject thereto. Neither is there a violation of anti-trust laws by virtue of two or more banks entering into agreements to purchase such drafts at such a discount, provided such agreements are drafted by a state agency and then presented to such banks for their signature.
