Book excerpt: Although a "pre-school," commonly understood to be a place where preschool-age children are involved in educational activities appropriate for their age, is neither defined by nor specifically made subject to the jurisdiction of the Secretary of Health and Environment by pertinent statutes and regulations, a pre-school is subject to regulation by the Secretary. Depending on the number and the age of children cared for, a pre-school may be regulated as either a "boarding home for children" or a "family day care home," which terms are defined by K.S.A. 65-503(a) and 65-517(a), respectively. Moreover, if a pre-school is a boarding home for children, the Secretary has the authority to regulate the pre-school as a "day care center," as that term is defined in K.A.R. 1980 Supp. 28-4-200(a). The current provisions of paragraphs 2 and 3 of K.A.R. 1982 Supp. 28-39-76(11) and the provisions of K.A.R. 1982 Supp. 28-39-94(b) are inconsistent with the provisions of K.S.A. 1982 Supp. 75-5348. Thus, notwithstanding the provisions of these administrative rules and regulations, persons who are social services designees under these rules and regulations, but who are not licensed under the Licensure of Social Workers Act, K.S.A. 75-5346 e̲t̲ s̲e̲q̲., and who engage in social work practice, or who participate in the delivery of social work services while not under the supervision of a licensed social worker, are engaged in activity violating K.S.A. 1982 Supp. 75-5348(a). Book excerpt: A personal property tax is imposed by K.S.A. 79-307b upon cattle which are held in feedlots. The statute permits the operator of the feedlot to collect the tax, which is calculated on a daily basis for each head of livestock present in the lot, and remit the same to the county along with the monthly report which is required by the same statute. Such taxes may not be released, discharged, remitted or commuted by the board of county commissioners or any other county officer. Accordingly, a resolution by a county commission which rebates part or all of the tax to the owner of the cattle either directly or indirectly through a collection fee to the feedlot operator is invalid. However, a collection fee which is not based on the amount of tax collected and which is reasonable in size is permissible. Cited herein: K.S.A. 79-307b; 79-1703.

Book excerpt: As amended by L. 1982, ch. 144, section 5, K.S.A. 1981 Supp. 8-1567 provides that a person convicted of a violation of the offense of operating a motor vehicle while under the influence of alcohol may be required to perform public or community service work as an alternative to incarceration or payment of a fine. In assigning the work to be performed, a judge or court services division would be exercising judicial and discretionary functions, respectively, and would be exempt from liability under the Tort Claims Act, K.S.A. 1981 Supp. 75-6101 e̲t̲ s̲e̲q̲. However, as noted by Attorney General Opinion Nos. 81-98 and 82-157, the recipient organization (including local governments and non-profit corporations) may be liable for injuries and damages inflicted or suffered by persons acting within the scope of their designated community service duties.
