Where the mortgage instrument states a total obligation, which in cludes not only the amount loaned but also a finance charge for interest, taxes, insurance, official fees, etc. all of which are payable in a specific number of consecutive monthly payments, there appearing no provision for rebate upon prepayment and the finance charge becomes part of the lien, then the tax is due on the whole sum of payments. A distinction must be made for transactions under the Kansas Uniform Consumer Credit Code, where by law the lender must set out in detail in the debt instrument exactly what charges are made and how the defiling, no obligation borrower has positive notice that the debt may be prepaid at any time without penalty, and receive a rebate of all unearned finance charge. In such case, the finance charge must not be taxed, because, at the time of filing, no obligation existed to pay a definite sum for finance charge.

Book excerpt: K.S.A. 1984 Supp 8-1341a provides that speeding convictions for traveling not more than 10 miles per hour in excess of the 55 miles per hour speed limit shall not be part of the public record and shall not be considered by any insurance company in establishing rates for an automobile liability insurance policy or cancelling such coverage. However, the statute does not have the effect of closing any other records concerning arrests, issuance of citations or judicial proceedings. While K.S.A. 1984 Supp. 74-2012(b)(1) and (2) permit the release of information by the division of vehicles or a law enforcement agency to insurers who are processing applications for, or renewing or cancelling, motor vehicle liability insurance policies, such a release involves only information in the public record. As information concerning the convictions specified in K.S.A. 1984 Supp. 8-1341a is not part of the public record, it is not subject to being released under the provisions of K.S.A. 1984 Supp. 74-2012. Book excerpt: Pursuant to K.S.A. 12-4210, an arresting police agency may accept from an accused the bond required under the warrant of another municipality and then forward such bond to the issuing municipality by U.S. mail. If an accused is unable to post bond set forth in the warrant, the arresting police agency may confine the accused to the local city or county jail, until said accused makes bond for his or her appearance or he or she appears before the municipal court, provided however, if the accused within 12 hours of his arrest has not yet posted bond or appeared before the municipal court, said accused shall be released from the jail on his or her own personal recognizance to appear at a later date. In order to satisfy the 12 hour requirement of K.S.A. 12-4213 an accused may be brought before the municipal court in the jurisdiction in which he was arrested, even though the said warrant for his arrest was issued by another municipality.

Book excerpt: The requirement of K.S.A. 79-501, that the appraisal of real property be based upon an actual view and inspection of the property, carries with it the implied authority for the appraiser to enter upon real property to perform these functions, without such action constituting a trespass. Due to such implied authority, the prior permission of the taxpayer to enter upon the real property, for the limited purposes of viewing and inspecting the same, is not required. If, however, the appraiser's entry upon real property is opposed by a taxpayer, the appraiser's paramount duty is to preserve the public peace. In such situations, the appraiser may proceed, through legal channels, to assure fulfillment of the legal duty to appraise the real property by an actual view and inspection thereof.
