This final rule also implements Recommendation 09-03 for South Atlantic swordfish. It also allows fishermen to remove the bill of the swordfish while still meeting the "head-naturally-attached" requirement for measuring swordfish using the lower jaw fork length minimum size, modifies and clarifies regulations regarding swordfish fishery season closures and the North Atlantic swordfish quota reserve category, and adjusts the North and South Atlantic swordfish quotas for the 2012 fishing year to account for 2011 underharvests and landings. This final rule could affect commercial and recreational fishermen who are fishing for swordfish in the Atlantic Ocean, including the Caribbean Sea and Gulf of Mexico. Book excerpt: Recreational fishing in the United States is an important social and economic component of many marine fisheries, with an estimated 14 million anglers making almost 82 million fishing trips in 2004. Although each individual angler typically harvests a small number of fish, collectively these sport fisheries can take a significant fraction of the yearly catch-in some cases more than commercial fisheries. For example, in 1999, recreational fishing accounted for 94% of the total catch of spotted sea trout, 76% of striped bass and sheephead, and 60 percent of king mackerel. It is important that systems used to monitor fishing catch are adequate for timely management of recreational fisheries. However, the large number of anglers and access points makes monitoring recreational fishing much more difficult than monitoring commercial fishing. This report reviews the types of survey methods used to estimate catch in recreational fisheries, including state/federal cooperative programs. The report finds that both telephone survey and onsite access components of the current monitoring systems have serious flaws in design or implementation. There are also several areas of miscommunication and mismatched criteria among designers of surveys, data collectors, and recreational fisheries. The report recommends that a comprehensive, universal sampling frame with national coverage should be established, and that improvements should be made in statistical analysis of the data collected and in the ways the data are communicated. A permanent and independent research group should be established and funded to evaluate the statistical design and adequacy of recreational fishery surveys and to guide necessary modifications or new initiatives.

Based on the comments received on the ANPR, in September 2011, NMFS published a Notice of Intent (NOI) to prepare an FMP Amendment that would consider catch shares for the Atlantic shark fisheries. Based on comments received on the ANPR and NOI, in April 2014, NMFS released a Predraft for Amendment 6 to the 2006 Consolidated Highly Migratory Species (HMS) Fishery Management Plan (FMP) that included management options for changes to regional quota and permit structures. On May, 27 2014, NMFS published another NOI announcing its intent to prepare an Environmental Assessment instead of an Environmental Impact Statement and that the agency was moving away from the catch share concept for this particular Amendment. On January 20, 2015, NMFS released the Draft EA and published a proposed rule (80 FR 2648) for Amendment 6 to the 2006 Consolidated HMS FMP, and the public comment period was open until April 3, 2015. This Final EA analyzes the potential environmental impacts related to (1) permit stacking (2) adjusting the large coastal sharks (LCS) trip limit for shark directed limited access permit holders; (3) establishing a management boundary in the Atlantic region, (4) creating sub-regional quotas in the Atlantic and Gulf of Mexico regions for LCS and small coastal sharks (SCS); (5) modifying the LCS and SCS quota linkages; (6) implementing total allowable catches and adjusting the non-blacknose SCS commercial quotas in the Atlantic and Gulf of Mexico regions based on the 2013 Atlantic sharpnose and bonnethead sharks stock assessments; and (7) modifying upgrading restrictions for shark permit holders.

These measures are meant to provide, to the extent practicable, the furtherance of equitable fishing opportunities for commercial shark fishermen in all regions and areas while also considering the ecological needs of the different species. Except for certain Shark Conservation Act of 2010 (P.L. 111-348) (SCA) provisions, which apply only to smooth dogfish (Mustelus canis), the management measures in Final Amendment 9 address "smoothhound sharks," which for purposes of this Amendment include smooth dogfish (Mustelus canis), Florida smoothhound (M. sinusmexicanus), and Gulf smoothhound (M. norrisi). The Final Amendment also implements the smooth dogfish-specific provisions in the SCA. The SCA requires that all sharks landed in the United States be landed with their fins and tail naturally attached to the carcass but includes a limited exception for smooth dogfish. For the federal Atlantic shark fisheries, current regulations already require all sharks to be landed with all fins naturally attached to the carcass, and the SCA's fins-attached requirement is being implemented nationwide through a separate ongoing rulemaking. Thus, this Final Amendment addresses only the provision contained in the SCA that allows at-sea fin removal of Atlantic smooth dogfish. The action will also establish an effective date for previously-adopted shark management measures finalized in Amendment 3 to the 2006 consolidated HMS FMP and the 2011 HMS Trawl Rule, although those measures were not developed through the Amendment 9 process.

Major accidental oil spills in the Gulf are infrequent; two of the most significant include the Ixtoc I blowout in the Bay of Campeche in 1979 and the Deepwater Horizon Oil Spill in 2010. Unfortunately, baseline assessments of the status of habitats and biota in the Gulf of Mexico before these spills either were not available, or the data had not been systematically compiled in a way that would help scientists assess the potential short-term and long-term effects of such events. This 2-volume series compiles and summarizes thousands of data sets showing the status of habitats and biota in the Gulf of Mexico before the Deepwater Horizon Oil Spill. Volume 2 covers historical data on commercial and recreational fisheries, with an analysis of marketing trends and drivers; ecology, populations and risks to birds, sea turtles and marine mammals in the Gulf; and diseases and mortalities of fish and other animals that inhabit the Gulf of Mexico.

Updated as of May 29, 2018 NMFS is eliminating the expiration date (or "sunset clause") contained in regulations requiring vessel speed restrictions to reduce the likelihood of lethal vessel collisions with North Atlantic right whales. The regulations restrict vessel speeds to no more than 10 knots for vessels 65 ft (19.8 m) or greater in overall length in certain locations and at certain times of the year along the east coast of the U.S. Atlantic seaboard. The purpose of the regulation is to reduce the likelihood of deaths and serious injuries to endangered North Atlantic right whales that result from collisions with ships. The speed regulations will expire December 9, 2013, unless the sunset clause is removed. With this final rule, NMFS is removing the rule's sunset provision. All other aspects of the rule remain in place until circumstances warrant further changes to the rule.
