This opinion upheld the involuntary sterilization law in the State of Virginia, and was written and delivered by Supreme Court Justice Oliver Wendell Holmes. In reality, the Virginia statute was one among many. Since 1907, twenty-nine states passed laws mandating sterilization, racial registration, and restricting miscegenation. Some were still on the books as recently as a decade ago. In this extraordinary book, J. David Smith chronicles the events leading to the enactment of this body of laws, as well as their execution over the years. It is a chilling account of myriad personal tragedies. The issue of eugenics as potential genocide is even today not dead. Proposals for compulsory sterilization through the use of Norplant is evidence of that.
