Les groupes de contrats et de sociétés ne pouvaient que faire croiser ses évolutions avec l'arbitrage, en amenant de multiples questions sur leurs rapports respectifs. Les rapports qu'entretiennent l'arbitrage et le groupe de contrats se développent premièrement sur la question de la clause compromissoire dans les groupes de contrats et de sociétés. Lorsque les juges et les arbitres admettent que la clause compromissoire produit de l'effet obligatoire à l'égard d'un tiers non signataire, deux questions se posent : "que signifie l'extension de la clause compromissoire ? Est-il concevable d'attraire l'ensemble des personnes ou des sociétés dans une même instance arbitrale sur la seule base de l'unité économique ?". Les rapports qu'entretiennent l'arbitrage et le groupe de contrats se développent deuxièmement sur la question de l'instance arbitrale dans les groupes de contrats et de sociétés. En conséquence de l'extension du champ d'application de la clause compromissoire, on peut aborder la question de l'instance arbitrale dans les groupes à travers deux interrogations : "Pourquoi l'arbitrage, alors qu'il existe d'autres modes de solution ?
