Book excerpt: Anti-social behaviour encompasses a broad range of behaviours including nuisance behaviour, intimidation and vandalism. Seventeen per cent of the population perceive high levels of anti-social behaviour in their area, with the young and the less well off being disproportionately affected, at a cost to government agencies of responding to reports of anti-social behaviour in England and Wales of around £3.4 billion per year. This report examines the work of the Home Office's Anti-Social Behaviour Unit set up in 2003 and measures introduced by the Home Office since 1997 to tackle anti-social behaviour, focusing on the impact of three of the most commonly used interventions: warning letters, Acceptable Behaviour Contracts and Anti-Social Behaviour Orders. Using a sample of 893 cases, the report found that the majority of people who received one of these interventions did not re-engage in anti-social behaviour, but there were a number of perpetrators for whom interventions had limited impact, with about 20 per cent of the sample having received 55 per cent of the interventions issued. Recommendations include that the Home Office should undertake formal evaluation of the success of different interventions and the impact of combining these with support services at the local level. International research suggests that preventive programmes, such as education, counselling and training can be a cost effective way of addressing anti-social behaviour.

Book excerpt: This report examines the proposal contained in the consultation paper "Policing in the 21st century: reconnecting police and the people" (Cm 7925, ISBN 9780101792523) for the introduction in England and Wales of elected Police and Crime Commissioners and the creation of Police and Crime Panels in each force area to scrutinise the Commissioners. The Commissioners would replace Police Authorities, and be responsible for holding Chief Constables to account. The first elections are scheduled for May 2012. Members of the Committee held widely differing views about the principle of elected Commissioners, but this inquiry seeks to determine how these proposals can best be delivered. The Committee believes there should be a cooling-off period of four years if a former senior police officer decides to stand as a Police and Crime Commissioner in the same area in which they have served. This restriction is necessary because otherwise they could be in the position of scrutinising decisions they had made while still in office. Commissioners should be responsible for the budget, staff, estate and other assets in their force area. Also recommended is a need for greater clarity on what is meant by operational independence: there is currently no statutory definition of operational independence and it should be defined in a written memorandum of understanding between the Home Secretary, Chief Constables and Police and Crime Commissioners. The Police and Crime Panels should be comprised primarily of elected representatives from Councils in the force area, but also of a significantly smaller number of independent members.

Local authorities should ensure that best practice is always followed when dealing with litter and graffiti, and should liaise with local businesses which are known sources of litter. Every local authority should ensure that data on noise nuisance is regularly compiled and sent to DEFRA or the Chartered Institute of Environmental Health; this will aid policy makers.

But the MPs criticise the Government for failing to bring in wider measures, including Dog Control Notices, to tackle out-of-control dogs. MPs also endorse the proposed amendment to the Dangerous Dogs Act 1991 making attacks on private land the same as attacks on public land. The current law makes it impossible to bring criminal charges against an owner whose dog attacks someone in a private place, such as a home. The Committee welcomed the proposal to enable action to be taken regardless of where a dog attack happens. The Committee agree with the Government that the protection from prosecution should apply only when an attack takes place on a trespasser in the house, not in a surrounding area such as the garden or drive. However, measures taken by the owner to minimise the likelihood of their dog acting aggressively toward someone unexpectedly in such places should be taken into account by enforcement agencies and the courts. MPs fully support the measures to extend offences to those committed against an assistance dog, such as a guide dog, in the same way as if the attack were on a person. This reflects the significant consequences such attacks have on the daily lives of people who rely on assistance dogs. The Committee recommends that such offences should be extended to apply to any attack which injures a protected animal, such as a horse or livestock.

Book excerpt: Wildlife legislation has become so complex that prosecutions fail and even specialist enforcement professionals struggle to implement it effectively. Hundreds of birds of prey have been deliberately poisoned with substances such as carbofuran that have no legal use and the Government could easily make possession an offence. The lack of sentencing guidelines on wildlife offences means that some offenders are being neither punished nor deterred in the courts. The CPS is also failing to train its prosecutors to handle complex wildlife cases. Furthermore, the inflexible implementation in UK law of international agreements covering the trafficking of endangered species squanders limited resources. The Government has maintained funding for specialist wildlife crime investigation and enforcement, but this is provided on an ad hoc basis, reducing operational effectiveness. Funding provided to monitor wildlife crime on the internet was too short-term to attract a suitably qualified individual to fill the post. In 2004, the Committee called for a new database to record all wildlife crime but this has still not been introduced. Internationally, this report also examines how the rhino, tiger and elephant are being driven to extinction by growing demand for illegal wildlife products in south-east Asia and China. The Government needs to exert robust diplomatic pressure in favour of the development and enforcement of wildlife law at the next CITES meeting in March 2013. In particular, the Government should focus attention on the damaging effect of 'one-off' sales of impounded ivory, which has been found to actually fuel demand for ivory products, and seek an unequivocal international ban on all forms of ivory trade.

Since 2007 dogs have killed seven people, including five children, in private homes. The NHS also spends over £3 million annually treating dog attack injuries. Some eight assistance dogs a month, and thousands of livestock annually, are attacked by dogs. The Home Office approach to tackling antisocial behaviour is too simplistic; and fails to reflect the impact that poor breeding and training by irresponsible owners can have on a dog's behaviour. New rules should give enforcement officers more effective powers, including Dog Control Notices, to prevent dog-related antisocial behaviour. Local authorities need to devote more resources to the effective management of stray dogs. MPs call for changes in the legislation to give powers to extend the banned list to include other dogs with particularly aggressive characteristics. At the same time, those tasked to enforce legislation should have the discretion to neuter rather than destroy a banned animal where a particular dog poses no threat. The Advisory Council on Welfare Issues of Dog Breeding should be given a formal regulatory role to enforce standards. Any breeder producing more than two litters per year should be licensed and subject to welfare checks. The Kennel Club should stop registering puppies from breeders not compliant with its own Assured Breeder Scheme. It should also commission an independent annual review of Breed Standards led by vets to eliminate health problems linked to breeding for exaggerated characteristics. Lastly, MPs call on websites advertising pets to develop a voluntary Code of Practice
