The report seeks to characterize and assess efforts by foreign entities -- government and private -- to unlawfully target or acquire critical U.S. technologies, trade secrets, and sensitive financial or proprietary economic information. Although the title implies a heavy emphasis on technologies acquired for economic purposes, in reality it is difficult to determine the motives -- military or commercial -- of those targeting U.S. technologies. Furthermore, sensitive U.S. technologies initially acquired by foreign entities for military use frequently find their way into commercial application and vice versa. This paper makes no attempt to differentiate technologies acquired for civilian use from those acquired for military purposes. Instead, it focuses on all technologies, the loss of which could undermine U.S. military superiority, impede the ability of the United States to compete in the world marketplace, and/or have an adverse effect on the U.S. economy, eventually weakening national security. The report is being submitted in compliance with the Intelligence Authorization Act for Fiscal Year 1995, Section 809 (b), Public Law 103-359, which requires that the President annually submit to Congress updated information on the threat to U.S. industry from foreign economic collection and industrial espionage. This report updates the eighth annual report published in February 2003. Unlike earlier reports that include data for only one year, this one includes information for calendar year 2002 and for January to September 2003. Data in the next annual report will be provided on a fiscal year basis (the tenth annual report will contain data for 1 October 2003 through 30 September 2004).

The National Counterintelligence Executive compiled this assessment using input from a broad cross section of US Government entities. The Department of Defense's Defense Security Service and the Air Force Office of Special Investigations collected significant amounts of data on illegal technology transfer and on economic and industrial espionage. Those data were instrumental in providing much of the detail for this assessment. The Federal Bureau of Investigation the lead investigative agency for enforcing economic espionage statutes also provided significant input. In addition, a host of other organizations made major contributions to and/or have coordinated on this report.

The Authorization Act specifies that the annual report is to examine three aspects of the threat to U.S. industry: the number and identity of the foreign governments believed to be conducting industrial espionage, the industrial sectors and types of information and technology targeted by such espionage, and the methods used to conduct espionage. To prepare this assessment, the Office of the National Counterintelligence Executive (NCIX) requested the assistance of the Intelligence Community, including the Central Intelligence Agency (CIA), the Defense Intelligence Agency (DIA), the Department of State, and the Federal Bureau of Investigation (FBI). As the world's leading industrial power and leader in technology development, the United States continues to be a prime target of foreign economic collection and industrial espionage. The United States pays a high financial price for economic espionage. The business community estimates that, in calendar year 2000, economic espionage cost from $100-250 billion in lost sales. The greatest losses to U.S. companies involve information concerning manufacturing processes and research and development. Increasing competition for limited global resources will intensify economic collection against the United States, including the theft of trade secrets and competitive business information.

Book excerpt: The threat to the United States from foreign economic intelligence collection and industrial espionage has continued unabated since the publication of the "Annual Report to Congress on Foreign Economic Collection and Industrial Espionage, 2007." Economic espionage cases went up slightly and nearly every day brought reports -- in the press and in the classified world -- of new cyber attacks against U.S. Government and business entities. Additionally, the increasing use of new modes of communication and social networking has provided uncharted opportunities for transferring information and espionage for enterprising foreign intelligence services. Foreign collectors continued to target a wide variety of unclassified and classified information and technologies in a range of sectors. According to the counterintelligence (CI) community, which has the most detailed information on foreign collection efforts against dual-use, export-controlled, and military items, the most heavily targeted sectors across all agencies included aeronautics, information systems, lasers and optics, sensors, and marine systems. Cyber threats are increasingly pervasive, and several key adversaries have drastically expanded their computer network operations for intelligence collection and military use. Moreover, the techniques used and the growing computer globalization made it increasingly difficult to detect and prevent intrusions. Tracking, analyzing, and countering foreign collection efforts are increasingly complex challenges as the growth of multinational organizations in the global marketplace compounds and obscures the threat to the United States. Appendix A provides descriptions of Federal agencies and departments that work to protect sensitive information and technologies from unlawful foreign acquisition. Appendix B is a table that presents selected arrests and convictions for economic collection and industrial espionage cases in FY 2008.

Analysis of updated information reported by U.S. counterintelligence agencies indicates that individuals, corporations, or government entities associated with at least 12 countries are assessed to be actively targeting U.S. proprietary economic information and critical technologies. This includes all of the 10 countries previously identified in the 1995 Annual Report. The 12 countries assessed to be actively collecting against U.S. interests have shown particular determination, and in most cases a willingness to use illegal and covert means, to collect U.S. economic and technological information. Inquiries and investigations of suspicious incidents have increased significantly; there are tentative indications of an expansion of nontraditional collection targeting U.S. industry. Foreign collection continues to focus on economic and S & T information and products. U.S. Defense investigators noted a primary focus on information systems technology. Foreign government and commercial collection continues to focus on dual-use technologies. Overt, open-source, and legal collection methods are most evident, but reliance on illegal, covert, and traditional espionage methods has not abated. Analysis suggests venues of collection efforts may be in flux as communications proliferate and marketplace expansion continues. These developments will provide more opportunities to access targeted information and technologies in the United States and globally.
