At the date of the last report the subway was practically completed, only minor details of interior finish being wanting, and during the present year the expenditure upon the structure as originally planned has been less than $20,000, the greater part of this amount being final contract payments. Interference with the Subway Structures by Corporations owning Structures in Streets. It has frequently happened that workmen employed by corporations having underground structures in the streets have not paid due regard to the necessity for preserving intact the outer coating of the subway. While the corporations concerned cheerfully promised to carefully avoid doing any injury, their workmen in many cases neglected to use due diligence, and therefore the following communication was sent to His Honor the Mayor: Boston, Oct.31, 1899. To His Honor the Mayor, Josiah Quincy: Dear Sir: I am instructed by the Commission to again call your attention to the above matter and would refer you to my letter of June 10, and also to a communication from our Chief Engineer under date of October 5. It is not regarded as a duty of this Commission to maintain a supervision over work in the streets in the vicinity of the subway structure. The Subway. As appears from the annexed report of the Chief Engineer, Mr. Howard A. Carson, the work on the subway has progressed during the year in a satisfactory manner. Novel in method and character as the work has been, no serious unexpected difficulties have been encountered. Several of the contractors have failed to complete their portions of the work within the times specified in their contracts, but the delays thus far suffered will not materially postpone the completion of the whole work. The Metropolitan Construction Company, in building that portion of the subway under Tremont street from Boylston street south to the vicinity of Hollis street, deserves honorable mention for having thus far kept fully up to the estimated amount of progress necessary to enable it to finish its work, under the contract, at the required time. Injunction Proceedings. An account of legal proceedings which were instituted for the purpose of enjoining the Commission from carrying on the construction of the subway was given in the first annual report, as far as they had then progressed. When that report was submitted, the bill in equity, asking for an injunction against the Commission, brought by Hon. Thomas N. Hart, Hon. F. O. Prince, and others, had been heard by Mr. Justice Knowlton of the Supreme Judicial Court, upon a motion for a preliminary injunction. This preliminary injunction the Court refused to grant. Extension of Term of the Commission. The term for which the Commission was originally appointed expired July 2, 1899. By act of the Legislature of 1899, chapter 375, the term was extended for three years from the first day of July, 1899. The Commission on August 3 organized for the extended term by the choice of George G. Crocker as Chairman, Howard A. Carson as Chief Engineer, and B. Leighton Beal as Secretary. Completion of the Subway. At the date of the fourth annual report the subway as originally planned was completed with the exception of minor details of interior finish. Sept. 3, 1898, that portion of the subway not already in use, namely, from Park-street station to the northern terminal, was opened to the public. Estimated Cost of the Subway. The estimated cost of the subway as originally planned in 1894 was $5,000,000. Its net cost to the date of this report is $4,141,896.46. The increase of this amount will be small. The total cost probably will not exceed $4,200,000. There has been expended up to August 15, 1899, on account of the alterations required by the Act of 1897 to adapt the subway to the use of the Boston Elevated Railway Company, $190,802.24, of which $103,607.40 was for real estate.
