Book excerpt: A Lei de Crimes Ambientais - LCA (Lei n° 9.605/98) se destaca por ser o principal instrumento de prevenção e penalização dos delitos contra a flora e a fauna no arcabouço jurídico ambiental brasileiro. Contudo, pouco se tem estudado sobre a real efetividade desse instrumento no fortalecimento da defesa contra os crimes ambientais, em especial no estado do Amapá, considerado uma região prioritária e estratégica para a conservação da floresta amazônica. O objetivo da pesquisa foi avaliar um conjunto de variáveis jurídico-econômicas mensuráveis e relacionadas às principais etapas do sistema de aplicação da lei, o qual é composto pela atuação de entes governamentais na esfera administrativa e judicial. A metodologia utilizada para analisar a efetividade desse sistema considerou informações chaves sobre a atuação do Instituto Brasileiro do Meio Ambiente e Recursos Naturais Renováveis - IBAMA-AP, Ministério Público e Poder Judiciário, detalhando-se cada etapa dos procedimentos processuais na busca da punição ao infrator ambiental, tanto na esfera criminal quanto na cível. Para tanto, foi elaborado uma proposta metodológica de análise de efetividade da LCA a partir do uso da modelagem jurídico-econômica, considerando os principais procedimentos adotados em cada uma das etapas utilizada nos trâmites normais das instituições envolvidas na sua aplicação. Na fase de modelagem foram utilizados dados obtidos do sistema on line SICAFI-IBAMA dos Autos de Infração Ambiental do IBAMA-AP aplicados no período de 2002 a 2008. Estes dados foram processados estatisticamente e complementados com informações detalhadas sobre as ações judiciais criminais e cíveis executivas, decorrentes destes autos de infração, os quais tramitaram nos Fóruns do Tribunal de Justiça do Amapá e no Fórum da Ia. Região da Justiça Federal no Amapá. Os resultados demonstraram que durante o período de análise houve um baixo nível de efetividade do sistema, com melhor desempenho dos procedimentos criminais em detrimento dos cíveis. Destaque deve ser dado ao descumprimento de etapas importantes dos trâmites processuais, os quais depauperam significativamente os valores econômicos provenientes de pagamento de multas por crimes ambientais. Como conclusão, observou-se que há falhas graves em etapas chaves ao longo dos procedimentos administrativos e judiciais, as quais elevam os riscos de insucesso de todo o sistema de aplicação da LCA. Como conseqüência, os instrumentos jurídico-econômicos tendem a diminuir sua efetividade na aplicação da LCA no Estado, perdendo seu objetivo que é prevenir e penalizar os crimes contra a flora.
