Book excerpt: Excerpt from An Outline of the French Law of Evidence This Work has been prompted by the difficulty actually experienced by the Author in the conduct of international litigation in moulding evidence procured from England or America into such shape as to make it admissible in a French Court - a difficulty arising chiefly from the natural unfamiliarity of the Anglo-Saxon practitioner with rules of evidence so very dissimilar from those to which he is accustomed. It has been kept within a brief compass, partly because the subject, being of a much less technical nature in France than in England and America, is not one of great extent; partly because the Author has deemed it for the greater convenience of his readers, that he should confine within modest limits what he believes to be a first attempt at a comparative study of English and French methods of presentation of proof. His aim has been to expound his subject in language as clear and as non-technical as possible, so that in case of need the layman as well as the lawyer may possibly derive some profit from its study. Book excerpt: Excerpt from Law of Evidence The philosophy of the present age is founded on a more charitable view of human nature than was indulged in by the prejudices of our ancestors, whose rules of action were often framed in the darker ages of the human race, and by narrow minded and bigoted persons. If, says Mr. Taylor, the rules of exclusion, recognized till lately by the English law, had been really founded, as they purported to be, on public experience, they would have furnished a omost revolting pic ture of the ignorance and depravity of human nature. In rejecting the evidence of parties to the record, and other interested witnesses, the law acted on the presumption, not only that such persons, sooner than make a statement which might prejudice themselves, would commit deliberate perjury, but that, if they did so, juries would be incapable of detect ing the falsehood. A more unfounded calumny upon the veracity of Witnesses and the intelligence of juries cannot well be imagined. Book excerpt: Excerpt from The Principles and Practice of the Law of Evidence N preparing this Edition for the Press we have not departed from the lines on which the previous Editions were based. We have considered all the cases upon the subjects dealt with in this Book which have been reported since the last Edition down to April, 1904, and have incorporated such of them as we deemed of sufficient importance in this Edition, and have also incorporated a few cases reported since that date. We have eliminated certain matters mainly of historical interest, and have other wise compressed the present Edition, so that in spite of the very considerable amount of new matter introduced into this Edition it will be found to be shorter by several pages than the previous Edition. The latter have, for the convenience of the reader, been arranged not only in separate columns according to their admissibility or the reverse, but, wherever. Book excerpt: Excerpt from Rules of Evidence as Prescribed by the Common Law for the Trial of Actions and Proceedings The work will present several useful innovations. The rules of evidence, together with the reasons for the same, are treated rather more fully than in such excellent works as The Theory of Evidence, by Reynolds, and Stephen's Di gest of the Law of Evidence. The latest cases are not to be found in the larger and older works. As one of the older works Greenleaf, Best, Taylor, or Wharton - is generally to be found in the hands of every practitioner, and accessible to every student, a mere repro duction of their works even in new form is unnecessary. The author has therefore made use of the arrangement of Stephen, modified as he thought necessary, enlarged by a fuller state ment of the rules, having made a point of citing only such of the older cases generally cited in the older works as were necessary or advisable, and having taken especial pains to cite the late cases through the union illustrating the applica tion of the rules of evidence. This feature of the work makes it especially desirable to the trial lawyer, and enables him at a very moderate price to supplement these older works by the latest utterances upon the subject, arranged in accordance with the most logical order of which the subject admits. Book excerpt: Excerpt from Leading Cases on the Law of Evidence With Notes It is believed that this table of contents, read together with the headnotes, will give a fairly complete outline of the Law of Evidence. With regard to the facts involved in the cases, in some instances they do not appear in the Reports, the point of Evidence only being stated. In other cases the facts are quite immaterial to the point of Evidence involved, and it has been thought better to omit them, together with such portions of the judgments as refer only to such facts and throw no light upon the point of Evidence.
