Book Synopsis North Korea, International Law and the Dual Crises by : Morse Tan
Download or read book North Korea, International Law and the Dual Crises written by Morse Tan and published by Routledge. This book was released on 2015-04-24 with total page 315 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Democratic People's Republic of Korea (DPRK) has a reputation as one of the worst human rights situations in the world. This book utilizes a unique international law perspective to examine the actions and inactions of North Korea with regard to international security and human rights. Adopting political, military, historical and legal perspectives, the book explores how the two issues of nuclear weapons and the human rights abuses in North Korea are interconnected, and why the international community should apply the same international law framework to find a solution for both. Drawing on eyewitness accounts, such as refugee and defector testimony, Morse Tan offers a real-life story of North Korea that covers the pertinent law, and constructive approaches of its regime. Tan examines the specific objectives and actions of the North Korean government, and measures these according to international legal obligations such as applicable treaty law, jus cogens norms, and customary international law. The book concludes by offering solutions for dealing with international security surrounding the Korean Peninsula, and forwards a proposal for the creation of a tribunal to prosecute those at the top of the regime for international crimes and human rights abuses. As a project exploring the extremes of international law violation, this book will be of great interest and use to readers interested in the history, and political and legal implications of the strategies employed by the North Korea government.

Book Synopsis China, South Korea, and the Socotra Rock Dispute by : Senan Fox

Book excerpt: This book exclusively addresses the political, historical and important contemporary strategic implications of the decades-long Socotra Rock dispute between China and South Korea. It is one of several maritime disputes involving China and a smaller state, and for which maritime law offers no apparent remedy. There is little doubt it will continue to be a problem in the future and should no longer be overlooked. The submerged rock, located between mainland China and the Korean Peninsula, straddles the Yellow Sea and the East China Sea. As China continues asserting its sovereignty and jurisdiction in maritime areas, this book will provide food for thought for scholars, think-tank researchers, and policymakers.
Book Synopsis Island Disputes and Maritime Regime Building in East Asia by : Min Gyo Koo
Download or read book Island Disputes and Maritime Regime Building in East Asia written by Min Gyo Koo and published by Springer Science & Business Media. This book was released on 2009-09-16 with total page 217 pages. Available in PDF, EPUB and Kindle. Book excerpt: islands has emotional content far beyond any material significance because giving way on the island issue to Japan would be considered as once again compromising the sovereignty over the whole Korean peninsula. For Japan, the Dokdo issue may lack the same degree of strategic and economic values and emotional appeal as the other two territorial disputes that Japan has had with Russia and the two Chinas – namely the Northern Territories/Southern Kurile Islands and the Senkaku Islands, respectively. Nevertheless, fishing resources and the maritime boundary issues became highly salient with the introduction of UNCLOS. Also, the legal, political, and economic issues surrounding Dokdo are all intertwined with Japan’s other territorial disputes to the extent that concessions of sovereignty on any of these island disputes could jeopardize claims or negotiations concerning the rest. South Korea and Japan have forged a deeper diplomatic and economic partn- ship over the past decade. A new spirit of partnership after the landmark joint declaration of 1998 culminated in the successful co-hosting of the World Cup 2002. At the end of 2003 the two neighbors began to negotiate an FTA to further strengthen their already close economic ties. South Korea’s decades-long embargo on Japanese cultural products has now been lifted, while a number of South Korean pop stars are currently sweeping across Japan, creating the so-called “Korean Wave” fever. A pragmatic calculation of national interests would thus suggest cooperative behavior.
