Consolidating previous international instruments relating to refugees, the 1951 Convention with its 1967 Protocol marks a cornerstone in the development of international refugee law. At present, there are 149 States Parties to one or both of these instruments, expressing a worldwide consensus on the definition of the term refugee and the fundamental rights to be granted to refugees. These facts demonstrate and underline the extraordinary significance of these instruments as the indispensable legal basis of international refugee law. This Commentary provides for a systematic and comprehensive analysis of the 1951 Convention and the 1967 Protocol on an article-by-article basis, exposing the interrelationship between the different articles and discussing the latest developments in international refugee law. Book excerpt: This study deals with the right of the individual to asylum, which is not as yet assured by any of the instruments appertaining to refugee law. It examines this lacuna in international law in the light of the proceedings of the 1977 United Nations Conference on Territorial Asylum. The author reviews the history of the concept of asylum and proceeds to define it by distinguishing between territorial and diplomatic asylum. An overview of relevant international instruments reveals that the only right to asylum assured is that of a state to grant asylum but not its counter, the right of the individual to be granted asylum. This is due to two reasons. The first is that individuals are considered as subjects of municipal law and states alone as those of international law. The second is that there is a lack of state practice considering asylum as a right of the individual. The author contends that these are the two fundamental reasons behind the failure of the 1977 UN Conference on Territorial Asylum to incorporate this right. He identifies the constitutive elements of asylum as being those of non-refoulement, provisional stay, non-extradition of political offenders and eligibility. Eligibility was the only element upon which any serious decisions were taken at the 1977 UN Conference. The author concludes by analysing the diverse and opposing interests in the asylum debate. He contends that there is some hope for the future, as the UN General Assembly continues to pay attention to the question, and certain regional instruments such as the American Convention on Human Rights adopted at Costa Rica on 22 November 1969 have provided the foundation for future elaboration of the right of the individual to be granted asylum by reiterating this right in their texts.
