Book excerpt: Excerpt from The English Constitution: And Other Political Essays The English Constitution, by Mr. Walter Bagehot, has already attracted some attention in this country, but it is a work that deserves to be much more widely and familiarly known. Its title, however, is so little suggestive of its real character, and is so certain to repel and mislead American readers, that, in bringing out a new and cheaper edition of it, at this time, some prefatory words may be useful for the correction of erroneous impressions. Book excerpt: Excerpt from An Essay on the History of the English Government and Constitution: From the Reign of Henry VII. To the Present Time The history of society, so far as regards government, may be divided into four different stages of civilization. 1st. The state of savage life. - This is the origin of all society, is to be found at the beginning of every history, and is exemplified to this day in North America, and some of the newly discovered parts of the world. Such was the state in which Caesar found the greater part of Britain, the sea-shore only being cultivated, and the interior occupied, or rather wandered over by hunters. Book excerpt: Excerpt from Essays on the Constitution of the United States: Published During Its Discussion by the People, 1787-1788 In 1888 the editor selected from the pamphlet arguments published during the discussion of the Constitution of the United States, prior to its ratification by the States, a collection of fourteen tracts, and printed them in a volume under the title of Pamphlets on the Constitution of the United States. The reception given that collection clearly proved that these writings were only neglected because of their rarity and inaccessibility, and has induced the editor to collect another, though largely similar class of writings, which he believes of equal value and equally unknown. In the great discussion which took place in the years 1787 and 1788 of the adoption or rejection of the Constitution of the United States, one of the important methods of influencing public opinion, resorted to by the partisans and enemies of the proposed frame of government, was the contribution of essays to the press of the period. The newspapers were filled with anonymous articles on this question, usually the product of the great statesmen and writers of that period. Often of marked ability, and valuable as the personal views of the writers, the dispersion and destruction of the papers that contained them have resulted in their almost entire neglect as historical or legal writings, and the difficulty of their proper use has been further increased by their anonymous character, which largely destroyed the authority and weight they would have carried, had their true writers been known. Book excerpt: Excerpt from A Primer of the English Constitution and Government: Or the Use of Colleges, Schools, and Private Students There are certain inherent difficulties in the composition of a work of the character of the present one, which I think it better to allude to at the outset, so that if it turns out that I have failed to overcome them, I may at least not seem so far disrespectful to my subject and to my readers as to have failed to look them fully in the face. In the first place, the Constitution and Government of England have in a peculiar degree sprung from a long line of historical antecedents, - antecedents, too, which are not so much startling and isolated events as vast groups of circumstances slowly and silently manifesting themselves in orderly and unceasing progression. Not to deal in any manner with these historical antecedents must leave certain parts of the subject wholly unintelligible. Book excerpt: Excerpt from The Federal Government of Switzerland: An Essay on the Constitution Tlements, liberty and equality were, in a certain sense, imposed upon the people by the circum stances of colonial life. Yet, however favorable to liberty and equality may have been the con ditions of colonial life in some parts of America, there existed in other parts a superior counter acting force in the despotic traditions of the mother country. This was particularly true with reference to the Spanish colonies which were planted in the New World in the sixteenth century. Of these, Mexico is a conspicuous example. Although now in the list of federal republics, yet it could not claim even nominal independence and liberty till after three centuries of uncompromising despotism. Most English colonial dependencies have worked their way to prominence through a struggling age of feeble ness. And in the effort have prepared themselves to win and defend their liberty. But the Span ish dependencies have been from the outset equipped with ample legal machinery, and been controlled and supported by the sagacity and power of the monarch, and in this state of com plete subordination have lost much of the self assertion and self-control which are requisite to the character of a free people. Book excerpt: Excerpt from The Federal Constitution: An Essay At this time, the one hundredth anniversary of the adoption of the Federal Constitution, it seems peculiarly fitting that we pause a while, to take a retrospective view, of the interesting scenes which were enacted in that eventful drama, and to contemplate the masterful structure then reared by the wise and inspired men of that remarkable epoch. During the past century, under the benign influence and polity embodied in that beautiful organism, a mighty nation has been established to give the world assurance of the stability and grandeur of the representative system. Book excerpt: Excerpt from The English Constitution: A Commentary on Its Nature and Growth In the introductory chapter, the statement is made that one object of the book is to enable American readers to gain a better knowledge of the American government. It may be an advantage to some readers for me to add that Part I. Was prepared specifically in order that Americans might be able to read with greater profit Bryce's The American Common wealth. To fully appreciate that great work, the American needs to be well grounded in English politics. He must know the present Constitution in its theory and in its practice. Part II. Is designed to answer certain questions often raised in an attempt to understand the present English Constitution. Americans should never forget that, until the founding of the colonies, English history is our history. Nor should they fail to remember that for a hundred years after, there was a per sistent effort to establish in England a government according to what would now be called the American model, - that is, a government based upon an artificial constitution whereby the Legislature and the Executive should be balanced one against the other. It was not until the coming in of the House of Hanover, in 1715, that English constitution-making became of a distinctly different character. Book excerpt: Excerpt from Essays on Government Any one who attempts to study a carpet loom, or even an ordinary steam engine, when at rest, will find its mechanism hard to under stand. He may examine the several parts; note their size and shape, and the materials of which they are made; but unless he watches them in motion he will not easily appreciate their hearing upon one another, or their func tions in the working of the machine. The same principle applies to the study of politics, for the real mechanism. Of a government can be understood only by examining it in action. It has, indeed, been far too common to study the constitutions of various countries statically, if I may use the term; and this has led to a. Book excerpt: Excerpt from An Essay on the First Principles of Government This publication owes its rise to the Remarks I wrote on Dr. Brown's proposal for a code of education. Several persons who were pleased to this favourably of that performance, (in which I was led to mention the subject of civil and religious liberty) were desirous that I should treat of it more at large, and without any immediate view to the Doctor's work. It appeared to them, that some of the views I had given of this important, but difficult subject, were new, and showed it, in a clearer light than any in which they had feel it represented before; and they thought I had placed the foundation of some of the most valuable interests of mankind on a broader and firmer basis, than Mr. Locke, and others who had formerly written upon this subject. Book excerpt: Excerpt from The Democracy of the Constitution, and Other Addresses and Essays The first five papers in this volume deal with the Constitution of the United States, with the democ racy which it created and limited, and with the changes in it which are now proposed, affecting the courts and the principles of representative govern ment. I have endeavored to omit, so far as possible, any repetitions, but as all the addresses are concerned with different phases of the same subject there are certain points where the same argument must recur in order to make clear the particular aspect of the question to which the main discussion is devoted.
