Book excerpt: Justice, Indigenous Peoples, and Canada: A History of Courage and Resilience brings together the work of a number of leading researchers to provide a broad overview of criminal justice issues that Indigenous people in Canada have faced historically and continue to face today. Both Indigenous and Canadian scholars situate current issues of justice for Indigenous peoples, broadly defined, within the context of historical realities and ongoing developments. By examining how justice is defined, both from within Indigenous communities and outside of them, this volume examines the force of Constitutional reform and subsequent case law on Indigenous rights historically and in contemporary contexts. It then expands the discussion to include theoretical considerations, particularly settler colonialism, that help explain how ongoing oppressive and assimilationist agendas continue to affect how so-called "justice" is administered. From a critical perspective, the book examines the operation of the criminal justice system, through bail, specialized courts, policing, sentencing, incarceration and release. It explores legal frameworks as well as current issues that have significantly affected Indigenous peoples, such as the Truth and Reconciliation Commission, the Inquiry into Missing and Murdered Indigenous Women and Girls, human rights, resurgence and identity. This unique collection of perspectives exposes the disconcerting agenda of historical and modern-day Canadian federal government policy and the continued denial of Indigenous rights to self-determination. It is essential reading for those interested in the struggles of the Indigenous peoples in Canada as well as anyone studying race, crime and justice.

Book excerpt: The Federal Bureau of Prisons (BOP), the component of the Department of Justice (DOJ) responsible for incarcerating all federal defendants sentenced to prison, was operating at 20% over its rated capacity as of December 2015. To alleviate overcrowding, in 1997 the BOP had begun contracting with privately operated institutions (contract prisons), to confine federal inmates who are primarily low security, criminal alien adult males with 90 months or less remaining to serve on their sentences. This report examined how the BOP monitors these facilities and assessed whether contractor performance meets certain inmate safety and security requirements. It found that, in most key areas, contract prisons incurred more safety and security incidents per capita than comparable BOP institutions and that the BOP needs to improve how it monitors contract prisons. Figures. This is a print on demand report.

Book excerpt: The authors of the chapters included in this volume provide preliminary answers to questions such as: How extensive were COVID-19 outbreaks in prisons, jails, and community corrections systems globally? Which regions and countries reported the largest outbreaks? Why were prisons and jails found to be "hot spots" for the spread of COVID-19 in most countries? How did governments initially respond to COVID-19 outbreaks in their corrections systems? Did the mitigation strategies used in each country reduce the spread of the infection in the corrections system (both in prisons and jails, and in community corrections)? Did the corrections-focused mitigation strategies used in each country have a positive or an adverse impact on public health and public safety? How likely is it that the varied short-term mitigation strategies implemented by governments will result in long-term changes in corrections policies and practices? The book includes three chapters examining the global impact of the COVID-19 outbreaks, six regional overviews, and 27 country-specific reviews, including reviews targeting 21 of the 50 largest prison systems globally. This collection will be an excellent resource for researchers, policymakers, practitioners, and the general public interested in knowing more about the nature and extent of COVID-19 outbreaks in corrections systems globally, and about the diversity of responses developed and implemented by governments from each global region. The chapters in this book were originally published as a special issue of the journal Victims & Offenders.

Available in PDF, EPUB and Kindle. Book excerpt: From Executive summary: This report focuses on the government's efforts to enforce federal civil rights laws prohibiting religious discrimination in the administration and management of federal and state prisons. Prisoners in federal and state institutions retain certain religious exercise rights under the Constitution and statutes including the Religious Land Use and Institutionalized Persons Act (RLUPIPA), the Religious Freedom Restoration Act (RFRA), and the Civil rights of Institutionalized Persons Act (CRIPA). Many states have similar provisions in their state constitutions and in state law modeled on RFRA. These rights must be balanced with the legitimate concerns of prisons officials, including cost, staffing, and most importantly, prison safety and security. Reconciling these rights and concerns can be a significant challenge for penal institutions, as well as courts.
