Book excerpt: U.S. aquaculture -- the raising of fish and shellfish in captivity -- has generally been confined to nearshore coastal waters or in other water bodies, such as ponds, that fall under state regulation. Recently, there has been an increased interest in expanding aquaculture to offshore waters, which would involve raising fish and shellfish in the open ocean, and consequently bringing these types of operations under federal regulation. While the offshore expansion has the potential to increase U.S. aquaculture production, no comprehensive legislative or regulatory framework to manage such an expansion exists. Instead, multiple federal agencies have authority to regulate different aspects of offshore aquaculture under a variety of existing laws that were not designed for this purpose. In this context, GAO was asked to identify key issues that should be addressed in the development of an effective regulatory framework for U.S. offshore aquaculture. In conducting its assessment, GAO administered a questionnaire to a wide variety of key aquaculture stakeholders; analyzed laws, regulations, and key studies; and visited states that regulate nearshore aquaculture industries. Although GAO is not making any recommendations, this review emphasizes the need to carefully consider a wide array of key issues as a regulatory framework for offshore aquaculture is developed. Book excerpt: The growth and worldwide expansion of intensive aquaculture production over the past few decades has significantly increased the presence of aquaculture activities in estuarine and coastal waters, as well as the share of aquacultured products in the food supply. Negative experience with, and concern over the environmental impacts of intensive aquaculture practices, particularly those of shrimp and carnivorous finfish farming, and more recently of finfish ranching, has grown in parallel with industry expansion, leading, in turn, to an intensification in the debate over the appropriate substance, approach, and scope of industry regulation. The core of the debate over aquaculture regulation lies in the clash between a strong conviction among industry promoters that aquaculture is already over-regulated, and the reality of accumulating evidence that in spite of growing negative experiences with current intensive practices, relatively little has been learned and achieved in addressing various environmental implications of different types of aquaculture. A thorough and reflective understanding of the existing legal and regulatory system is a key factor in conducting and sustaining an informed and participatory discussion on the future of intensive aquaculture in the U.S., and on formulating societal expectations for industry environmental performance. This report aims to contribute towards the building and consolidation of such an understanding.

It consider a range of issues including the role of the fishing industry and its growth over the last 50 years; the legal framework for the marine environment and fisheries, at the national, European and international levels; the impact of fishing and the legacy of overfishing; aquaculture fisheries; marine protected areas; improved fisheries management; and a system of marine spatial planning. The report concludes that, as a society, we give much lower priority to protecting our seas compared with the land, and over-fishing is a global problem which has led to the collapse of fisheries in many areas. This situation requires significant urgent change which recognises the need for sustainable fisheries management and avoids the degradation of our seas, placing it within the context of wider management of human activities in the marine environment. Recommendations made include: the introduction of a Marine Act to establish a statutory framework with strategic objectives for marine environmental protection; a move away from a presumption in favour of fishing rights to a precautionary approach which requires demonstration that fishing activity is environmentally sustainable; establishing a network of marine protected areas within the UK over the next five years, which would lead to 30 per cent of the UK's exclusive economic zone being closed to commercial fishing; and a change in the emphasis of research away from management of fish populations towards a wider focus on the marine environment.
