The focus was on three areas of the industry: travel products and product providers including airline flights, hotels, recreational activities, and attractions; travel packages; and time-sharing or vacation sharing. An overview is presented of the nature of travel transactions, the regulatory environment, the size of travel-related problems, and the nature of the tourism industry in Canada. Problems are discussed at the pre-contractual, contractual, and post-contractual stages of the travel transaction and include telemarketing issues, the use of travel certificates, issues arising from technological advances, and issues covered under existing regulations such as misrepresentation, business failures, and licensing of agents. This is followed by a review of the federal and provincial laws governing the travel industry and of regulatory approaches used in other jurisdictions such as the United States and Britain. Finally, remediation of consumer problems and fraud is discussed, including co-ordinated law enforcement, inter- jurisdictional co-operation, self-regulation, and consumer education.
