Ford Aviation Investment and Reform Act for the 21st Century (AIR21 or FAIR21)(P.L. 106-181) contains a so called ''guarantee'' that uses House and Senate point-of-order rules to ensure that all aviation trust fund receipts (including interest) are spent for aviation purposes on an annual basis. This provision represents a compromise in what had become a contentious debate. When the legislation was first considered in the House in 1999 it contained two separate budget options for the trust fund. The first, taking the trust fund off-budget, was contained in the passed House version of the bill. The second option, which would have created a ''firewall'' around aviation programs, was dropped during later committee consideration. (1) Changing the budget treatment of the trust fund was opposed by the Clinton Administration and by some Members of the House and Senate Budget and Appropriations Committees. Reauthorization legislation passed by the Senate contained no budget treatment provisions. The budget treatment provisions in AIR21 were not challenged during the FY2001 appropriations process. Available in PDF, EPUB and Kindle. Book excerpt: The Airport Improvement Program (AIP) provides federal grants to airports for capital development. The April 5, 2000 enactment of the Wendell H. Ford Aviation Investment and Reform Act for the 21st Century (P.L. 106-181) was the culmination of two years of legislative effort to pass a multi-year Federal Aviation Administration (FAA) reauthorization, including authorization for AIP. The length of the struggle was an outgrowth of the difficulty of the issues Congress faced. During the 106th Congress, the House and the Senate passed two very different FAA reauthorization bills. It took until March 8, 2000 for conferees to come to agreement and the bill was not signed into law until April 5, 2000. This meant that the AIP was in abeyance for six months starting October 1, 1999. The House multi-year FAA reauthorization act, the Aviation Investment and Reform Act for the 21st Century (H.R. 1000), also referred to as AIR21, passed the House on June 15, 1999. It proposed a five-year AIP authorization at the following annual levels; $2.475 billion for FY2000, $4.0 billion for FY2001, $4.1 billion for FY2002, $4.25 billion for FY2003, and $4.35 billion for FY2004. It also included provisions for doubling the ceiling on Passenger Facility Charges(PFCs) under certain conditions. The increase of annual AIP spending and many of the formula changes in the bill were dependent on passage of provisions in H.R. 1000 that would have taken the Airport and Airway Trust Fund (hereafter, the aviation trust fund). The Senate version of H.R. 1000 (as amended by S. 82) the Air Transportation Improvement Act passed on October 5, 1999. It includes AIP authorization levels of $2.41 billion for FY1999, $2.475 billion for FY2000, and $2.41 billion annually for FY2001 and FY2002. It also included program changes affecting aspects of funding distribution, PFC waivers, and project eligibility criteria. Although the floor debate focused on non-AIP issues, some changes to AIP were included in the Senate-passed version including a new 5% apportionment for states that include a General Aviation Metropolitan Access and Reliever Airport, as defined in the bill. On April 5, 2000, the Wendell H. Ford Aviation Investment and Reform Act for the 21st Century (FAIR21, P.L. 106-181) was signed by the President. This $40 billion FAA reauthorization Act includes AIP authorizations of $2.475 billion for FY2000, $3.2 billion for FY2001, $3.3 billion for FY2002, and $3.4 billion for FY2003. The Act also Raises the PFC ceiling to $4.50. The new law includes so-called ''guarantees'' that all of each year's receipts and interest credited to the aviation trust fund will be made available annually for aviation purposes. One of the enforcement provisions makes it out-of-order in either the House or Senate to consider legislation for funding FAA's Operations and Maintenance or its Research, Engineering and Development budgets if the AIP and the Facilities and Equipment Budgets are funded below authorized levels. Supporters of AIP hope that this will assure AIP funding at the fully authorized level. This report will not be updated.

Book excerpt: Pursuant to a congressional request, GAO examined the proposal by a coalition of the seven largest U.S. airlines to replace the ticket tax with user fees, focusing on: (1) whether the ticket tax should be replaced by a different fee system; (2) what the potential competitive impacts of the fees proposed by the coalition airlines would be; (3) what factors need to be considered if a new fee system were to be developed; and (4) the implications on the Federal Aviation Administration's (FAA) budget of reinstating or not reinstating the taxes that finance the Airport and Airway Trust Fund. GAO found that: (1) because the ticket tax is based on the fares paid by travelers and not an allocation of actual FAA costs, it may not fairly allocate the system's costs among the users; (2) the coalition airlines' proposal to replace the ticket tax with user fees only incorporates factors that would substantially increase the fees paid by low-fare and small airlines and decrease the fees paid by the seven coalition airlines; (3) the proposal would dramatically redistribute the cost burden among airlines and could have substantial implications for domestic competition; (4) any replacement system for the ticket tax would need to account for the wide range of costs incurred by FAA in managing the airport and airway system; (5) the views of all affected parties, not just any particular group of airlines, would need to be included in assessing the mechanisms for financing the airport and airway system; and (6) Congress established a commission to study how best to meet FAA financing needs which will help ensure that, in the long term, FAA has a secure funding source, commercial users of the system pay their fair share, and a strong, competitive airline industry continues to exist.

Proposed reauthorization legislation was considered but not enacted in the 110th and 111th Congresses, although several short-term measures were passed to extend the authorization of aviation programs, funding, and Trust Fund revenue collections. The latest of these extensions--the Airport and Airway Extension Act of 2010, Part IV--was enacted on December 22, 2010, extending FAA programs, expenditure authority, and aviation trust fund revenue collections through March 31, 2011. This testimony provides an update on the status of the Airport and Airway Trust Fund, including the current financial condition of the Trust Fund, anticipated Trust Fund expenditures for planning and implementing improvements in the nation's air traffic management system that are expected to enhance the safety and capacity of the air transport system, and options for ensuring a sustainable Trust Fund.
