Book excerpt: This excellent book is translated from the original Arabic book 'Nidham ul Islam' by Sheikh Taqiuddin An Nabahani, an Islamic jurist, 'alim, writer and the founder of Hizb ut-Tahrir - the largest Islamic global political party under a single leadership. It lays out the fundamentals to develop a strong Islamic personality and da'wah carrier. It begins with laying the foundation by explaining the correct way to belief. It proves the existence of a creator intellectually and the Quran as the final revelation sent to humanity by Allah (swt). It then goes on to clarify the important creedal concept of Al-Qada wal Qadar (fate and destiny), which is often held in a vague or confused manner. The third chapter, its largest concentrates on explaining the different ideologies that exists namely Capitalism, Communism and Islam highlighting the differences between them giving the reader a clear framework to understand the world that we live in. After having laid the basis for the correct belief, intellectual and political thinking, it then moves onto address the key Islamic legal principles. The short chapters are intended to focus on the most important aspects such as Usuli subjects like the meaning of Hukm Shar'i, the types of ahkam shariah, Sunnah and emulating (ta'assi) the actions of the Messenger (saw). The last section of the book also clarifies misconceptions regarding spirituality and morals according to Islam as well as articulating the need for a constitution for the future Islamic state.

Book excerpt: Islam is an all inclusive way of life which covers the intellect and the real, the theoretical and the practical. The major part of the Islamic code of practice and behavior is formalised in the discipline of Islamic law which established itself as a discipline before other Islamic disciplines. The early Muslim jurisconsultants are to be credited as the pioneers of the development of the Islamic legal system. Shaikh Mohammad ibn Hasan ibn 'Ali Abu Ja'far al-Tusi (385-460 AH/995-1067 AD), who was given the honorary title of Shaikh al-Ta'ifat al-Imamiyyah (The Head of the Shi'a Islamic School) was at the orefront of these pioneers. His book Al-Nihayah fi Mojarrad al-Fiqh wa al-Fatawa (A Concise Description of Islamic Law and Legal Opinions) has been recognised as one of the major early sources, references and textbooks in the field of Islamic Law in general and of Shi'a Islamic law in particular. This book has been translated, edited and introduced by Professor A. Ezzati, and published by ICAS Press as the present volume.

Available in PDF, EPUB and Kindle. Book excerpt: Due to the intellectual decline that has affected the Muslims throughout the last few centuries the subject of Ijtihad has become vague in the minds of many, unfortunately, including some thinkers as well as Ulema. Different extremes exist, some believe the doors of Ijtihad are closed whereas others have broken the doors of Ijtihad altogether. The following are some of the key misconceptions that have crept into the minds: a) The doors of Ijtihad are closed i.e. it is impossible and not permitted to undertake Ijtihad today. b) The scope of Ijtihad includes most things including definitive matters such as the prohibition of Riba (usury) and the prohibition of having nation states with a multiplicity of rulers in the Muslim world. It allows Islam to be reformed in order to apply to the modern age. c) Ijtihad is only personal reasoning and not the hukm of Allah i.e. it is the reasoning of an individual and therefore cannot be a shariah rule. d) Ijtihad is an individual obligation (Fard Ayn) and therefore Taqleed (following an opinion of a Mujtahid) is prohibited (haram). This book “Essays on Ijtihad in the 21st Century” is a compilation of independent articles written over a period of time, put together in a logical sequence. Written in a lucid language this book is a suitable read for all those who want to understand the practical reality of Ijithad and how it can be applied to the current reality. This key Islamic concept needs to be understood even more so in this era where the enemies of Islam attempt to defame it and portray it as a backward religion unable to deal with modernity and the challenges of the technologically advanced world. The doors of Ijtihad are not only open, rather it is a great Islamic duty, a fard kifaya (obligation of sufficiency) and the revealed method by which we are able to extract the rulings of Islam for all problems we face until the day of judgement. Besides the confusion over Ijtihad, there is ambiguity over the definition and conditions of a Mujtahid. This book explains the types of Mujtahid namely the Mujtahid Mazhab, Mujtahid Masála and Mujtahid Mutlaq. Chapters of the book include: - Ijtihad and Applying it in the 21st Century – This chapter explains in detail what Ijtihad is, its scope and how it is indispensable for the Muslims to practice it. - Evidences for Ijtihad – This chapter clarifies that Ijtihad is not something new, rather it is something which is the part of Islam since the time of the Messenger of Allah (peace and blessings be upon him). - The Mujtahid – This chapter is about the conditions for Ijtihad and the types Mujtahid. - Exposing the Call for Reformation – This chapter elaborates how the word Ijithad is misused today by those who attempt to reform Islam and make it compatible with the secular liberal values. - Understanding Dar al-Kufr (land of disbelief) and Dar al-Islam (land of Islam). - Between Sufism and Salafism. - Moon sighting – Distinguishing between nationalism, political allegiance & fiqh (jurisprudence). - Understanding Illah (legal reason) and Qiyas (analogy).

Book excerpt: This book discusses the common principles of morality and ethics derived from divinely endowed intuitive reason through the creation of al-fitr' a (nature) and human intellect (al-‘aql). Biomedical topics are presented and ethical issues related to topics such as genetic testing, assisted reproduction and organ transplantation are discussed. Whereas these natural sources are God’s special gifts to human beings, God’s revelation as given to the prophets is the supernatural source of divine guidance through which human communities have been guided at all times through history. The second part of the book concentrates on the objectives of Islamic religious practice – the maqa' sid – which include: Preservation of Faith, Preservation of Life, Preservation of Mind (intellect and reason), Preservation of Progeny (al-nasl) and Preservation of Property. Lastly, the third part of the book discusses selected topical issues, including abortion, assisted reproduction devices, genetics, organ transplantation, brain death and end-of-life aspects. For each topic, the current medical evidence is followed by a detailed discussion of the ethical issues involved.

Available in PDF, EPUB and Kindle. Book excerpt: Muslims remain largely unaware of the importance and value of the Qur’anic principle of al-Shura (mutual consultation) and the significant role it can play in the advancement and reform of Muslim society. In this work, the author attempts to introduce and examine key meanings and practices of al-Shura, trace its historical evolution, and explore ways in which the principle can be introduced, institutionalized and applied in Muslim societies. There is no doubt that al-Shura has been sidelined throughout the Muslim world and the reasons for this are both historically and politically complex. According to the author, although much has been written on the subject, in reality it has been at best ineffectively applied and at worst heedlessly ignored. Even today it is a hotly contested issue. As al-Shura is increasingly associated with democratic participation in a decision-making process, debate has ignited with critics challenging the notion of equating the principle with western notions of democracy, with others claiming that the principle allows for a meaning that breaks the grip of centralized power. These and other issues are investigated with careful scholarship. Al-Raysuni concludes that al-Shura should be adopted as a way of life for all Muslims to protect their interests and as a vital tool for reconstruction and reform. In doing so he addresses the subject from some intriguing new angles, giving insight into areas hitherto little, if at all, examined.

This book was released on 2019-01-01 with total page 398 pages. Available in PDF, EPUB and Kindle. Book excerpt: Shaikh Muhammad al-Tahir ibn Ashur is the most renowned Zaytuna Imam and one of the great Islamic scholars of ‎the 20th century. The publication of this translation of Shaikh Ibn Ashur’s Treatise on Maqasid al-Shari’ah is a ‎breakthrough in studies on Islamic law in the English language. In this book, Ibn Ashur proposed Maqasid as a ‎methodology for the renewal of the theory of Islamic law, which has not undergone any serious development since ‎the era of the great imams. Ibn Ashur – quite courageously – also addressed the sensitive topic of the ‎intents/Maqasid of Prophet Muhammad (SAAS) behind his actions and decisions. ‎ He introduced criteria to differentiate between the Prophetic traditions that were meant to be part of Islamic law and ‎the Prophetic actions/ sayings that were meant to be for the sake of specific purposes such as political leadership, ‎court judgment, friendly advice, and conflict resolution. But Ibn Ashur’s most significant contribution in this book has ‎been the development of new Maqasid by coining new, contemporary, terminology that were never formulated in ‎traditional Usûl al-Fiqh. For example, Ibn Ashur developed the theory of the ‘preservation of lineage’ into ‘the ‎preservation of the family system’, the ‘protection of true belief’ into ‘freedom of beliefs’, etc. He also introduced the ‎concepts of ‘orderliness’, ‘natural disposition’, ‘freedom’, ‘rights’, ‘civility’, and ‘equality’ as Maqasid in their own ‎right, and upon which the whole Islamic law is based. This development opens great opportunities for Islamic law to ‎address current and real challenges for Muslim societies and Muslim minorities.‎
