Book excerpt: On August 2, 2005, President Bush signed into law the bill to implement the Dominican Republic-Central American Free Trade Agreement, or DR-CAFTA (P.L. 109-53, H.R. 3045). Drawing much attention during congressional debate were the agreement's sugar provisions to allow additional sugar from the region to enter the U.S. market. To assuage concerns expressed by some Members, the Administration pledged prior to Senate passage to take steps to ensure that all sugar imports, including those under DR-CAFTA, do not exceed a "trigger" that could undermine the U.S. Department of Agriculture's ability to manage the domestic sugar program. Sugar producers and processors responded that USDA's pledge did not address their long-term concerns, and continued last-minute efforts to defeat the agreement. In DR-CAFTA, the United States and six countries will completely phase out tariffs and quotas -- the primary means of border protection -- on all but four agricultural commodities traded between them in stages up to 20 years. The four exempted products are as follows: for the United States, sugar; for Costa Rica, fresh onions and fresh potatoes; and for the four other Central American countries, white corn. The Dominican Republic, El Salvador, Guatemala, Honduras, and Nicaragua have approved the agreement; Costa Rica's legislature is currently considering it. As it takes effect on a rolling basis, the U.S. agricultural sector will over time gain free access to the six highly protected markets on a reciprocal basis, matching these countries' current duty-free entry for nearly all their agricultural exports to the United States. Other provisions establish safeguards for specified agricultural products to protect U.S. and the region's producers from sudden import surges; prohibit the use of export subsidies between partners; and establish a mechanism to address sanitary and phytosanitary barriers to agricultural trade. DR-CAFTA's provisions, once fully implemented, are expected to result in trade gains, though small, for the U.S. agricultural sector. The U.S. International Trade Commission (ITC) estimates that $328 million in additional exports (primarily grains, meat products, and processed food products) would be offset by a $52 million increase in imports (largely reflecting additional access granted for sugar and beef from the six countries). Of the $2.7 billion increase in total U.S. exports that the ITC projects under DR-CAFTA, 12% would be attributable to the U.S. agricultural sector. Most U.S. commodity groups, agribusiness and food manufacturing firms, and the American Farm Bureau Federation (a general farm organization) supported DRCAFTA, expecting to benefit from the guaranteed increased access to these six markets. Cotton producers announced their support only after one major textile trade association came out in favor of it. The U.S. sugar industry strongly opposed the additional access for sugar imports from these countries, fearing its economic impact on domestic producers and processors. Two cattlemen trade organizations held differing positions on the agreement's beef provisions. The National Farmers Union (a general farm organization) opposed DR-CAFTA. Congress is expected to monitor developments on DR-CAFTA implementation during the second session of the 109th Congress. This report will be updated.

Book excerpt: The United States Trade Representative (USTR) and trade ministers from Costa Rica, El Salvador, Guatemala, Honduras, Nicaragua, and the Dominican Republic signed the Dominican Republic-Central America-United States Free Trade Agreement (CAFTA-DR) on August 5, 2004. Nearly one year later, it faced a contentious debate and close vote in both houses of the U.S. Congress. The Senate passed implementing legislation 54 to 45 on June 30, 2005, with the House following in kind 217 to 215 on July 28, 2005. President Bush signed the legislation into law on August 2, 2005 (P.L. 109-53, 119 Stat. 462). All other countries except Costa Rica have ratified the agreement. As of August 1, 2006, the United States has implemented the agreement for El Salvador, Honduras, Nicaragua, and Guatemala and will do so for the remaining two countries when they adopt the necessary regulatory and legal framework. Costa Rica stands alone in still needing legislative approval of the CAFTA-DR agreement, which is expected to occur in 2006. The CAFTA-DR is a regional agreement with all parties subject to "the same set of obligations and commitments," but with each country defining its own market access schedule. It is a reciprocal trade agreement, basically replacing U.S. unilateral preferential trade treatment extended to these countries under the Caribbean Basin Economic Recovery Act (CBERA), the Caribbean Basin Trade Partnership Act (CBTPA), and the Generalized System of Preferences (GSP). It liberalizes trade in goods, services, government procurement, intellectual property, and investment, and addresses labor and environment issues. Most commercial and farm goods attain duty-free status immediately. Remaining trade will have tariffs phased out incrementally over five to twenty years. Duty-free treatment will be delayed longest for the most sensitive agricultural products. To address asymmetrical development and transition issues, the CAFTA-DR specifies rules for transitional safeguards, tariff rate quotas, and trade capacity building. The CAFTA-DR is not expected to have a large effect on the U.S. economy as a whole, but some sectors and groups will be affected more than others. Supporters see it as part of a policy foundation supportive of both improved intraregional trade, as well as, long-term social, political, and economic development in an area of strategic importance to the United States. Opponents wanted better trade adjustment and capacity building policies to address the potentially negative effects on certain import-competing sectors and their workers. In light of the region's poor labor standards in some cases, the perception of inadequate labor laws, and widely accepted lax enforcement, opponents also argued that the labor provisions in the CAFTA-DR needed strengthening. The report focuses on the developing countries of Central America, namely Costa Rica, El Salvador, Guatemala, Honduras, and Nicaragua. The analysis presented in the report shows that the vast majority of the population in Central America is likely to experience welfare gains from implementation of DR-CAFTA, even in the short run. At the same time, the removal of trade barriers in sensitive agricultural crops could adversely affect a small share of the population living in rural areas in Central America. Although provisions in DR-CAFTA will allow for long timetables in reducing tariffs for the most sensitive products, appropriate support programs may need to be designed. In addition, selective investments in education, rural infrastructure, rural finance, and technical assistance will be required to ensure that the rural poor have the means to take full advantage of the new opportunities arising out of DR-CAFTA. Chapter 1 of the report reviews the main findings of the chapters in the order in which they appear. Chapter 2 places DR-CAFTA in the historical context of the economic reforms that Central American countries have been undertaking since the late 1980s. Chapter 3 provides a summary overview of the recently negotiated DR-CAFTA, with special attention on the extent to which the agreement's provisions would significantly change market access for Central American goods and services, and also on how far they could be expected to consolidate prior reforms. Chapter 4 reviews various analyses that assess the potential impacts of DR-CAFTA on the developing countries of Central America. Chapter 5 focuses on the identification and quantification of potentially affected populations from the easing of trade restrictions in sensitive agricultural products, and analyzes policy options to assist vulnerable groups.
